The founder of the #ThisFlag movement <a href="https://pindula.co.zw/Pastor_Evan_Mawarire">Evan Mawarire</a> condemned the passage of the Criminal Law (Codification and Reform) Amendment Bill in the ZANU PF-dominated National Assembly (Lower House of Parliament) on Thursday.
The proposed law contains the contentious Patriotic clause that seeks to punish Zimbabweans who speak badly about the country or associate with foreign diplomats or any other foreigners discussing such issues.
Mawarire said the Bill criminalises citizens’ rights such as freedom of speech, freedom of association, and assembly. He wrote:

Very sad day for Zimbabwe. Parliament passed the draconian Patriot Act.
It criminalizes freedom of speech, freedom of association, and assembly and disallows Zimbabwe citizens from engaging foreign government officials.
Zimbabwe has become far worse than any of us imagined.

Citizens Coalition for Change (CCC) spokesperson and lawyer <a href="https://pindula.co.zw/Fadzayi_Mahere">Fadzayi Mahere</a> said:

Did you know? A person convicted under the “Patriotic Bill” can potentially face the death sentence.
This violation of the right to life under Section 48 of the Constitution which says the death penalty can only be imposed for murder committed by men between 21-70 years.

Harare East MP, <a href="https://wiki.pindula.co.zw/Tendai_Biti">Tendai Biti</a> (CCC), who vigorously debated against the passing of the Bill in the National Assembly said:
<blockquote>
It was a day indeed as Parliament passed the Patriot Bill this evening.
The new law is an unprecedented law that seeks to proscribe freedom of association, assembly, and speech of any citizen holding a meeting with a foreign government.
Not even Apartheid Rhodesia passed such repugnant law.
</blockquote>
The Bill seeks to amend the Criminal Law (Codification and Reform) Act [Chapter 9:23], which has four clauses, three of which have been described as progressive excluding Clause 2.
Clause 3 will amend Section 65 of the Principal Act to make 15 years the minimum required punishment for rape, in response to the rise in crimes of sexual violence and rape.
Clause 4 proposes to amend Section 155 of the main Act’s definition of dangerous drugs to include prepared opium, prepared cannabis resin, and a drug schedule.
Clause 5 proposes to amend Section 174 of the main Act as the existing definition of criminal abuse of office, as provided for in Section 174 (i), is fairly broad, allowing public officials to be charged for honest mistakes made while doing their duties.
At least 99 Members of Parliament voted in favour of the amendments while 17 voted against resulting in the adoption of the amendments.
Justice, Legal and Parliamentary Affairs Minister <a href="https://wiki.pindula.co.zw/Ziyambi_Ziyambi">Ziyambi Ziyambi’s</a> proposed amendments to Clause 2 (3) read as follows:

Any citizen or permanent resident of Zimbabwe who, within or outside Zimbabwe, intentionally partakes in any meeting, whose object or one of whose objects the accused knows, or has reasonable grounds for believing involves the consideration of or the planning for the implementation or enlargement of sanctions or a trade boycott against Zimbabwe (whether those sanctions or that boycott is untargeted or targets any individual or official, or class of individuals or officials), but whose effects indiscriminately affect the people of Zimbabwe as a whole, or any substantial section thereof shall be guilty of wilfully damaging the sovereignty and national interest of Zimbabwe and liable to…
The clause provides penalties that include a fine not exceeding level twelve or imprisonment for a period not exceeding 10 years, or both.

The Bill sailed through after the Parliamentary Legal Committee issued a Non-Adverse Report on amendments that had been adopted.

Political Activists Condemn Passage Of 'Patriotic Bill' In Parliament

Activist and cleric Evan Mawarire wants his case against police in which he is seeking US$65 000 in damages which was struck off the roll to be retried after he failed to appear in court for the trial. Mawarire has filed an urgent chamber application with the High Court seeking a re-trial for the case, The Herald reports.
Through his lawyers Mawarire said he did not appear in court because of an error caused by his receptionist:
<blockquote>As appears on the set down notice, it was received by the receptionist on 4 June 2020 at 12:09 hours. However, the receptionist did not forward the notice to me on time as I only got to realise it later after 1200hours on 8 June and this matter had been set down for trial at 1000hours. In fact, a colleague who was in court that day called and advised that the matter had been struck off the roll because no one had appeared</blockquote>
Mawarire has cited Home Affairs Minister and several police officers including police general Godwin Matanga for damages emanating from his arrests and detention from 1 February 2017 to 29 November 2017 for demonstrating which is his constitutional right.

Zimbabwean journalist and filmmaker, Hopewell Chin’ono has said the Zimbabwean masses are ready for a revolution while the leadership is not.

His remarks come when some have accused the opposition MDC of using baby gloves and employing student activism tactics on the corruption-accused ruling ZANU PF.
MDC, however, previously tried to stage demonstrations but the state blocked the demos saying there was overwhelming evidence to suggest that the protests would degenerate into chaos.

