The trial of Vice President Constantino Chiwenga’s ex-wife, Marry Mubaiwa on an attempted murder charge, failed to start on Thursday after she fell sick and vomited in the dock.
Mubaiwa’s lawyer, Beatrice Mtetwa then asked for the postponement of the matter to 13 March.
However, prosecutor Lancelot Mutsokoti insisted on going to trial saying he had to call off his official leave to prosecute the matter.
Mtetwa told Harare magistrate Florence Chakanyuka that Mubaiwa was not fit to stand trial, but had no medical affidavit to support her argument. She said, as quoted by <a href="https://www.newsday.co.zw/local-news/article/200007547/chiwengas-ex-wife-vomits-in-court-trial-deferred">NewsDay</a>:
<blockquote>
She is not fit to stand trial. You said a medical report is required, but she does not have the medical report because the doctors are afraid of VP Chiwenga, who happens to be the Health minister.
Look, she is sleeping in the dock. You can have a physical inspection of the dock and if you’re quite happy to see her as being fit, then we can proceed to trial. This is not our creation.
We have a judgment concerning that a fair trial includes accused persons being in a state of mind that allows him or her to concentrate.
Ironically, the case law involved the same accused where your brother magistrate Ngoni Nduna insisted she goes through a trial when she is unwell, and this is a breach of the right to a fair trial.
She cannot follow the proceedings. With due respect, it is a clear breach of the Constitution which requires that there be equality for the law as section 56 of the Constitution states.

The matter was remanded to this Friday for trial.

Marry Mubaiwa Vomits In Court, Trial Deferred

Marry Chiwenga has said she sought the help of Zimbabwe Defence Forces (ZDF) commander Philip Valerio Sibanda in her dispute with her husband, Vice President Constantino Chiwenga after the latter unleashed soldiers to terrorise her.
Marry told The NewsHawks reporter Bridget Mananavire that she reached out to General Sibanda after soldiers started to meddle in her domestic affairs.
The former model claimed that armed soldiers came to her offices and intimidated her workers causing them to run away in terror.
Marry also said soldiers recently broke down her Highlands office wall after they had ransacked her offices and took bank statements, contracts, invoices of things and took other personal documents.
Responding to a question on whether she had tried engaging the Zimbabwe Defence Forces (ZDF) or their commander to find out why soldiers are being used in a domestic matter, Marry said:
<blockquote>Yes, we have before. And even now I have written him ( ZDF commander Phillip Valerio Sibanda) a letter.
My lawyer, Beatrice Mtetwa, also wrote to them before. I have also written to (ZDF commander Philip Valerio) PV Sibanda which we were typing, to say your soldiers continue to terrorise my office because the Vice-President doesn’t have soldiers, the soldiers serve under PV so they belong to him.
I said to him your military personnel continue to terrorise my office, to terrorise me and they continue to loot my things, what is going on? Why all this intimidation?
Why are you doing this to me or to my office? Why are you doing it? For what reason? So, 
we’ve engaged him, but he has not responded.</blockquote>
Marry also said she appealed to President Emmerson Mnangagwa so that she could get a new passport to enable her to travel to South Africa for medical care.
This came after judges refused to release her passport which is being held as part of her bail conditions. She said:
<blockquote>&#8230; I asked the President to give me another passport so that I can get medical attention. He said he was going to secure a passport for me and money to go and get medical attention, but it’s out of the window.
As you can see, I am still here. I am still very much in pain. I am still suffering. Medically, not much has happened.</blockquote>

Marry Chiwenga Engages Army Commander Over Harassment By Soldiers

Vice President Constantino Chiwenga&#8217;s estranged wife, Marry, has warned him that power does not last forever, alleging that he is using his political muscle to persecute her since their marriage became strained in 2019.
Posting on Twitter, Marry accused Chiwenga of hypocrisy for taking part in Roman Catholic &#8220;Mass&#8221; while he denies her access to their children.
Marry also accused her husband of having her thrown into prison and further claimed that Zimbabwe&#8217;s judiciary is being compromised. <a href="https://twitter.com/MarryMubaiwa/status/1367339443825295363" target="_blank" rel="noopener">She wrote:</a>

In 2020, the High Court dismissed Marry&#8217;s application to have her bail conditions relaxed so that she could go to South Africa to seek medical treatment.
She is suffering from an ailment that causes swelling of her hands and legs.
The former model has since filed an application at the Supreme Court against Justice Chikowero dismissing her appeal last year.

Marry Mubaiwa Chiwenga has joined Twitter and according to The News Hawks, she plans to use her handle to pour her heart out and detail the incidences occurring in her life. The News Hawks also posted images of Marry&#8217;s swollen hands which have very large wounds and her feet are also swollen.

