Harare High Court judge, Justice Owen Tagu has ordered the Registrar of Birth and Death registration to allow fathers to apply for and obtain birth certificates for their children born out of wedlock if the mothers deserted or abandoned their children.
The judgment which was handed down on 8 November 2021 came after Bernard Tashu together with the Child rights activist, Petronella Nyamapfene approached the High Court to compel the Registrar to comply with the Birth and Death Registration Act which allows fathers to apply for birth certificates for their children in circumstances where the mother abandoned or deserted the child.
The Registrar was refusing fathers to secure birth certificates of their children without a marriage certificate or without the mother of the child.
Tashu was represented by the Child Rights lawyer, Pamela Musimwa of the Justice for Children, whilst Nyamapepfene was represented by Darlington Marange of the Zimbabwe Human Rights NGO Forum.

Single Fathers Granted Right To Acquire Birth Certificates For Their Kids

A High Court judge has ruled that banning the use of spikes by traffic police to stop vehicles refusing to obey orders to halt would be as good as legalising crime and disempowering police from maintaining law and order.
The ruling was made by Justice Owen Tagu following an application by the Passengers Association of Zimbabwe (PAZ), who were seeking an interdict prohibiting officers from using the strips of spikes and smashing windscreens of private taxis to halt pirate taxis and kombis.
PAZ argued that the conduct by the police endangered the lives of the public and cause blatant unlawful and malicious damage to private property that police are supposed to protect.
Through its legal counsel, PAZ argued that police should be barred from practising this “rudimentary” and “barbaric” way of enforcing traffic offence law.
However, the court accepted the police argument that operators of pirate taxis were not just committing traffic offences only but other crimes that could be classified as more dangerous.
The police said some of the crimes committed by Mushikashika crews include drug abuse, harassment of commuters especially women, and theft and robberies.
Some of the vehicles used as pirate taxis are unregistered and mostly driven by immature and unlicensed drivers, police argued.
The ZRP also argued that the conduct of the pirate taxis had resulted in a spike of pedestrian deaths as they are run over by vehicles fleeing police officers.
The police further argued that touts employed by errant drivers, assault and kill police officers when they try to impound their vehicles and arrest the violators.
It was on this basis that Justice Tagu refused to grant the application by PAZ. He said:
<blockquote>To grant the application would be tantamount to legalising the actions of these errant motorists as the police would be incapacitated to deal with them.</blockquote>

High Court Approves Use Of Spikes By Traffic Police

The Supreme court reserved judgement in the case in which the National Prosecuting Authority (NPA) is challenging the high court&#8217;s ruling to acquit <a href="https://www.pindula.co.zw/Wicknell_Chivayo">Chivayo</a> on fraud charges in the Gwanda Solar energy deal, The Herald reports.
The presiding judge Justice <a href="https://www.pindula.co.zw/Owen_Tagu">Owen Tagu</a> ruled that Wicknell and Intratrek had no criminal case to answer as the matter between ZPC and Intatrek was contractual.
According to the publication:
<blockquote>Justice Tagu’s judgment criticised the State for “malicious prosecution” of Mr Chivayo on a contractual dispute incapable at law of being resolved through the criminal justice system.
He ruled that compelling a civil matter to be determined by the State through the criminal justice system was not only wrong but set a dangerous precedent if not tamed at its inception.
In addition, Justice Tagu said that if the courts allowed such prosecutions to occur in this country, no investor would open themselves to the extreme exigencies of having the fate of their investment determined by a criminal court.</blockquote>
