ZEC Commissioner Wins Legal Battle Over Residential Stand

Dr. Qhubani Moyo, a Zimbabwe Electoral Commission Commissioner has won an 18 year legal battle over a residential stand. He has been fighting with Regina Masina the wife of the late Mr. Leonard Godfrey Masina. Masina was refusing to sign papers for the transfer of his rights, title, and interest in the stand he bought in 2001.

Justice Maxwell Takuva ordered Ms. Masina to sign the papers. Takuva revealed that the Sheriff of the High Court has permission to sign on her behalf in terms of section 3 of the Titles Registration and Derelict Lands Act. Takuva’s ruling read:

The first respondent (Estate of the late Leonard Masina), his agents, nominees or proxies or administration of his estate as the case may be, be and are hereby ordered to sign all papers necessary to effect cession of his rights, title and interest in the property called stand 14395 Selbourne Park, Bulawayo into the names of the applicant.

In the event that she fails to comply with the order, Dr Moyo wants to be granted leave for the Sheriff of the High Court to sign the papers in terms of section 3 of the Titles Registration and Derelict Lands Act.