The trial date for Evan Mawarire has been set to 24 June 2019. Mawarire together with the President of Zimbabwe Congress of Trade Union (ZCTU) Peter Gift Mutasa, and Secretary General Japhet Moyo are facing charges of inciting public violence which took place in the country earlier this year.
Mawarire is the leader of #ThisFlag Zimbabwe and together with his counterparts Mutasa and Moyo published a video which went viral on social media urging Zimbabwean workers not to report duty.
Harare Magistrate Mrs. Rumbidzai Mugwagwa dismissed their applications for refusal of further remand stating:

Evan Mawarire's January Protests Trial Set For 24 June

A Harare magistrate on Monday dismissed an application for refusal of remand filed by three civil society leaders who are facing treason charges related to the January fuel protests.
The three are the Zimbabwe Congress of Trade Union (ZCTU) president Peter Mtasa, secretary-general Japhet Moyo and #ThisFlag leader Evan Mawarire.
Alec Muchadedama, who is representing Mtasa and Moyo said:
<blockquote>The State said they need six weeks to complete the investigations and now it is more than six weeks.
There is only one exhibit which is a video, but they are taking more than six weeks to investigate that video.
The State was stampeding us to try public violence matters after just 30 minutes of the arrest, but now they are refusing to try our clients within that period.</blockquote>
Rumbidzai Mugwagwa dismissed the application. She said that the State had demonstrated to the court the progress they had made for the purpose of coming up with a trial date.
The matter was postponed to April 16.

State Dismisses Treason-accused Trio's Freedom Bid

ThisFlag flagbearer pastor Evan Mawarire has laughed off allegations made against him by Jealousy Mawarire, spokesperson of the opposition party, National Patriotic Front.
The NPF official has suggested that the clergyman is working in cahoots with the country’s military. In response, pastors Mawarire said:

ThisFlag Leader Laughs Off NPF Claims That He's Sponsored By Army

National Patriotic Front (NPF) spokesperson Jealousy Mawarire has said ThisFlag activist and cleric Evan Mawarire was sponsored by the army to oppose former President Robert Mugabe.
Speaking on Twitter on Mugabe’s 95th birthday on Thursday, Jealousy Mawarire said the army gave Pastor Evan protection and brought tickets for him and his family to go to the United States. He was responding to Pastor Evan’s comment on Mugabe’s birthday. Pastor Evan had said it is hard for him to say happy birthday to a man who ruined millions of birthdays. Said Pastor Evan:

Evan Mawarire Was Sponsored By Army To Oppose Mugabe- NPF Spokesperson

Zimbabwean pastor and activist Evan Mawarire said there are hundreds of people still in jail with wounds from beatings by security forces.
Mawarire was released from Chikurubi Maximum Prison on Wednesday evening, after being granted $2,000 bail on Tuesday. Mawarire is accused of treason and  is on bail pending trial. He was arrested for calling on Zimbabweans to join the 14 – 16 January Shutdown Zimbabwe stayaway. Speaking to journalists after being released from Chikurubi Mawarire said President Emmerson Mnangagwa’s government is behaving like that of former leader Robert Mugabe. Said Mawarire:
<blockquote>Once again we have to run and hide. It breaks my heart. I was locked up with over 300 young men whose limbs were broken after being beaten by soldiers and police. It is a tragedy, it is a shame. There are 16-year-olds who have been locked up.”</blockquote>

Evan Mawarire: I Was In Jail With Over 300 Young Men Whose Limbs Were Broken After Being Beaten By Soldiers And Police

This Flag Movement Leader Evan Mawarire was on Tuesday granted bail by the High Court in Harare. Mawarire has been in custody for more than a week.
He is facing charges of subversion and is accused of inciting protests which degenerated into rioting on January 14 this year.
The High Court in the capital, Harare, says Evan Mawarire must pay $2,000 and report to police three times a week.

BREAKING: Evan Mawarire Granted $2 000 Bail By The High Court

Pro-democracy activist and founder of #This Flag Movement, Evan Mawarire has slammed the mid-term monetary policy statement released by Reserve Bank of Zimbabwe (RBZ) governor John Mangudya on Monday. Mawarire complained that ordinary citizens are being robbed again through the government’s policies.

Pro-democracy activist and aspiring candidate for Harare City Council, Pastor Evan Mawarire has revealed that contrary to Zimbabwe Electoral Commission (Zec) chairperson Justice Chigumba’s assertion that the Voters’ Roll was now available, he failed to get it. Mawarire revealed that he wanted to collect a copy of the Voters’ Roll for his Mt Pleasant ward following Chigumba’s announcement. However, he got the runaround at Zec and was told that the Voters’ Roll may be ready on Monday. Said Mawarire,

Justice Chigumba had previously claimed that the Voters’ Roll was now available, saying that candidates could collect electronic copies starting Friday. Said Chigumba at a press conference.

