News:Judge postpones judgement on demo ban to 27 September

<vote /> Judge president, Justice George Chiweshe has postponed another application challenging the ban of demonstrations in Harare. The ban was proclaimed on the 16th of September by the police in terms of Section 27 of the Public Order and Security Act (POSA). Judge president Justice Chiweshe postponed the hearing and ordered the applicant, Bishop Ancelimo Magaya of Zimbabwe Devine Destiny to file heads of argument before the 21st of September. Magaya is being represented by Tendai Biti and Dzimbabwe Chimbgwa.

The state represented by Fortune Chimbaru is also expected to file a response by the 23rd of this month. Before postponing the matter, Justice Chiweshe indicated that this application is very important hence the parties must be afforded ample time to file their papers. Zimbabwe Lawyers for Human Rights will argue that the ban is unconstitutional as it is not proportional and does not comply with the principles of natural justice. Further, the proclamation breaches Section 58, 59, 60, 61,66 (2) 67 (2), 68 of the Constitution as well as provisions of the Administration of Justice Act.

Oral Hearing will be on 27 September 2016 while judgement has been set down for 30 September 2016.
