News:Magistrate To Rule On ZBC Bosses On Monday

<vote /> ZBC acting chief executive Patrick Mavhura and the national broadcaster’s acting head of finance and administration, Benania Shumba, who are facing criminal abuse of office related to a deal with Croco Motors involving 35 vehicles made an application for referral of the matter the Constitutional Court.

In the application they made three submissions, the first one was that the response made was filed by the investigating officer and not the prosecutor. Law mandates that a prosecutor must file state papers. Another issue they pointed out in their submission is that ZBC is not a state enterprise but a private entity and that they are not state officers. They also pointed out that they have been incarcerated for more than the required 48 hours. The prosecutor only objected to the first submission that their papers had been submitted by an investigating officer instead of him.

The Magistrate postponed the ruling of the matter to 22 August 2016.

In June 2016, Mavhura and Shumba appeared before Harare magistrate Ms Vongai Muchuchuti who released them on US$1 000 bail each. They were ordered to stay away from their workplace and to surrender their passports to the clerk of court. The two are accused of buying 35 vehicles Croco Motors without following due process, prejudicing Government of US$20 000. They face another charge of potentially prejudicing ZBC of US$738 900. According to court papers, on November 3 last year Mavhura wrote a letter to the permanent secretary in the Ministry of Information, George Charamba requesting authority to buy 45 vehicles, indicating he had consulted CMED officials who referred him to Croco Motors.
