Head of State is above Executive, Judiciary and Legislature: Mnangagwa

Vice President Emmerson Mnangagwa says that there is nothing out of the ordinary with President Mugabe appointing the Chief Justice of the Supreme Court as the head of state is above all the arms of government. The Vice President said that the head of state is the executive, judiciary, and legislature and has the right to appoint the heads of the legislature and judiciary. Mnangagwa has of late been defending himself against numerous allegations of trying to undermine the independence of the judiciary, by amending the new constitution.

In an Interview with state newspaper The Herald, Mnangagwa said:

We have three arms of State — the Executive, headed by the President, the judiciary by the Chief Justice and the legislature by the Speaker.

We have one person who is above the executive, the judiciary and the legislature – the Head of State. So, when he exercises his powers to appoint the Speaker, Chief Justice – he does that as Head of State…Ndiwomatongegwo enyika aya.

So, the amendment is to deal with the issue of procedures. It does not derogate anything concerning independence of the judiciary. Independence of the judiciary is guaranteed in the Constitution. We are not tempering with that. I wanted that to be clear.