Marry Mubaiwa Sets Up A Twitter Account To Pour Her Heart Out

The two warrants of arrest issued on Monday morning against Vice President Constantino Chiwenga&#8217;s estranged wife Marry Chiwenga have been cancelled at the Harare Magistrates’ Courts.
A visibly unwell Chiwenga was brought to court in an ambulance on Monday afternoon after her no-show in the morning prompted Magistrate Ngoni Nduna to issue out the two warrants of arrest.
Marry&#8217;s lawyer Beatrice Mtetwa told the court in the morning that her client was not well and couldn’t make it to court and asked the court to remand her in absentia.
However, magistrate Ngoni Nduna said an administrative warrant would only have been possible if she was in the hospital.
Chiwenga is facing charges of attempted murder, money laundering, and assaulting a family maid.
Images of Marry seated in a chair and on a drip sparked outrage on social media. Veteran lawyer David Coltart tweeted:
<blockquote>The manner in which Mrs Chiwenga was treated this afternoon- hauled before a magistrate demonstrably ill, on a drip, attended by nurses &#8211; is utterly shameful.
This is a shocking travesty of justice. The magistrate should be disciplined &#8211; [Law Society of Zimbabwe] speak up, please.</blockquote>
Renowned journalist Violet Gonda also tweeted:
<blockquote>This is happening as we commemorate the 16 days of activism against gender-based violence. A visibly unwell Marry Chiwenga was wheeled out of an ambulance into court.
[Joana Mamombe] and co had similar experiences. This is more than systemic abuse of women. It’s dehumanising and degrading.</blockquote>
Meanwhile, Mtetwa told the court that Marry is set to travel outside the country for medical attention and applied that the matter is set for January 28 to enable her time to recover and seek medical attention.

Warrants Of Arrest For Marry Chiwenga Cancelled

WATCH: Sickly Marry Chiwenga Stretchered To Magistrates' Court

Vice President Constantino Chiwenga packed her estranged wife Marry Mubaiwa&#8217;s property and dumped it at her offices in Eastlea, Harare on Friday.
The property was taken from the couple’s Borrowdale Brooke mansion and driven to Marry&#8217;s offices by soldiers who were led by Lieutenant Colonel Hove and another senior military officer only identified as Lawayo.
An insider close to the developments told The Standard that the soldiers who numbered about 40, allegedly said they were working under the former Zimbabwe Defence Forces commander. Said the insider:
<blockquote>Chiwenga’s team arrived at around 5:30 pm and that was already after business hours so most people were not around.
There were about 40 of them in a lorry driven by one Zengeni.
They claimed the Vice-President was coming with the other property.
This was meant to instil fear in the two guards who were at the premises.
We are all shocked at Chiwenga’s decision to dump the property at the offices when he knows where Marry stays.</blockquote>
The property included three top-of-the-range vehicles, plates, clothes, blankets and kitchen utensils.
The vehicles included an unregistered Ford Ranger Wildtrak, a Range Rover and a Kia.
Marry was reportedly away from the offices when the property was dumped as she is said to be gravely sick.
Chiwenga and Marry have been living separately since last year, with the VP now staying at a Chinese hotel in Harare.

Chiwenga Clears Marry's Property, Dumps It At Her Offices

Local water delivery company Hesno Holdings Private Limited trading as Water To You has taken Marry Chiwenga to court after she failed to settle her water bill of $6000, New Zimbabwe reports. According to court papers seen by the publication, Marry has not indicated any willingness to settle her water bill which is just above US$6000:
<blockquote>Plaintiff and defendant entered into an agreement of sale in terms of which the plaintiff would supply water and the defendant would pay for the water supplied. The plaintiff is in possession of two detailed invoices of the quantity of water supplied and the total amount which is overdue.
Despite several demands, defendant has failed, refused and or neglected to make payments. Wherefore, plaintiff prays for payment in the sum of US$6 055 being outstanding balance for the water supplied, an order for interest on the said sum at the prescribed rate per annum from the date of issue of summons to date of final payment.</blockquote>
The case is yet to be heard before the court.

