<p>The Zimbabwe Human Rights NGO Forum has condemned the arrest of Zimbabwe Election Support Network (ZESN) and the Elections Resource Centre (ERC) staff members by the Police last week.</p>
<p>In a statement released on 28 August, the Forum said the arrest of 39 ZESN and ERC staff members and volunteers who were arrested while conducting lawful, non-partisan election observation work was “disheartening”.</p>
<p>Read the full statement below:</p>
<blockquote>
<p>The Zimbabwe Human Rights NGO Forum (the Forum) stands in solidarity with its fellow civic society organizations — the Zimbabwe Election Support Network (ZESN) and the Elections Resource Centre (ERC) following the arbitrary arrests of 39 ZESN and ERC staff members and volunteers who were arrested while conducting lawful, non-partisan election observation work.</p>
<p>The Forum, in addition to being a consortium of 21 civic-based organizations, also coordinates a total of 21 heads of civic society organizations and networks in the fight to defend and protect civic space in Zimbabwe to which ZESN forms an essential constituent.</p>
<p>The Forum has also collaborated closely with the ERC in ensuring support of institutional election processes that are devoid of instances of organized violence and torture (OVT).</p>
<p>The Forum therefore expresses deep concern over the needless raids of ZESN and ERC workspaces that ultimately resulted in the arbitrary arrest of the 39.</p>
<p>The arrest culminated in the seizure of a range of communication gadgets which included cellphones, laptops and modems on the basis that the group was congregating to collect and collate Zimbabwe’s 23 August 2023 Harmonised Elections poll results in preparation for the unlawful announcement of the election outcome.</p>
<p>Resultantly, the 39 were charged with contravening section 66(A)(1)(a) of the Electoral Act [Chapter 2:13] which speaks to the offence of “purported publication of results prior to the official announcement”.</p>
<p>They were then held incommunicado from 2100hrs on 23 August until around midday on 24 August. During that time, in contravention of the constitution, they were unable to communicate with their spouses, relatives, legal practitioners, doctors or anyone else.</p>
<p>The Forum considers the arrest as an attempt to suppress transparency and accountability around the 2023 Harmonised Elections.</p>
<p>The Forum remains perplexed by the drive behind the dragnet arrests when the Zimbabwe Electoral Commission (ZEC) encouraged parallel voter tabulation by independent bodies ahead of the by-elections last year.</p>
<p>ZEC at the time averred that parallel voter tabulation would help counter claims of vote rigging by the elections management body.</p>
<p>The Forum notes with relief that the 39 were granted bail when they appeared before Deputy Chief Magistrate Ngoni Nduna on 25 August 2023.</p>
<p>We however remain disheartened by the disturbing details that emerged from submissions made by their legal counsel pertaining to the nature in which their arrests were effected including how the group was made to lie down for three consecutive hours by AK assault rifle-wielding police officers.</p>
<p>The terror they must have endured throughout this ordeal, with the youngest of them being just 19 years of age, is unimaginable.</p>
<p>The Forum therefore hopes that their incarceration will not deter our peer organizations from continuing with their good work and efforts towards supporting democratic electoral processes and contributing to transparency around critical phases of the election through independent verification of election results, a practice that is observed globally.</p>
<p>Linked with electoral processes, the Forum and some of its member organisations have received distress calls from presiding officers, polling agents and some observers who are being targeted for the work that they did in the just-ended harmonized elections.</p>
<p>While we note that ZEC has issued a statement refuting allegations of recalling polling officers and observers or victimising them due to their work, we note that if the allegations are true, then whoever is recalling these presiding officers, polling agents and some observers can only be someone with a sinister motive.</p>
<p>The Forum, in reiterating its unwavering solidarity with ZESN and ERC accordingly calls upon the Government of Zimbabwe, at this critical time in the country’s political landscape to:</p>
<ul>
<li>Immediately act to reaffirm its commitment to upholding and defending fundamental human rights and freedoms by abiding by the Revised SADC Principles and Guidelines for Democratic Elections which mandate member states to exercise political tolerance, ensure full participation of the citizens in the political process as well as respect, protect and fulfil the right to freedom of peaceful assembly and association of civic society organizations and citizens collectively;</li>
<li>Openly condemn the conduct of the Zimbabwe Republic Police (ZRP) in its disproportionate use of force when conducting the raids and arrests and calling upon the ZRP to at all times be professional and non-partisan in character as mandated by section 219 of the 2013 Constitution of Zimbabwe and ultimately to</li>
<li>End the unwarranted persecution of ZESN and ERC staff and volunteers by facilitating the full and unconditional dropping of charges against the arrested 39 individuals and the return of the equipment seized.</li>
<li>Ensure that polling agents and observers are protected and are not victimized because of the work they carded out during the elections.</li>

