Full statement by the Zimbabwe Human Rights Commissions (ZHRC) on the upcoming 2023 harmonised general elections.
<blockquote>
ZIMBABWE HUMAN RIGHTS COMMISSION PRESS STATEMENT ON UPCOMING 2023 HARMONISED GENERAL ELECTIONS.
In line with its constitutional mandate to promote, protect and enforce human rights, the Zimbabwe Human Rights Commission (ZHRC) as the National Human Rights Institution of Zimbabwe would like to remind the public of their political rights and obligations as we approach the 2023 General Elections.
Political rights refer to an individual’s ability to participate in the civil and political life of the society and the State without fear of discrimination or repression.
The right of everyone to participate in the government of his or her country is a fundamental human right and should be applied without discrimination.
Elections play an important role in ensuring adherence to the right of political participation. International human rights instruments protect a number of basic rights that are crucial to a meaningful electoral process.
The right to participate in free and fair elections includes rights such as participating freely in political rallies, events, or protests.
Freedom of expression including freedom of the media, freedom of assembly and association and freedom from torture, cruel, inhuman and degrading treatment are part of people’s inalienable rights Article 21 of the Universal Declaration of Human Rights provides that everyone has the right to take part in the Government of their country, directly or through freely chosen representatives.
Article 23 (1) further provides that, “the will of the people shall be the basis of the authority of Government; this will shall be expressed in periodic and genuine elections which shall be by universal and equal suffrage and shall be held by secret vote or by equivalent free voting procedures.”
The International Covenant on the Civil and Political Rights (ICCPR) guarantees in Article 25(b) that every citizen shall have the right and opportunity, “to vote and to be elected at genuine periodic elections which shall be by universal and equal suffrage and shall be held by secret ballot, guaranteeing the free expression of the will of the electors.”
Furthermore, Article 13 (1) of the African (Banjul) Charter on Human and Peoples’ Rights provides that “every citizen shall have the right to participate freely in government”.
In line with these international standards, Section 67 of the Constitution of Zimbabwe guarantees political rights for every Zimbabwean citizen.
The key element of the right includes the following: free, fair, and regular elections for any elective public office; making political choices freely; forming, joining and participating in activities of a political party of choice; campaigning freely and peacefully for a political party or cause and standing for election for a public office among other such considerations.
The Commission is currently observing, assessing and monitoring the human rights situation and freedoms towards the election in all Provinces as part of its mandate under Section 243(1)(c) of the Constitution.
The ZHRC calls upon various stakeholders including political parties and political actors, other Independent Commissions, Traditional Leaders, religious leaders and faith-based organisations, as well as civil society organisations to actively promote political tolerance in the build-up to the 2023 Harmonised Elections, in order to uphold human rights and fundamental freedoms of all citizens.
We make this statement in support of His Excellence, the President’s repeated call at Zimbabwe’s 43rd Independence Celebrations in April 2023 held in Mount Darwin, at which he urged the nation to remain vigilant, united and preach peace in all families, churches and communities. He promised free, fair and credible elections, free from political violence with the aim to promote democracy.
In light of the aforesaid, the ZHRC encourages the public at large to practice political tolerance and maturity, respect divergent views and to co-exist with one another, to avoid violating human rights and fundamental freedoms of other citizens in the pretext of supporting political parties of their choice as well as to report threats of violence or acts of violence to the Zimbabwe Republic Police (ZRP) for investigations.
In conclusion, the ZHRC hereby exhorts all political parties to abide by the following:
1. To ensure political tolerance and co-existence among political rivalries to avoid monopoly in their dealings as well as to refrain from victimizing and threatening others;
2. To ensure that their members exercise restraint in their activities by promoting political tolerance and diversity of views as well as accepting political pluralism;
3. To ensure that their members in garnering support for their candidates desist from advocating and resorting to violence in speech and action and do not use force and threats as that has an effect of violating the rights of other individuals;
4. To desist from interfering with other political rivalries’ right to association and assembly;
5. To desist from using Traditional Leaders to further their political interests as that is inconsistent with Section 281(2) of the Constitution;
6. To promote peacebuilding activities in a bid to de-escalating political violence; and
7. To continuously encourage and train their members on human rights-based approaches in the conduct of their party’s political business.