Water Company Takes Marry Chiwenga To Court Over $6000 Water Debt

The trial of Marry Chiwenga, the estranged wife of Vice President Constantino Chiwenga on assault charges was postponed on Tuesday because some witnesses travelled to their rural homes just before the commencement of the national lockdown.
The State proposed to postpone the case to June 20 but it was revealed that Chiwenga had already been booked for surgery for June, therefore, the trial was deferred to July 27.
Chiwenga’s lawyer Beatrice Mtetwa confirmed the development, saying her client was supposed to undergo surgery for injuries sustained in the Bulawayo blast at White City Stadium in 2018. Said Mtetwa:
<blockquote>Your Worship, it is correct that today (yesterday) was the day for trial commencement, but we were told that witnesses are not available.
The State had proposed a new date that is June 20, but my client is supposed to undergo an operation during the same month.
The operation is due to the injuries she sustained during the Bulawayo blast. Also by June 20, she would not have fully recovered.</blockquote>
Chiwenga was arrested earlier this for allegedly assaulting a family helper, Delight Munyoro, at Hellenic School in Borrowdale following an altercation over the custody of children.

Marry Chiwenga To Undergo A Medical Operation

MDC MPs in parly this week mocked <a href="https://www.pindula.co.zw/Constantino_Chiwenga">Vice President Chiwenga</a> and referred to him as a senior bachelor and others accused him of bringing coronavirus to Zimbabwe, New Zimbabwe reports.
The VP had attended parliament for a question and answer session when he became the subject of ridicule. According to the publication:

Parly Drama: MDC MPs Mock "Senior Bachelor" Chiwenga

Vice President Constantino <a href="https://news.pindula.co.zw/2020/01/24/full-text-vp-chiwenga-appeals-against-high-court-judgment/">Chiwenga has appealed at the Supreme Court</a> against a High Court judgment which ordered him, among other things to allow his estranged wife, Mary Mubaiwa-Chiwenga access to the couple&#8217;s Borrodale home and custody of children.
The appeal means that the <a href="https://news.pindula.co.zw/2020/01/24/breaking-high-court-verdict-on-vp-chiwenga-marrys-wrangle-over-custody-of-children-and-access-to-borrowdale-home/">High Court judgment giving victory to the former model</a> is now suspended until appeal.
The wrangle for the custody of children, access to properties will therefore continue and the VP will continue to lock Marry outside of their Borrowdale home until the court has given a verdict.

The Meaning Of VP Chiwenga's Appeal Against High Court Ruling

Acting President Chiwenga is reportedly in a fix after his estranged wife rejected an out of court settlement in favour of letting the court settle the issues between them, Zim Morning Post reports.
According to a source close to <a href="https://www.pindula.co.zw/Marry_Chiwenga">Marry Chiwenga</a>&#8216;s defence council:
<blockquote>Marry is in a no nonsense mood and would want the matter to be settled in court.
The applicant is the one who brought the issue to the courts so there is no need for it to be settled out of courts

Marry Chiwenga Remanded Till 14 January

The estranged husband of Vice President <a href="https://www.pindula.co.zw/Constantino_Chiwenga" rel="noopener noreferrer" target="_blank">Constantino Chiwenga</a>, <a href="https://www.pindula.co.zw/Marry_Chiwenga" rel="noopener noreferrer" target="_blank">Marry Chiwenga</a> (nee Mubaiwa) faces a lengthy period in jail if convicted on charges of breaching Exchange Control regulations, fraud and money laundering, and murder allegations she is facing.
In opposing bail for Marry, prosecutor Albert Masamha told the court that the offence of fraud attracts up to 35 years, while Money Laundering provides for imprisonment for up to 25 years. He said:
<blockquote>Releasing the applicant on bail is, therefore, likely to jeopardise and erode public confidence in the justice system.
… it is the respondent’s submission that the sentence for attempted murder is also severe in the event the applicant is convicted.
The offence of fraud provides for imprisonment not exceeding 35 years, whilst Section 8 (8) of the Money Laundering and Proceeds of Crime Act, Chapter 9:24 provides for imprisonment not exceeding 25 years.</blockquote>
Marry has been in remand prison ever since she first appeared in court nearly two weeks ago.
On Friday, the <a href="https://www.pindula.co.zw/High_Court_of_Zimbabwe" rel="noopener noreferrer" target="_blank">High Court</a> postponed her bail application and appeal hearings to Tuesday next week.
She is being represented by Mtetwa &amp; Nyambirai Legal Practitioners.