Zimbabwe Human Rights NGO Forum Condemns Arrest Of ZESN, ERC Election Observers

<p>The Zimbabwe Human Rights NGO Forum has condemned the assassination of Eswatini pro-democracy activist and human rights lawyer Thulani Maseko. A statement issued by the Forum on Sunday, 22 January, reads:</p>
<blockquote>
<h2>CONDOLENCE MESSAGE ON THE PASSING OF ESWATINI HUMAN RIGHTS STALWART, THULANI MASEKO</h2>
<p>The Zimbabwe Human Rights NGO Forum (the Forum) has learnt, with a deep sense of loss, of the assassination of Eswatini pro-democracy activist and human rights lawyer Thulani Maseko. Maseko was shot in the head in his lounge on the evening of 21 January 2023.</p>
<p>We join the entire human rights community in mourning the loss of one of our generation’s most fierce defenders of human rights and steadfast champions of the voiceless.</p>
<p>Maseko was a friend of the Forum, sharing with the Forum a strong belief in social responsibility and consciousness in defending the rights, dignity, and equality of all.</p>
<p>He supported the Forum in advancing the human rights discourse in Africa in several civic space engagements and initiatives.</p>
<p>He fought tirelessly to promote respect for fundamental human rights on the continent as recently seen by his participation at the Southern Africa Human Rights Defenders Summit convened in Lusaka, Zambia from 28-29 November 2022.</p>
<p>Maseko was persecuted repeatedly for his unwavering defence of human rights. He was arrested on 17 March 2014 and charged with contempt of court for writing articles denouncing the lack of judicial independence in Africa’s last absolute monarchy, the then Swaziland.</p>
<p>His arrest, charges and pretrial detention were set aside by the Swaziland Supreme Court which ordered his release on 6 April 2014 just for him to be rearrested again two days later on 8 April 2014.</p>
<p>He was subsequently convicted of “contempt of court” on 17 July 2014 by the Swaziland High Court which sentenced him to two years in prison.</p>
<p>He endured solitary confinement during this period, criminalized for daring to speak out against an oppressive royalist regime.</p>
<p>Despite the persecution, he remained at the forefront of defending the rights of others following his release on 30 June 2015.</p>
<p>His deep-rooted conviction in assisting his fellow man was one for which he paid the ultimate price – that of his life.</p>
<p>It is in this spirit that the Forum mourns the devastating loss of an unwavering champion of democracy and human rights.</p>
<p>The Forum strongly condemns this callous and cold-blooded killing that has robbed the region of a selfless human rights stalwart. We demand justice and accountability for Thulani.</p>
<p>Thulani leaves behind a void that will be extremely difficult to fill. In his honour, we commit to continue to boldly defend the ongoing struggle for the realisation of all human rights for all persons.</p>
<p>The Forum extends heartfelt condolences to the Maseko family, his close friends, co-workers in the legal fraternity and the entire human rights community who interacted with and shared his commitment to the struggle for human rights.</p>
<p>The struggle for the rights and dignity of all continues, and Thulani’s assassination strengthens our resolve.</p>

