<p>The Crisis in Zimbabwe Coalition (CiZC) has demanded the implementation of the recommendations made by the Motlanthe Commission which was established to investigate the 1 August 2018 killings.</p>
<p>Six civilians were shot dead by soldiers in central Harare during protests over delays in announcing presidential election results.</p>
<p>Thirty-five others were wounded in the shootings, forcing President Emmerson Mnangagwa to appoint a commission headed by former South African President Kgalema Motlanthe, to probe the killings.</p>
<p>The Motlanthe Commission, recommended, among other things, compensation to families of the deceased as well as prosecution of the killers.</p>
<p>In a letter dated October 18, 2022, addressed to the Minister of Justice, Legal and Parliamentary Affairs Ziyambi Ziyambi, CiZC chairperson Peter Mutasa said:</p>
<blockquote>
<p>We address you in your capacity as the chairperson of the Inter-Ministerial Taskforce which was tasked with addressing issues arising from the findings of the Motlanthe Commission of Inquiry report.</p>
<p>We write to your esteemed office expressing our reservations over the failure of the Government of Zimbabwe to implement recommendations of the seven-member Motlanthe Commission of Inquiry following the events of August 1, 2018, that resulted in the death of six civilians at the hands of the army following protests over the late announcement of Presidential election results in Harare.</p>
</blockquote>
<p>Mutasa raised the issue of security sector reforms which he said should be addressed. He said:</p>
<blockquote>
<p>So far, the Government of Zimbabwe has not instituted security sector reforms to ensure that the military acts within the provisions of the Constitution of Zimbabwe and in conformity with human rights norms and standards.</p>
<p>The State is still to implement Section 210 of the Constitution of Zimbabwe that provides for an Independent Complaints Mechanism for receiving and investigating complaints from the members of the public about misconduct on the part of members of the security services, and for remedying any harm caused by such misconduct.</p>
<p>The Independent Complaints Mechanism is a crucial body in light of the increasing cases of human rights abuses linked to security.</p>

CiZC Demands Implementation Of Motlanthe Commission Recommendations

<p>Justice minister Ziyambi Ziyambi has claimed that president Emmerson Mnangagwa has pledged to fully implement all recommendations and reforms proposed in the Kgalema Motlanthe inquiry report. The inquiry was initiated by president Mnangagwa following the August 1, 2018 shootings which resulted in about 6 deaths. <span id="more-3096224744021747"></span></p>

<p>Ziyambi, who chairs the inter-ministerial taskforce tasked to ensure implementation of the Kgalema Motlanthe inquiry report said:</p>
<blockquote><p>We have done all the work in terms of looking at how to implement the recommendations and these will be made public once we present them to Cabinet. What I can tell you (for) now is President Mnangagwa is committed to implement that report in full. It has not been discarded, it’s being taken seriously.</p></blockquote>
<p>He further said that the report recommended some law reforms including electoral laws and compensation of victims.</p>
<p>There are doubts in some circles on whether arrests will be effected on security personnel who were implicated in the shootings. It is also not clear whether there shall be security sector reforms or not.</p>
<p>A NewsDay source revealed that among other recommendations, the report advocated the commencement of a political dialogue to diffuse years of political violence. The source also indicated that bringing to book military officers accused of shooting and killing people on the streets of Harare was the major impediment to the implementation of the report in full.</p>

ED Pledges To Fully Implement The Motlanthe Recommendations

<p>The government has denied claims that it has ignored the recommendations made by the Motlanthe Commission of Inquiry.</p>
<p>The Commission recommended among other things, that the government identifies and punishes the soldiers who killed civilians in cold blood as well as compensating the victims of the shootings.</p>
<p>Permanent secretary in the Ministry of Justice Virginia Mabiza had this to say:</p>
<blockquote><p>Remember, the President set a special task force of ministers to deal with these issues and we are already at an advanced level of dealing with these matters, including compensation of victims, security sector reforms and multi-party dialogue, which is already being implemented.</p>
<p>We have already started with the realignment of laws, and other issues have been discussed at the task force. You should know that things like compensation involve mobilising resources and this is why we have roped in the Ministry of Finance to assist us, but work is being done and the report has not been dumped.</p></blockquote>