Zimbabwe Human Rights Commissions (ZHRC) Statement On 2023 General Elections | Full Text

The Zimbabwe Human Rights Commission (ZHRC) has urged chiefs to uphold constitutionalism and stay away from politics.
Speaking during a pre-election workshop for political parties and other stakeholders held at a hotel in Bulawayo on Tuesday, ZHRC executive secretary Delis Mazambani said chiefs’ mandate is fostering development and resolving disputes among their subjects.
The <a href="https://newsday.co.zw/southerneye/local/article/200013892/stay-away-from-politics-chiefs-told">Southern Eye</a> reported that Mazambani reiterated that the country’s Constitution forbade traditional leaders from being members of a political party. Said Mazambani:

Section 282 of the Constitution states that traditional leaders who include chiefs, village heads and headmen have several functions that include facilitating development and resolving disputes in their communities in accordance with customary law.
The Constitution bars traditional leaders from being members of any political party or participating in any way in partisan politics, acting in a partisan manner, or furthering the interests of any political party or cause.
</blockquote>
The Constitution states that chiefs must be apolitical, and “must not in any way participate in partisan politics, act in a partisan manner, further the interests of any political party or cause or violate the fundamental rights and freedoms of any person”.
In 2020, the Election Resource Center approached the High Court in a bid to see the president of the Zimbabwe Chiefs Council Fortune Charumbira punished for defying a court order that ordered him to issue an apology in 2017 after <a href="https://zero.pindula.co.zw/chief-charumbira-ordered-to-withdraw-statement-urging-chiefs-to-support-zanu-pf/">he was quoted urging all chiefs to rally behind ZANU PF in the elections that were going to take place the following year.</a>
Chief Charumbira refused to apologise prompting the ERC to approach the court again.

Human Rights Commission Tells Chiefs To Stay Away From Politics

<blockquote>The Zimbabwe Human Rights Commission (ZHRC) wishes to notify all its valued partners and stakeholders of the retirement of four Commissioners namely: Commissioners (Dr) Ellen Sithole (former Deputy Chairperson), Dr Joseph Kurebwa, Kwanele M. Jirira and Japhet Ndabeni-Ncube, with effect from the 7th May 2020.
Before the retirement of the four Commissioners, there was already a vacancy after the resignation of Commissioner Carrol T. Khombe on the 3oth of October 2018.
The ZHRC is left with only four Commissioners, out of a full complement of nine Commissioners. The remaining four Commissioners do not constitute a quorum, which is supposed to be five.
This means that as of now the ZHRC cannot hold Commission meetings for purposes of making policy resolutions or adoption of monitoring and investigation reports.
This handicap prevents the dissemination of ‘unadopted’ Commission reports which are being produced for activities that are currently taking place.
The reports which are being produced now are filed of record and will only be adopted by the Commission after new Commissioners have been appointed.
In the meantime, the Commission can only share statements which provide highlights of the activities being carried out.
Processes for recruitment of new Commissioners are currently underway. Parliament advertised the positions but interviews have not yet been conducted due to disruption of Parliament business by the national lockdown.
With the resumption of operations by Parliament, it is our hope that new Commissioners will be appointed without delay.</blockquote>

ZHRC Statement On The Resignation Of Four Commissioners {Full Text}

<blockquote>The Zimbabwe Human Rights Commission joins the nation and the rest of the international community in celebrating the International Women’s Day running under the theme, “Think Equal, Build Smart, Innovate for Change” placing innovation efforts by women and girls at the heart of all efforts that are channelled to achieve gender equality.
Over the years, women have proved that they are capable of economic, social and political spheres of life and their efforts have made the world a better place to live.
Section 56 of the Constitution of Zimbabwe and other regional and international treaties that Zimbabwe is party to have guarantee equality and non-discrimination before the law.
However, the lived experiences of many women in Zimbabwe have limited their ability to be equal with men for them to excel in all spheres of life.
Women and girls suffer disproportionately as existing inequalities are exacerbated by deterioration of the current economic environment and acute poverty.
This has drawn back the potential of women to meaningfully contribute to development on an equal basis with their male counterparts.
Women continue to experience inequalities including limited opportunities in accessing services, violation of their basic human rights such as the right to food and water as well as the right to health care which accords them value and dignity.
The Zimbabwe Human Rights Commission is encouraged by the recent commitment by President Mnangagwa to continue working towards full equality and further empowerment of girls and women in Zimbabwe.
The country has already set the tone for a realisation of equality and gender balance through the Constitution and commitment to show political will by the leadership.
There is need to avail financial support, skills development and the appointment of women to critical positions of influence among other measures in order for the country to benefit from the full potential of women as equals in development.
ZHRC calls on the State to expedite the alignment of legislation such as the Children’s Amendment Bill and the Marriages Amendment Bill to the Constitution in order to adequately protect women and girls.
All stakeholders should collaborate in efforts towards empowering women in all spheres of life in order to realise the global theme of thinking equality and being innovative in order to realise the desired change.
The harmonisation of all these efforts will lead to gender quality and the full empowerment of women and girls in line with sustainable development goal number 5 on gender equality.
Women have proved that with a supportive and conducive environment they can champion innovative efforts that improve the world and indeed the future is female.</blockquote>