Zimbabwe Human Rights NGO Forum Condemns "Callous" Killing Of Eswatini Lawyer

<h2>Full statement by the Zimbabwe Human Rights NGO Forum marking World Day Against the Death Penalty.</h2>
<blockquote>
<p>10 October 2022</p>
<p>World Day Against the Death Penalty was first organised by the World Coalition Against Death Penalty in 2003.</p>
<p>It is now observed annually on October 10. Commemoration of such a day mobilises civil society, political actors and leaders, lawyers, opinion leaders and more towards supporting the clarion call for the universal abolition of capital punishment. The Zimbabwe Human Rights NGO Forum (the Forum), a coalition of 22 human rights organisations joins the rest of the world in observing this day to complement the existing global movement against the death penalty.</p>
<p>A myriad of organisations and world leaders hold that the death penalty breaches specific human rights, particularly, the right to life and the right to live free from torture or cruel, inhuman or degrading treatment or punishment.</p>
<p>Both imperatives are protected under the Universal Declaration of Human Rights (UDHR) which was adopted by the United Nations in 1948.</p>
<p>As the world stands up against the death penalty, it is sad to note that it remains a key element of Zimbabwe’s Penal Statute, namely, the Criminal Law (Codification and Reform) Act (Chapter 9:23]; the Criminal Procedure and Evidence Act (Chapter 9:07) as well as the Defence Act [Chapter 11:02).</p>
<p>The supreme law of Zimbabwe (2013 Constitution of Zimbabwe) still imposes the death penalty.</p>
<p>Apart from the constitution still embodying such an archaic clause, the provision itself is manifestly discriminatory on the ground of age and gender as it excludes persons below 21 and above 70 years of age and women.</p>
<p>The Forum is particularly concerned with the correlation between the use of the death penalty and torture or other cruel, inhuman, and degrading treatment or punishment.</p>
<p>In the case of Zimbabwe psychological torture from the mental anguish of anticipating execution resulting from the lack of a hangman and other delays remains a cause for concern.</p>
<p>This practice extends to secondary victims such as families or those with close relationships with the sentenced person.</p>
<p>Capital punishment consequently encroaches upon a spectrum of constitutional rights and freedoms that include the right to human dignity, the right to personal security which incorporates the right to bodily and psychological integrity, the right to not be subjected to cruel, inhuman or degrading treatment or punishment as well as the right to life.</p>
<p>The Forum notes that no known execution has occurred in Zimbabwe since 22 July 2005. The Forum commends the significant inroads made towards abolishing the death penalty made by the incumbent President of the Republic of Zimbabwe, President Emerson Mnangagwa.</p>
<p>Through Clemency Order No. 1 of 2018, President Mnangagwa reduced to sentences of prisoners on death row for more than 10 years to life imprisonment.</p>
<p>This meant that any death row inmate sentenced before 10 March 2008 no longer faced execution. Some Zimbabwe death row inmates have also benefited from a 2019 Presidential Amnesty aimed at decongesting prisons in the wake of the COVID-19 pandemic resulting in 6 death row inmates being set free out of a total of over 4000 prisoners amnesty beneficiaries.</p>
<p>The Forum, however, notes with great concern that despite efforts on the part of the Government to move away from the imposition of the death penalty through the clemency order and presidential amnesty, more than 80 prisoners currently remain on death row.</p>
<p>The Forum further notes that whilst there have been no known executions in Zimbabwe since 22 July 2005, courts have continued to sentence prisoners to death row.</p>
<p>It is against this background that the Forum urges the Government of Zimbabwe to:</p>
<ol>
<li>Abolish the death penalty as it undermines human dignity and clearly violates the state’s human rights obligations.</li>
<li>fulfil its obligations arising from the Constitution, and regional and international treaties to that espouse the respect, protection, promotion and fulfilment of all human rights and fundamental freedoms and</li>
<li>adhere to international human rights best practices, standards and principles relating to the rights of persons deprived of their liberty and demonstrate such willingness and commitment by: </li>
</ol>
</blockquote>
<ul>
<li>
<blockquote><p>immediately refraining from fast-tracking enactment of repressive legislation aimed at constricting what is left of the civic and political space in Zimbabwe and instead, take proactive steps aimed at officially striking off the death penalty from statute books.</p></blockquote>

<blockquote><p>ratifying the United Nations Convention Against Torture and Other Cruel, Inhuman and Degrading Treatment or Punishment (UNCAT) and its Optional Protocol.</p></blockquote>

Forum Statement To Mark World Day Against The Death Penalty | Full Text

<p>High Court judge Justice David Mangota has given the Justice Minister and the Attorney-General 45 days to develop a Code of Conduct for Vice-Presidents and Ministers.</p>
<p>A Case Alert issued by the Zimbabwe Human Rights Forum this Wednesday reads:</p>

<p>High Court gives Minister 45 days to develop Code of Conduct for Vice-Presidents and Ministers Harare High Court Judge Justice David Mangota has ordered Justice Legal and Parliamentary Affairs Ziyambi Ziyambi and Attorney-General Prince Machaya to craft a law that will stipulate the Code of Conduct for Vice President, Ministers and Deputy Ministers.</p>
<p>Justice Mangota made the ruling in an application which was brought by a former ZEGU Law Student Nyasha Chiramba who approached the High Court seeking to compel the Minister and AG to initiate the drafting of the Bill envisaged under section 106 (3) of the Constitution.</p>
<p>Chiramba argued that the Vice-Presidents, Ministers and Deputy Ministers have been involved in different types of misconduct including sexual misconduct and abuse of state resources yet there is no compliance with this piece of legislation.</p>
<p>Former Vice-President Kembo Mohadi was forced to resign after the audios of his sexual escapades went viral on social media.</p>
<p>Only last week, the President fired a deputy minister for conduct said to be inappropriate for the office.</p>
<p>The deputy minister, Douglas Karoro, was recently arrested for criminal abuse of office.</p>
<p>In a judgement which was delivered Wednesday 8 June, Justice Mangota ruled that that law is overdue since the Constitution was promulgated 9 years ago.</p>
<p>He ordered the Minister of Justice and the Attorney General to draft the Bill and submit it to the Cabinet within 45 days.</p>