Govt Denies Claims That It Ignored Motlanthe Commission Report

<p>President Emmerson Mnangagwa faces a Herculean task in implementing the Motlanthe Commission recommendations.</p>
<p>The recently-held ZANU PF Annual National People’s Conference recommended that the party should not enter into a government of national unity with the opposition MDC. ZANU PF has reportedly refused to even talk to the MDC. Part of the Motlanthe recommendations read:</p>
<blockquote><p>The commission recommends the establishment of a multi-party reconciliation initiative, including youth representatives, with national and international mediation to address the root causes of the post-election violence and to identify and implement strategies for reducing tensions, promoting common understandings of political campaigning, combating criminality, and uplifting communities.</p></blockquote>
<p>ZANU PF secretary for legal affairs, Munyaradzi Paul Mangwana said the MDC has to approach ZANU PF. He said</p>
<blockquote><p>The big brother will not go to the younger brother. It’s the other way round. We have always been open. We will talk to Zimbabweans who think they have something to offer. We are open, but we will not accost them to talk.</p></blockquote>
<p>Some of the recommendations which the Motlanthe report made, and which Mnangagwa may find hard to implement read as follows:</p>
<blockquote><p>Those particular members of the military and the police found to have been in breach of their professional duties and discipline on August 1, 2018 should be identified as soon as possible for internal investigations and appropriate sanction, which should include a hearing from the victims and their families for impact assessment and to provide the necessary compensation.</p></blockquote>

Mnangagwa In Catch-22 Over Implementing Motlanthe Commission Recommendations

<p>A political commentator, Lennon Manyengawana said that the Motlanthe Commission report revealed that the deployment of soldiers on August 1 was chaotic. He said that it fails to identify who really gave the order for the soldiers to shoot at unarmed civilians and this means that the Zimbabwe army can be commanded by just about anyone.</p>
<p>In an interview with the Mail and Telegraph, Manyengawana said</p>
<blockquote><p>The real issue that people want to hear at the moment is what is going to be done to the people who shot these people and it is being said in a bracket whether it is just saying the responsibility of the of the deaths lays on the soldiers and the police but you are not specifying it, this soldier and this soldier shot people on this day because the blame is now being put on the command structure whether you are saying the command structure was not clear and there were issues so we do not know who commands who.</p>
<p>In an army where you are the commander in chief and you say you do not know who issued the command, it is a very bleakly statement that you could say as the commander in chief because every commander has to come through you. If there is another person who is commanding besides you, that person needs to be brought to book because it simply means our army can be commanded by every jack and Jill, they can call the army to go and shoot people in town and you as the president, you do not know.</p>
<p>The solder’s mandate is to protect the people of Zimbabwe against external threats or maybe terrorism but not to go and quench demonstrations so the commission of inquiry was a bluff, it was a waste of money because at the end of the day it did not answer the fundamental questions.</p></blockquote>

Motlanthe Commission Report Shows The Army Can Be Commanded By Every Jack And Jill - Political Commentator

<p>Calls have been made for President Emmerson Mnangagwa to apologise to the families of the victims of the August 1 shootings. The Motlanthe Commission implicated the army in the shootings, and Mnangagwa by virtue of being the Commander in Chief of the Zimbabwe Defence Forces is morally obliged to apologise.</p>
<p>Human rights lawyer and constitutional law expert Fadzai Mhere said  wrote on Twitter today</p>
<blockquote><p>Respectfully, Mr President, Because the army was implicated in the killings and you are the Commander in Chief, surely it behoves you to take responsibility and at least apologize for the moment of madness? Why did you promote the commander involved if you regret this episode?</p></blockquote>
<p>Respected lawyer and former Minister for Education, Sport and Culture David Coltart had this to say</p>
<blockquote><p>In my mind, the most appalling aspect of this tragic episode is that the army commander who brazenly lied to Motlanthe Commission (that troops fired at 45 degrees and didn’t kill civilians) has now been promoted and rewarded by Mnangagwa. He should have been court-martialed.</p>
<p>In addition, Mnangagwa has officially been found to have deployed the troops which then, using excessive force, killed civilians in cold blood. Despite this there still hasn’t been a whiff of an apology, never mind accountability.</p></blockquote>
<p>A veteran journalist Brezhnev Malaba queried Mnangagwa’s decision to promote the Commander of an army unit responsible for killing unarmed civilians. Wrote Malaba</p>
<blockquote><p>The Motlanthe Inquiry has concluded: The military and police killed unarmed civilians. Victims and families must be compensated. Prosecution of culprits. BUT how can the soldiers be held responsible when Mnangagwa promoted their commander a day before revealing the findings?</p></blockquote>
