The Econet group in Zimbabwe and an entrepreneur that operates a company called Dr. Dish are in a legal wrangle over the Kwese satellite TV service.
<a href="https://www.techzim.co.zw/2019/02/breaking-econet-cassava-accused-of-obstruction-of-justice-after-defying-high-court-order/" rel="noopener" target="_blank">According to an article on Techzim</a> The entrepreneur, Nyasha Muzavazi is accusing Econet of withholding information on money it owes him from a partnership they had when Kwese TV was launched in Zimbabwe in 2017.
Econet partnered Dr. Dish to use its satellite TV license since Econet did not have one itself. The two companies apparently had an agreement to share revenue from subscriptions to the Kwese TV service. The entrepreneur, however, accuses Econet of claiming they only owed him $8 (eight dollars) where the evidence from Econet’s own public press information indicated they owed him $6.8 million since the service had over 40,000 subscribers before the agreement was terminated by Econet.

Yesterday (Saturday) Muzavazi successfully got a High Court order to search EcoCash records to determine what exactly his company is owed but he was stopped by the company and ordered to leave EcoCash premises where the search had begun.
Muzavazi says him and the Sherrif of the High Court were told by someone representing EcoCash to leave. Said the representative:
<blockquote>I have received a call from a higher office saying, ‘tell the people that are executing the Order to stop what they are doing there and leave peacefully now.’ I therefore direct you to stop whatever you are doing and leave this place peacefully now</blockquote>
Commenting on the issue, Econet has said:
<blockquote>On perusal of the Order we noticed that neither EcoCash Private Limited nor Econet Wireless (Private) Limited, who are the custodians of the said information, had been cited as parties to the order.
EcoCash have since filed an Urgent Chamber Application in the High Court to have the issue resolved.
We would like to categorically state that EcoCash (Private) Limited have no relationship with the said Dr Dish. The relationship which Dr Dish had with our affiliate Econet Media was terminated in November 2017.</blockquote>
Kwese TV was a service provided by Econet Media under the umbrella of the Econet group of companies in Zimbabwe. The service was shut down last year following business viability issues.

Entrepreneur Fights Econet Over Kwese

Kwese TV’s former broadcast partner, Dr Dish, has submitted a $3.5 million bid in order to broadcast matches from the domestic Premier Soccer League (PSL). This comes at a time when Dr Dish’s former partners, Kwese TV, said that at present they had no interest in broadcasting the local league. If Dr Dish’s bid is accepted by the PSL, the domestic league will receive $750 000 per year for the next five years.
50% of Dr Dish is owned by Zimbabwean lawyer Gerald Mlotshwa through his private family vehicle Ktulu Nominees after a deal that was signed in January. This makes Mlotshwa’s family the largest shareholder in Dr Dish. Mlotshwa is married to President Emmerson Mnangagwa’s daughter, Farai Mnangagwa.
Sources from Dr Dish told the Herald,
<blockquote>The leadership at Dr Dish believe interest in Zimbabwean football is very high throughout the country with thousands, if not millions, of people following what happens at our stadiums every weekend with religious interest.
They believe, if well-packaged, and with a lot of matches being covered, there is a market out there that has an appetite for content that is generated from the local Premier League and which a lot of people want to see on their televisions at home, in the bars or in the offices.
Of course, the decision rests with the PSL leaders and let’s see how it pans out but clearly, this is far more money, which has been put on the table, than what the PSL were getting from their previous deal with SuperSport.</blockquote>

Mnangagwa's Son-In-Law Bids $3.5 Milion For Local Football Rights, As Kwese Shows No Interest

Sources interviewed by Techzim revealed that Econet Media which provides Kwese TV terminated its contract with Dr Dish because of its ties to President Emmerson Mnangagwa’s son in law Gerald Mlotshwa.
Mlotshwa who is married to President Mnangagwa’s daughter acquired a 50% stake in Dr Dish. He also has a 40% stake in Telecel, one of Econet’s competitors. Techzim writes that it was only logical for Econet Media to terminate the contract with Dr Dish given that Mlotshwa has a stake in one of Econet’s competitors as this would pose a conflict of interest issue,

Kwese TV Terminated Contract With Dr Dish Because Of Mnangagwa's Son In Law

Econet Media’s partner Dr Dish has threatened to report the providers of Kwese TV to the Zimbabwe Anti-Corruption Commission (ZACC) for operating without a broadcasting license as stipulated by  the Broadcasting Services Act Chapter 12:06.
Speaking to Techzim, Nyasha Muzavazi, the Executive Chairman of Dr Dish,said Econet Media is breaking the law. muzavazi said they are consulting their lawyers and will take appropriate action which may include reporting Econet Media to ZACC. Said Muzavazi:
<blockquote>What I can only say as an Industry player is that, there is no provision in the Broadcasting Services Act Chapter 12:06 for anyone to operate a Broadcasting Service without a License. Erecting of Broadcasting Apparatus at households in Zimbabwe by Kwese without a License is illegal and a criminal offence in terms of the Broadcasting Services Act .Operating of a Broadcasting Services called Kwese without a valid License is illegal in Zimbabwe. As Dr Dish we are still consulting our lawyers and will take appropriate action as would be advised, which may include taking the matter to ZACC for investigations.</blockquote>
When reached for comment by Techzim, Econet Media (Kwese) responded advising that they would definitely respond with their official position by end of day on Thursday. There is still no response from Econet Media. Techzim also reached out to the Permanent Secretary in the Ministry of Information Media and Broadcasting Services, George Charamba and he was too busy to discuss Kwese. Currently this ministry doesn’t have a minister.

Dr Dish Threatens To Report Kwese TV For Corruption

Kwese TV risks being pulled out of Zimbabwe after Econet Media reportedly activated its “contractual termination clause” with Dr Dish, the licence holder whom they were running their Kwese TV services in the country.
The Herald reports that Econet Media wrote to the Broadcasting Authority of Zimbabwe (BAZ) on November 10 with High Court record HC9182 /17 indicating that they had severed ties with Dr Dish. When contacted for comment by the publication, Econet Media consultant Mr Zachary Wazara said there was no risk of the service to our customers being interrupted now or in the future as Kwese operations have the authority of government.
However, The Herald reports that Kwese TV is operating on a permit and not a licence as provided for in the BAZ Act which could present complications for them. Dr Dish’s Nyasha Muzavazi said they are currently studying the letter to BAZ and will be guided by their advisors on the way forward.