Code Of Conduct For Vice-Presidents, Ministers

<p>Full statement by the Zimbabwe Human Rights NGO Forum (the Forum) marking the 42nd Independence Day anniversary.</p>
<blockquote>
<h2>Zimbabwe commemorates its independence from white colonial rule on 18 April yearly.</h2>
<p>The ushering in of independence marked the start of a nation grounded on respect for human rights and values of mutual respect and dignity.</p>
<p>Today, the Zimbabwe Human Rights NGO Forum (the Forum) joins the rest of the country in saluting heroes, living and departed, of the liberation struggle whilst lamenting the deplorable oppression, and abuse of human rights that is now the order of the day.</p>
<p>Section 3 (1) (c) (g) and (i) of the Constitution states that Zimbabwe is founded on, among others, the respect of fundamental human rights and freedoms, gender equality and recognition and respect for the liberation struggle.</p>
<p>This dovetails with the theme of this year’s independence celebrations, “Zim@42- Leaving no one and no place behind.”</p>
<p>However, the current socio-economic situation does not auger with the theme and indeed the Constitution.</p>
<p>For the past 42 years, the gap between the rich and the poor has been growing, to the extent of diminishing this year’s theme without reasonable doubt.</p>
<p>The gap between the rich and the poor is widening. Corruption at the highest level of society has allegedly been rampant.</p>
<p>Manipulation of currencies and inconsistencies in economic policies by the Reserve Bank of Zimbabwe has widened inequalities among citizens.</p>
<p>The collapsing economy, caused by currency distortions, has seen the prices of basic commodities going beyond the reach of many, mostly poorly paid, citizens, government workers included.</p>
<p>Many are struggling to access essential staple food, clean water, electricity, and health services.</p>
<p>Selective application of the law especially favouring the ruling elite and cartels connected to them has indeed left behind many citizens.</p>
<p>Grand corruption involving national resources has been left unchecked while ruling party functionaries have been left to violate the law with impunity.</p>
<p>The independence celebrations also come when disturbing developments are taking place in the country.</p>
<p>These include the closure of civic space and continuous abuse of human rights, particularly the opposition supporters and human rights defenders.</p>
<p>It is worrying that the government has taken a preoccupation with crafting laws to close civic space, taking the country decades back.</p>
<p>The Private Voluntary Organisations (PVO) Amendment Bill, the proposed Patriotic Bill, and the Cyber Security Act, among others, are not laws fit for an independent country that has seen the worst form of repression from the colonial government using similar laws.</p>
<p>The Forum acknowledges that true independence is when all the people of Zimbabwe are truly free, and their rights and freedoms are respected and protected.</p>
<p>It is regrettable that the true meaning of independence has lost value to many Zimbabweans because of the worsening economic situation in the country and the ever-rising political tensions in betrayal of the fundamental rights and freedoms which are guaranteed by Chapter 4 of our Constitution.</p>
<p>The Forum, therefore, urges the government of Zimbabwe to;</p>
<p>(i) address the economic challenges faced by Zimbabweans;</p>
<p>(ii) respect the values that the brave sons and daughters who took up arms fought for;</p>
<p>(iii) commit to uniting citizens and fulfilling their desire for freedom, justice, and equality;</p>
<p>(iv) commit to the values of democracy, good, transparent, and accountable governance.</p>
<p>(v) allow for an enabling environment and open civic space.</p>

Human Rights NGO Forum Statement On The 42nd Independence Anniversary | Full Text