Marry's Bail Hearing To Be Heard On Friday

<a href="https://www.pindula.co.zw/Shingi_Kaondera" target="_blank" rel="noopener noreferrer">Shingi Kaondera</a>, <a href="https://www.pindula.co.zw/Marry_Chiwenga" target="_blank" rel="noopener noreferrer">Marry Mubaiwa Chiwenga</a>&#8216;s former husband, said she changed the surname of their daughter Destiny without his consent or knowledge.
Speaking to Zim Morning Post reporter Nigel Pfunde on Friday, Kaondera claimed that he last saw his daughter, now 10, when she was only two years old. He said:
<blockquote>Wangu (my brother), my daughter I last saw him her when she was two years old and Marry went on to amend my daughter’s birth certificate, she liaised with Registrar General Office and my daughter ’s last name was changed from Kawondera to Mubaiwa, her maiden surname and that is not fair, but well Mwari ndewemuhu wese haamwire kuDreams, I wish her well though.</blockquote>
Shingi and Marry divorced a decade ago before she went on to marry the former Commander Zimbabwe Defence Forces, <a href="https://www.pindula.co.zw/Constantino_Chiwenga" target="_blank" rel="noopener noreferrer">Constantino Chiwenga</a> who is now one of the country&#8217;s Vice Presidents.

Kaondera told Zim Morning Post on Friday that he invested money into their business while he was in Cyprus where he played professional football. Said the former Warriors striker:
<blockquote>Wangu, when I met her (Marry) she was a struggling model.
Of course, she came from a well up family but I was on fire, ndaipisa wangu and I invested in a business that I thought was ours.
I poured in money for her to start a business, we had a vision of Lachelle Company where we wanted to do boutiques and travel services and she took over because I was in Cyprus.
She is a good woman but her rich background pushes her to maintain her status and she can do anything.</blockquote>
Kaondera has sued Marry for US$700 000 accusing her of forging his signature and deceiving a court to grant her a divorce while he was in Cyprus.
He said Marry fraudulently obtained the divorce as he was never served with a divorce summons.

Kaondera: Marry Chiwenga Was A Struggling Model When We Met

Chairman of <a href="https://www.pindula.co.zw/Alpha_Media_Holdings" target="_blank" rel="noopener noreferrer">Alpha Media Holdings (AMH)</a> and a member of the <a href="https://www.pindula.co.zw/Presidential_Advisory_Council_2019" target="_blank" rel="noopener noreferrer">Presidential Advisory Council (PAC)</a>, Trevor Ncube, said Marry Mubaiwa Chiwenga, the estranged wife of Vice President <a href="https://www.pindula.co.zw/Constantino_Chiwenga" target="_blank" rel="noopener noreferrer">Constantino Chiwenga</a> is a victim of selective application of the law.
Ncube warned that what Marry is going through can happen to any Zimbabwean citizen. Writing on microblogging site Twitter, Ncube said:
<blockquote>I have never met Marry Mubaiwa Chiwenga. I don’t know her from a bar of blue soap. She has become the latest victim of selective application of the law and weak compromised/national institutions. What she is going through can happen to any of us.</blockquote>
Marry appeared at the Harare regional court on Monday morning where she was formally placed on remand on the charge of attempting to kill her husband.
The former model was initially charged with the externalization of US$1 million, fraudulently seeking to solemnise her marriage with neither Chiwenga’s knowledge nor consent and money laundering.

ED's Advisor Bemoans Marry Chiwenga's Victimisation By ZACC, Courts

<blockquote>5 Territoriality of crimes
(1) A person may be tried, convicted and punished for a crime, whether in terms of this Code or any other enactment, where the crime or an essential element of the crime was 
(a) committed wholly inside Zimbabwe; or 
(b) committed partly outside Zimbabwe, if the conduct that completed the crime took place 
inside Zimbabwe; or 
(c) committed wholly or partly outside Zimbabwe, if the crime 
(i) is a crime against public security in Zimbabwe or against the safety of the State of 
Zimbabwe or (ii) is a crime which; 
A. has produced a harmful effect in Zimbabwe, or B. was intended to produce a harmful effect in Zimbabwe, or C. was committed with the realisation that there was a real risk or possibility that it might produce a harmful effect in Zimbabwe.
(2) This section does not limit the effect of any enactment which 
(a) regulates the territorial jurisdiction of any court; or

The <a href="https://www.pindula.co.zw/Zimbabwe_Anti-Corruption_Commission">Zimbabwe Anti-Corruption Commission</a> is planning to recruit 25 people for the Bulawayo office, the Chronicle reports.
This was revealed by ZACC Commissioner Thandiwe Mlobane during the World Anti Corruption Day Commemorations which were held at Sekusile Shopping Centre in Bulawayo. Mlobane said:
<blockquote>We want to change our operations in 2020 hence the decision to beef up the local office. We are looking at engaging at least 25 officers to boost the office’s capacity to service this region. Those to be recruited include officers to handle administration, public relations, education and investigations.</blockquote>

