High Court challenge against Tsvangirai's appointment of Chamisa & Mudzuri as MDC-T Vice Presidents commences
The High Court challenge by Patson Murimoga and George Rice who claim to be MDC-T party members commenced today.
The two cite Tsvangirai, Chamisa, Mudzuri, MDC national chairman Lovemore Moyo and MDC as respondents and accuse Tsvangirai of failing to follow the party’s constitution when he appointed Chamisa and Mudzuri as the party’s vice presidents in July last year. However, Tsvangirai through his lawyer, Thabani Mpofu raised a preliminary point seeking the dismissal of the case with costs at a high scale on the basis that Murimoga and Rice used the wrong constitution to pursue the matter and that they did not exhaust internal remedies provided by the party constitution before approaching the court. The applicants lawyer, Zivai Macharaga counter argued that his clients had a right to approach the court and challenge Tsvangirai’s appointments by virtue of being members.