<p>The Government of Zimbabwe has adopted only 127 out of 264 recommendations made during the third cycle of the Universal Periodic Review (UPR) process on 26 January.</p>
<p>Zimbabwe reportedly ignored recommendations on torture and other human rights abuses and only adopted recommendations on social-economic justice.</p>
<p>Speaking during a UPR review meeting hosted by the Zimbabwe Human Rights NGO Forum on Thursday, Women’s Coalition of Zimbabwe programmes manager Mercy Jaravani said:</p>
<blockquote>
<p>The top 11 deferred recommendations by the government include the adoption of necessary measures to guarantee the protection of journalists and human rights defenders.</p>
<p>The government also deferred amending laws that guarantee the protection of civic space.</p>
<p>The government also deferred the UN Convention Against Torture, Protection of all Persons Against Forced Disappearance, providing redress to victims of torture as well as the full implementation of the recommendations of the Motlanthe Commission of Inquiry.</p>
</blockquote>
<p>The Government, however, made a commitment to support 48% of the 264 recommendations. Said Jaravani:</p>
<blockquote>
<p>Government made a commitment to address increasing measures to mitigate change and over-relying on climate-sensitive sectors as key to reducing the country’s vulnerability, to provide citizens with birth certificates and national identity cards in order to ensure access to education, government services, voter roll and many more.</p>
</blockquote>
<p>The Government is expected to announce its position on the Third UPR process between June and July this year before the sitting of the Human Rights Council.</p>

'Govt Has Ignored Calls To Stop Torture, Forced Disappearances'

<p>Civil Society organisations have criticised Midlands Provincial Affairs minister Larry Mavima for saying non-governmental organisations (NGOs) operating in the country should go and render their services in Ukraine.</p>
<p>Ukraine is a country in Eastern Europe that has been under constant shelling and heavy bombardment from nuclear-armed Russia since 24 February this year.</p>
<p>Speaking during a devolution meeting in Gweru at the weekend, Mavima said local authorities should de-register NGOs that fail to comply with restrictions on their activities.</p>
<p>Zimbabwe Human Rights NGO Forum (The Forum) director Musa Kika said that the Government needs NGOs to operate successfully. He said:</p>
<blockquote>
<p>The government is being short-sighted and is choosing perceived political expediency over livelihoods, economic well-being, strengthened governance and all that civil society represents.</p>
<p>We have no precedent anywhere in the world where the government operates successfully without civil society, bearing in mind that civil society is the people, citizens self-organising over issues of community and national importance.</p>
<p>There is no sustainability in what the government is doing, so the comments attributed to the minister (Mavima) are unfortunate.</p>
</blockquote>
<p>Crisis in Zimbabwe Coalition (CiZC) spokesperson Obert Masaraure said it is unfortunate that Zimbabwe has “misguided” people like Larry Mavima in leadership positions. Said Masaraure:</p>

<p>I think Mavima is highly misguided. It’s unfortunate that Zimbabwe has such people as leaders who say a country doesn’t need NGOs; a country with more than 7,9 million people living in poverty doesn’t need NGOs?</p>
<p>Even if you go to stable developed countries, they still have NGOs. He doesn’t appreciate the role of NGOs.</p>
<p>What Mavima doesn’t pick is that there is a lot of humanitarian work that is being done by NGOs.</p>
<p>They are feeding thousands of people who cannot afford to get a meal and are sending a lot of dropouts back to school.</p>