ZACC To Recruit 25 Employees For Its Bulawayo Office

Details on how the second lady allegedly externalised funds and fraudulently obtained a marriage license without the VP&#8217;s consent have spilt into the public domain as reported by the Chronicle. Marry allegedly faked proforma invoices for the purchases of either event tents and chairs or prepaid household electrical meters according to the publication.
Sources that spoke to the publication said;
<blockquote>She would get forex from CBZ Bank and divert it to her personal use.On October 2018, Mubaiwa sent her driver Carrington Kazingizi and a Terrence Mutandwa to China with US$114 000 through Robert Mugabe International Airport without any declaration being made to the authorities which is in contravention of the Exchange Control Act, Chapter 22:05
Sometime in November 2018, she instructed Ms Memory Chakuinga- who is the Managing Director of two South African based companies namely Falcon Projects Pvt Ltd and Bonnette Electrical Pvt Ltd which are based in Pretoria- to come up with a proforma invoice for the supply of event tents and chairs which were then sent to CBZ Bank and also to the accused. On 17 December 2018, the accused on the strength of the proforma invoice, caused CBZ Bank to transfer US$201 846-81 through Outgoing Telegraphic Transfer into Falcon Projects Suppliers Private Limited South African FNB Bank account number 62576755105
On 4 February 2019, the invoice was sent to CBZ Bank and to the accused. On 13 February 2019 the accused caused CBZ Bank to transfer US$307 545 through Outgoing Telegraphic Transfer into Falcon Projects Suppliers Private Limited South African FNB Bank account number 62576755105
Sometime in February and March this year, Ms Mubaiwa allegedly externalised US$36 923,08 which she used to buy furniture for the Pretoria home
Sometime between February and March 2019, Ms Mubaiwa gave a Ms Judith Gamuchirai Goredema US$230 769,23 for the purchase of a second Range Rover registration number HX61PSGP that she registered in South Africa under her name.
In May 2019, she allegedly instructed Ms Chakuinga to raise another proforma invoice for the supply of prepaid meters and got US$142 858,93 from CBZ Bank which she allegedly diverted into Martin Portgietter Attorney Trust Account number 081327021 domiciled at Standard Bank South Africa towards payment for the house in Pretoria.
In the fraud case, Ms Mubaiwa allegedly misrepresented to Judge President George Mutandwa Chiweshe that VP Chiwenga had consented to a marriage under the Marriage Act, Chapter 5:11. The Acting Chief Magistrate however noticed that the passport size photos and address of the parties were not included. The items were later forwarded to him and acting on the misrepresentation, the marriage officer caused the completion of registration forms and the marriage certificates in preparation for the ceremony. When the accused was doing all this, complainant was bed ridden and not in a condition to consent to the marriage</blockquote>

The wife of the Vice President was noticeably absent from him homecoming mass that was held in Wedza yesterday, The Standard reports. VP Chiwenga's Wife Reportedly Absent At Chiwenga's Homecoming Mass

In an interview with the Daily News, Vice President Constantino Chiwenga&#8217;s wife Marry said she is still putting on bandages on her hands to prevent the wounds from infection.
She said she is recovering well and has been able to go to work. Marry denied reports that Deputy Health Minister John Mangwiro is taking care of the Chiwengas saying they are capable of taking care of each other. Said Marry:
<blockquote>I have these bandages on but my hands are no longer swollen, the bandages are to cover the wounds from infection. Yes, my hands and legs were affected during that bomb blast, but I am recovering well. I feel fine. I even go to work and I even drive, I have carried on living as I used to. Marry Chiwenga Gives Update On Her Health

Speaking to the Daily News on Sunday Marry Chiwenga  said she does not know the woman who claimed to be her husband Vice President Constantino Chiwenga’s niece who got a prophecy from South Africa-based prophet Alph Lukau, claiming that the former General was a victim of witchcraft.
Marry said they did not even know the woman and that they did not have relatives in South Africa. She said she did not recognise it as a prophecy since the woman had said the name Chiwenga already. Said Marry:
<blockquote>No, she’s not a relative, I do not know her and the VP does not know her, and to be honest I didn’t see any prophecy there because the woman had said the name. Whatever he said about witchcraft I don’t know, I know what the doctors told us.</blockquote>

Marry Chiwenga Speaks On Prophecy Claiming Husband VP Chiwenga Was Bewitched

Speaking to The Herald, Deputy Chief Secretary to the President and Cabinet (Presidential Communications) who is also the Presidential spokesperson, George Charamba explained Vice President Chiwenga’s wife Marry’s health condition.
He said Marry Chiwenga’s hands were swelling because of pus that was gathering in wounds she sustained during the Zanu-PF rally bombing in July this year. Said Charamba:

After the Bulawayo bombing incident, apparently she had some deep lesions right to the bone and they were beginning to gather pus leading to swelling of hands.
