Chamisa Takes Khupe Case To Supreme Court, Says Judge Misdirected Himself

MDC-T leader Nelson Chamisa has challenged High Court judge Justice Francis Bere’s decision in which he ruled that application by MDC-T (Chamisa) was not urgent and that the dispute should be handled through arbitration. Chamisa’s MDC-T party had been seeking to bar Thokozani Khupe and her breakaway party from using the MDC-T name and symbols.

In the Supreme Court appeal which was filed by Thabani Mpofu, the lawyer for MDC-T (Chamisa) said:

….The court a quo (the court in which the matter was first heard) seriously misdirected itself, such misdirection amounting to an error in law, in finding at any rate that the matter before it was not urgent and so erred in failing to consider the applicable principle of time and consequence; the application of which entitled appellant to the indulgence of an expedited hearing.
