The Supreme Court this Wednesday reserved judgment in a case which Nelson Chamisa is challenging a High Court ruling which nullified his presidency of the MDC.
The High Court had ruled that Thokozani Khupe was the legitimate leader of the party since she was the acting president when the late party founding leader, Morgan Tsvangirai died.
Khupe’s lawyer, Professor Lovemore Madhuku said the court was going to evaluate the legality of the developments that transpired following Tsvangirai’s death. He said:
We were arguing that when he died, our client Khupe ought to have become acting president, the other side says no, what happened then was correct that they had a meeting on 15 February 2018 which brought in Chamisa.
The court is not being called to say which group is MDC, they are saying whether what happened was lawful when it happened.
Meanwhile, MDC Alliance secretary for elections, Jacob Mafume said that the MDC leadership can not be decided by courts.
He added that both the Chamisa and Khupe led groupings have since conducted their congresses which effectively render the case a non-event.