Mavima Criticised For His Remarks On NGOs

<h2><span>Full statement by the Zimbabwe Human Rights NGO Forum condemning an increase in electoral violence.</span></h2>
<blockquote>
<p>The Zimbabwe Human Rights NGO Forum (the Forum) unreservedly condemns the increase in political violence that has been recorded over the past month.</p>
<p>The Forum has noted a growing and disturbing trend in politically-motivated violence since the launch of the Citizens for Coalition Change (CCC) in January 2022.</p>
<p>On 27 January 2022, six CCC members were arrested for wearing yellow t-shirts and helmets in the Harare CBD.</p>
<p>Plainclothes police officers severely assaulted the six during the arrest, and one of the six fractured his right arm.</p>
<p>They were detained overnight at Harare Central Police Station nefariously charged with disorderly conduct before being released on ZWL2000 bail each the following day (28 January 2022).</p>
<p>This was followed by a similar incident on 6 February 2022 in which Zimbabwe African National Union-Patriotic Front (ZANU-PF) activists attacked CCC supporters during a campaign in Kwekwe.</p>
<p>ZANU-PF supporters pelted stones towards Kwekwe Central CCC supporter Judith Tobaiwa’s vehicle, destroying windows on the vehicle.</p>
<p>On Monday, 14 February 2022, CCC vice-president Tendai Biti and his aide, Emmanuel Zellers Gumbo, were arrested by three armed police officers, including the Officer-in-Charge of Rhodesville Police Station, and taken to Harare Central Police Station’s Law and Order Section.</p>
<p>Biti and his aide were released without charge after Forum member, Zimbabwe Lawyers for Human Rights intervened.</p>
<p>Although this incident did not culminate into direct violence, the use of State security agents to further political agendas remains a cause for concern.</p>
<p>On 16 February 2022, CCC supporters were assaulted with iron bars by ZANU-PF supporters in Harare East, where Biti is contesting against ZANU-PF candidate Mavis Gumbo for the 26 March by-election. They were assaulted for wearing yellow t-shirts.</p>
<p>On 18 February 2022, a disabled CCC member known as DJ Vaneldo was also attacked by ZANU-PF supporters at his home in Highfields. 
His parents and people around the house were also assaulted. On the same day, 13 CCC members were arrested in the afternoon by the ZRP for allegedly staging a car rally.</p>
<p>They were taken to Harare Central Police Station and charged with public violence for displaying their party leader Nelson Chamisa’s poster on their vehicles.</p>
<p>Some of their vehicles were impounded. The 13 were assaulted by the police and declined access to medical services.</p>
<p>These recent incidents disregard the country’s Constitution. Section 53 of the Constitution of Zimbabwe entrenches the right to freedom from all forms of torture, or cruel, inhuman, or degrading treatment or punishment.</p>
<p>Under Section 216 of the Constitution, the country’s police service is called to protect and secure the lives of the people and uphold the Constitution and enforce the law without fear, favour, or prejudice.</p>
<p>The Forum accordingly condemns the conduct of the ZRP, as the premier institution for enforcing the law and dictates of the Constitution in what should be a non-partisan manner, for exhibiting partiality through its targeting of and clamping down on opposition political party leaders and perceived voices of political dissent.</p>
<p>The Forum reiterates that civil and political rights are guaranteed under the Constitution as encapsulated under section 67 of the Constitution, wherein every Zimbabwean citizen has the right to make political choices freely.</p>
<p>During the 3rd cycle Universal Periodical Review peer evaluation, Justice minister Ziyambi Ziyambi told the Committee Against Torture that Zimbabwe did not ratify the convention because it has domestic laws that adequately provide for antitorture legislation.</p>
<p>It is the Forum’s position that this stance is manifestly inaccurate as the legal framework governing the criminal justice system in the country does not have the definition of torture or any definition that comes closer to criminalising acts of torture, inhuman, cruel, and degrading treatment.</p>
<p>It is against this backdrop that the Forum urgently calls upon the Government of Zimbabwe to take steps to fulfil its obligations arising out of the Constitution of Zimbabwe to respect, promote and protect fundamental human rights and show this commitment to fulfilling these obligations by:</p>
<ul>
<li>speaking out and condemning all acts of violence in the country.</li>
<li>ensuring that the Independent Complaints Mechanism Bill is passed into law without delay.</li>
<li>launching immediate investigations into the allegations of human rights violations being perpetrated by members of the police and taking appropriate action where it is necessary</li>
<li>creating a professional, impartial and accountable police force in Zimbabwe by ensuring that the ZRP immediately stops perpetrating human rights violations including but not limited to beatings, excessive use of force, torture and the intimidation of civilians;</li>
<li>urgently enacting an independent complaints law and establish the independent complaints mechanism, required by the Constitution to ensure that perpetrators of violence are investigated and prosecuted fully and that victims and survivors of violence receive adequate compensation and rehabilitation, and</li>
<li>ratifying the United Nations Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment (UNCAT).</li>

Human Rights NGO Forum Condemns Increase In Electoral Violence [Full Text]

<p>ZANU PF has reportedly commandeered close to 100 hundred buses including school buses to ferry supporters to a rally in Marondera on Sunday ahead of the 26 March by-elections.</p>
<p>According to the Zimbabwe Human Rights NGO Forum, the buses transported people from the whole of Mashonaland East Province to Rudhaka Stadium for a ZANU PF rally to be addressed by Vice President Constantino Chiwenga.</p>
<p>From the pictures posted on Twitter by The Forum, ZANU PF used school buses and the Zimbabwe United Passengers Company (ZUPCO) buses, while a Zimbabwe Prisons and Correctional Service (ZPSC) bus could be seen in the background. See the pictures:</p>
<p>This comes after the Zimbabwe Republic Police (ZRP) warned the opposition Citizens Coalition for Change (CCC) against bussing its supporters to Zimbabwe Grounds, Highfields, Harare for its rally this Sunday.</p>