On Thursday, <a href="https://news.pindula.co.zw/2018/06/14/high-court-orders-that-zec-must-provide-electoral-resource-centre-with-provisional-voters-roll-within-5-days-of-payment/" rel="noopener" target="_blank">High Court judge Justice Tawanda Chitapi ordered Zec to provide independent electoral watchdog, the Electoral Resource Centre (ERC) with a copy of the provisional voters’ roll within five days</a> of a demand being made. The Lovemore Madhuku led National Constitutional Assembly (NCA) party a<a href="https://news.pindula.co.zw/2018/06/15/lovemore-madhukus-nca-sues-zec-over-voters-roll/" rel="noopener" target="_blank">lso sued Zec at the High Court on Thursday, demanding the release of the voters’ roll</a> before the sitting of the nomination court.
Commenting on the matter on Twitter, former minister David Coltart said,

Question Marks Over Zec And Chigumba's Credibility After Candidate Fails To Get Voters' Roll, Told To Check Monday

In an interview with DW, Germany’s public international broadcaster, Evan Mawarire (EM) spoke about his decision to move into mainstream politics and the future of  #ThisFlag movement.
Mawarire said he has always been in mainstream politics because he spoke out and the only difference is that he is now running for office. He said that #ThisFlag will continue as a citizen’s movement since it is not owned by one person. Below is an excerpt of Mawarire’s interview:
<blockquote>DW: What has informed the formation of POVO?
EM: The formation of POVO — the People’s Own Voice — has been informed by the desperate need that the city of Harare finds itself in in terms of service delivery. Up to today we have areas in Harare that have had no water for 15 years. Up to today we still deliver very dirty and very dangerous water to the residents of Harare. We have got potholes; our road network is completely dilapidated and needs to be revived again. Those are the things that my generation feels urgently need attention.
 
DW: Does this signal your entry into mainstream politics?
EM: The sign for me getting into mainstream politics was in 2016. I have been in mainstream politics in terms of speaking into it for the last two years. There is nothing that has changed. All I have done is to say, I am now going to become a candidate. But it’s important for Zimbabweans to be involved in the politics of our nation. Nobody should disengage. Everyone is involved in politics. If you are a registered voter, you are actually the central aspect of politics in Zimbabwe.
DW: What is the future of #ThisFlag?
EM: The #ThisFlag citizen movement continues. It is not the ownership of one person but it is found in the heart of Zimbabweans. They are many Zimbabweans who are doing what this flag was advocating for. Our job was to empower citizens to speak up and to stand up. I think we have been able to achieve that in the last two years. There are more Zimbabweans today who are having conversations about politics and the direction of politics than ever before. Our payoff line, if you remember, was: If we cannot cause the politicians to change then we must empower the citizen to be bold. Today is a result of that payoff line.</blockquote>

Evan Mawarire On Why He Joined Politics, #ThisFlag Movement's Future

Deliberately I chose not to run for office as an independent candidate because I am a staunch advocate for a grand coalition (involving political parties &amp; other organizations/movements). Not only that, it’s a public secret that I support and obviously serve my brother and mentor <a class="profileLink" data-hovercard="/ajax/hovercard/user.php?id=777339917&amp;extragetparams=%7B%22fref%22%3A%22mentions%22%7D" data-hovercard-prefer-more-content-show="1" href="https://www.facebook.com/nelson.chamisa?fref=mentions">Nelson Chamisa</a>.
I worked with some of these guys who are going to run for council seats under POVO. Our efforts towards pushing to be absorbed into the alliance did not yield much. No headway could be made.

My honest position is that both sides have somewhat valid reasons.
In as much I have misgivings over the manner in which the process was handled, I still resolutely believe that we need to fight ZANU – PF from one corner rather than in silos. The proliferation of political parties and independent candidates is concerning and in some cases senseless. Admittedly, there are justifiable reasons in some instances. After all, everyone has the right to make any form of political choices within the confines of our constitution.
Bar the skullduggery, kindergarten pettiness and even myopic resistance I have encountered in my quest to contribute from the standpoint of convergence or even to merely serve the people’s President, Chamisa, I will continue doing my utmost best. Besides, it is my belief that leadership does not start and end in council or Parliament. I don’t need to be in Parliament to prove my leadership mettle. I will lead and be the change where I am.
Ultimately, it will be amiss for me to watch while false conjectures and explanations are proffered regarding some of these individuals. I have read with disdain how individuals like Mawarire are being lampooned by some as ZANU – PF agencies for choosing to run as independent candidates. Based on what I know, having been involved in some of these processes one way or another, I can categorically confirm that these are merely individuals who feel they can contribute towards changing people’s lives.
Of course, I don’t agree with the path they chose. To me, a grand coalition/alliance is what we need to dismantle ZANU – PF but I find politics premised on lies and dishonour detestable.
I wish these POVO guys all the best today as they launch their ‘thing’.