<p>Some ZANU PF supporters who wanted to leave President Emmerson Mnangagwa’s rally last Saturday were reportedly assaulted and forced back by soldiers and police officers.</p>
<p>According to the Zimbabwe Human Rights NGO Forum, the disgruntled ZANU PF supporters wanted to leave Epworth High School grounds, the venue of the rally before Mnangagwa had spoken.</p>
<p>The Forum also claimed that ruling party supporters forced informal traders in Mbare to close their market stalls and bussed them to attend Mnangagwa’s rally in Epworth.</p>
<p>The people wanted to leave after an announcement that no title deeds would be given out at the rally. The Forum said:</p>

<p>On 12 February, ZANU PF supporters forced informal traders in Mbare to close their market stalls and attend a rally addressed by President Emmerson Mnangagwa in Epworth. </p>
<p>Buses were deployed to ferry people to Epworth, with ZANU PF youth ordering some members, most of whom got the stalls through the ZANU PF patronage system, to abandon business and attend the rally.</p>
<p>At the same time, some ZANU PF youths were also forcing informal dealers at Gazaland, Highfields to abandon their workstations and attend the President’s rally.</p>
<p>Assaults Disgruntled ZANU PF party members who attempted to leave the Epworth venue before President Emmerson Mnangagwa addressed the rally were beaten up and forced back by armed soldiers and police.</p>

'Soldiers, Police Officers Assaulted People For Leaving ED's Epworth Rally Early'

<div><strong>1.0 Introduction</strong></div>
<div>This report covers two days, Saturday 25 and Sunday 26 July 2020 which marked days 116 and 117 of the national lockdown declared by President Emmerson Mnangagwa and has been in place since 30 March 2020 respectively. By Sunday 26 July 2020 confirmed COVID-19 cases had increased to two thousand five hundred and twelve (2 512). Local transmissions accounted for one thousand four hundred and eighty-six (1 486). The number of cumulative tests done stood at one hundred and nineteen thousand eight hundred and sixty-six (119 866). The death toll increased to (34).</div>

<div><strong>2.0       Methodology</strong><br/>

<div><strong>3.0       Requirements for exemption letters</strong><br/>
The National Police Spokesperson Assistant Commissioner Paul Nyathi issued a press statement in which he announced conditions required for citizens to be grated exemption letters. The documents considered for movement exemptions are clustered as follows:</div>
<ul>
<li>Health sector are required to be in uniform, and should have their work issued identification cards. Those in civilian attire, require a letter from the Medical Superintendent or Chief Executive Officer (CEO) stating the place, dates, and times for reporting on and off duty.</li>
<li>Companies/Organisations- letters from the Chief Executive Officer or General Manager stating the place, days and times of reporting on and off duty.</li>
<li>Ministries/ Parastals and Provincial levels- National Level exemption letters signed by Directors and senior management stating the duty, place, days, and times of reporting. For provincial levels-an exemption letter from Provincial Heads stating the duty, days, and times of reporting.</li>
<li>Commercial A2 and A1 farmers- an offer letter or lease agreement and exemption certificate from local Officer in Charge station.</li>
<li>Workers for food retailers have to present certified copies of a shop licence and an exemption letter from the police, members of the public are implored to do their shopping within a five-kilometre radius of their residence to acquire basic necessities like food, gas and medicine</li>
<li>To get medical supplies, one has to produce the medical cards or prescription and contact details of a doctor</li>
<li>For the attendance of funerals, concerned relatives have to produce a copy of burial order to the local police station and need to be issued with exemption letters showing destination and dates of movement to those who intend to bury relatives in other areas.</li>
</ul>

<p>All the documents must indicate the details of the person who issued them including their telephone numbers and designation.</p>
<p><strong>4.0       Highlights</strong><br/>
Government gazetted Statutory Instrument 186 of 2020 Public Health (COVID-19 Prevention, Containment and Treatment) (National Lockdown) (Amendment) Order, 2020 (No. 15), which empowered police officers to seize any public transport vehicle or other vehicle which doesn’t fall under the category of essential services, to carry passengers for commercial purposes. Government also advised that it had completed working on guidelines for the transport sector.  The guidelines were said to be under the consideration of the Ministry of Health and Child Care to ensure that they are in line with protocols that curb the spread and transmission of COVID-19.</p>
<p>The Permanent Secretary in the Ministry of Information and Publicity Mr Nick Mangwana reported that churches are still allowed to hold services as long as they satisfy the following conditions:</p>

<ul>
<li>They should disinfect premises before and after each service.</li>
<li>They should have facilities to wash hands or sanitise hands.</li>
<li>Mandatory temperature checks for all congregants.</li>
<li>Congregants should wear masks and exercise physical distancing.</li>
</ul>
<div>
<p>Meanwhile, police officers arrested twenty (20) members of the Johan Masowe Wechishanu congregation on the outskirts of Gwanda town. The congregation did not satisfy the necessary requirements like infrared thermometers, attendance register, hand sanitisers among others. Congregants were released after paying an admission of guilt fine of ZWL200 each.</p>
<p>Bulawayo City Council Director of Health Services, Dr Edwin Sibanda identified Cowdray Park, Magwegwe West, Nkulumane and Emganwini suburbs as having the highest number of infections while in terms of institutions, the hotspots have been identified as Mpilo Central Hospital, United Bulawayo Hospitals, Khami Maximum Prison and Bulawayo Prison. Nonetheless, it could not be established how many confirmed cases were attributed to each locality.</p>
<p>The Zimbabwe Electoral Commission (ZEC) chief elections officer Mr Utloile Silaigwana advised that electoral activities will soon commence under strict COVID-19 guidelines crafted by ZEC to allow for safe resumption of elections. Addressing journalists, Mr Silaigwana stated that the new COVID-19 policy on electoral activities will include mandatory temperature checks for voters, sanitisation of participants, equipment and election material, and social distancing. ZEC has adopted a final draft of the guidelines following a consultative process with stakeholders.</p>
<p>The Minister of Finance and Economic Development Professor Mthuli Ncube advised that one million households will start receiving ZWL300 monthly pay-outs as part of the government’s efforts to cushion people whose sources of income have been affected by COVID-19. Addressing a ZANU PF Provincial Co-ordinating Committee (PCC) meeting in Gwanda, Professor Ncube advised that the total number of beneficiaries might rise depending on the response from the public. However, details of the criteria and mode of payment of the ZWL300 pay-outs were not publicised.</p>
<p>Chief Co-ordinator for the National Response to the Covid-19 Pandemic in the Office of the President and Cabinet, Dr Agnes Mahomva advised that government is procuring more personal protective equipment (PPE) and undertaking extensive training of healthcare workers to effectively use available gear to curb the spread of COVID-19 within the health workforce. This comes as 323 health workers have contracted COVID-19 since the beginning of the outbreak in March as local infections continue to rocket.</p>
<p><strong>5.0       Attack on Journalists    </strong><br/>
Journalists Blessed Mhlanga and Ruvimbo Nyikadzino were arrested at a police-controlled checkpoint on their way into the CBD for a press conference which had been called by the Minister of Information and Broadcasting Services Senator Monica Mutsvangwa.  The two were detained at Mabvuku Police station. According to Blessed Mhlanga, the duo was turned away at a checkpoint and told to return to their places of residents. The journalists complied and subsequently made a call to the National Police Spokesperson Assistant Commissioner Paul Nyathi to explain the situation. The National spokesperson then informed them that he had spoken to the commanders at the roadblock hence they could proceed to work. However, upon reaching the roadblock, the officers were agitated and said the journalists were not complying with their instructions. The two journalists were then arrested for a miscellaneous misdemeanour and taken to Mabvuku Police station where they were briefly detained. The Media Institute for Southern Africa (MISA) offered legal assistance for the duo.</p>

Nontokozo Tachiona, a lawyer and the Young Lawyers Zimbabwe filed an urgent application at the High Court Harare challenging the legality of a press statement issued by the Zimbabwe Republic Police.  In the press statement the police announce that all people passing through checkpoints should have letters with certain information, which information according to the Applicants is not provided for in the regulations. Further, the Applicants are also seeking that Statutory Instrument 83of 2020 and Statutory Instrument 174 of 2020 be declared unconstitutional.</div>

<div><strong>8.0 Conclusion</strong><br/>
The Forum remains gravely concerned by the number of confirmed COVID-19 local transmissions. This comes at the backdrop of consistent defiance of the lockdown regulations by citizens and increased escapes from quarantine centres. Though the Forum welcomes the new lockdown regulations particularly noting their importance in curbing the pandemic, the Forum reminds the government that human rights for all should still be observed during the lockdown. The Forum further notes the increasing attacks against journalists and media practitioners by State security agents, the Forum calls upon the respect for media freedoms.</div>
