Harare residents submitted a petition to their City Council on Monday regarding the recent <a href="https://news.pindula.co.zw/2023/04/28/council-redoubles-efforts-to-control-budiriro-cholera-outbreak/">cholera outbreak</a> in the city. Over the past few weeks, Harare has reported more than 20 cases of cholera.
As of Friday, the Health and Child Care Ministry reported at least five cases in Harare since the previous Wednesday. The country has had a total of 665 suspected cholera cases and five deaths.
The residents’ petition, directed to Mayor Jacob Mafume, accuses Harare City Council of being primarily responsible for the outbreak. Read the petition:

We are further disturbed by Harare City Council’s failure to efficiently attend to and provide permanent solutions to perennial sewer bursts, access to clean potable water and non-collection of refuse which are major drivers of waterborne diseases including cholera with a potential to contribute to the spiking and surging of reported cases in Glen View, Budiriro, Mbare and Dzivarasekwa.
A case in point is at number 4257 Glen View 3, where sewer bursts contaminated a well which residents rely on for domestic purposes posing a health hazard to the residents of Harare.

Residents of Harare blame the city council for the current cholera outbreak, citing poor sanitary conditions in high-density suburbs, such as Glen View, Mbare, Mabvuku, Budiriro, Mufakose, and Dzivarasekwa.
The petition states that these conditions have led to the contamination of water sources, which residents rely on for safe drinking water. The city council has not done enough to fix the sewer system, and communal toilets and bathrooms have not been cleaned, forcing residents to do it themselves without proper equipment and protective clothing.
The petitioners urged the city council to improve service delivery, refurbish old sewer pipes, provide alternative clean water sources in cholera hotspots, and call an emergency all-stakeholders meeting to address the outbreak.

Harare Residents Petition Council Over Cholera Outbreak

City of Harare Mayor <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume </a>has responded to the Environmental Management Agency (EMA)’s ultimatum as well as ‘taking over’ declaration on uncollected garbage in the capital city.
Early this month, EMA gave the City Fathers a 10-day ultimatum to remove uncollected garbage in Mbare or face sanctions. 
The City of Harare was served with an environmental protection order to remove garbage from undesignated places in Mbare.
On Sunday, it was reported that <a href="https://news.pindula.co.zw/2023/02/19/ema-set-to-take-over-city-of-harares-waste-management/">EMA will be taking over the capital city’s waste management.</a>
Mafume, speaking at a Council function today, scoffed at those threats, saying they don’t many any sense at all.  He said:

We want to advice ministers, to look at the press releases that are released from their offices and to manage their offices and to manage their ministries as professional entities. 
It is irresponsible for one to make such imperious announcements when they were simply supposed to announce that they had bought some equipment.

Mafume reiterated that EMA does not have the power to involve itself in refuse collection matters. He said:

From my own understanding,  EMA is a regulatory body. It does not involve itself in the collection of refuse, it monitors all and everybody —public and private, who is polluting the environment.

Uncollected Gabarge: Harare Mayor Mafume Scoffs At EMA's "Taking Over" Declaration

President Emmerson Mnangagwa has said the people he sends to solve the issue of land barons are also involved in the illegal allocation of state land. 
He made the remarks on Monday 13 February 2023 while officially opening the Aspindale Park and Aspire Heights Development in Harare. <a href="https://www.newsday.co.zw/local-news/article/200007445/land-barons-are-top-officials-ed">NewsDay</a> cites him as saying:

I have realized that the people I send to solve the issue of land barons are also involved. They cannot arrest themselves because they are thieves.
I have seen some of the settlements when I am flying out of the country. Some of the houses are so small and I wonder if there are any toilets there. I also wonder if they have addresses. I am sure most of the people use their memory to locate them. We do not want such settlements.
Trends show that once housing and infrastructure growth are accorded an integral part in development, a nation is better poised to effectively implement its economic production and productivity mix.
</blockquote>
He also vowed that he will wrestle local authorities from the opposition in the general elections later this year. He said:

Is Jacob Mafume here (Harare Mayor)? This time we are going to take control of the councils in the coming elections. The councils have failed to collect refuse and potholes are everywhere. Local authorities are reminded that the provision of often interlinked and functional facilities remains imperative.
To this end, the prioritisation of backbone infrastructure such as water, health, waste management, transport and other related services is critical.

Over the years, local government authorities demolished thousands of houses built on illegally-acquired land or on undesignated sites like wetlands.

"People I Send To Solve The Issue Of Land Barons Are Also Involved" - Mnangagwa

Harare City Council (HCC) has dismissed reports in local media that there has been massive land looting at the local government authority.
The Herald reported on Friday that opposition Citizens Coalition for Change (CCC) councillors in Harare, working in cahoots with top council officials and their MDC Alliance counterparts, buy commercial and industrial stands for as little as US$60 and resell them at more than US$120 000.
The state-run publication says there are documents which show that the council’s Mayor Jacob Mafume received land in parts of Harare. Other councillors who are said to have received land include:

i). Denford Ngadziore, 
ii). Stanley Manyenga, 
iii). Adonia Shoko and 
iv). Jason Kautsa 
</blockquote>
The Herald further says councillors Happymore Gotora, Joseph Kunashe, Keith Charumbira, Brian Matione, Costa Mande, Maxwell Dutuma, Midia Mudariki, Tichaona Mhetu, Runyowa Chihoma and Gaudencia Marera are also involved in the alleged scam. 
In a response seen by Pindula News, the city fathers said the stands in question were leased to the said individuals, therefore, they are not allowed to sell them. Reads the statement:

Council has noted with concern the flimsy and malicious allegations carried in today’s edition of The Herald against councillors and senior officials.
In the story, The Herald purported that councillors and officials had sold themselves commercial stands for a song when in actual fact the councillors and officials were applying to lease the said land after following laid down procedures.
Council has proper laid down procedures and processes for all applications of industrial and commercial stands including those made by policymakers and officials.
As has become the norm The Herald chose to ignore the facts and even failed to contact the relevant officials for comment showing the obvious intent to injure and harm the reputations of the councillors and officials written in the story.
This is against journalistic principles which requires journalists to seek comment before publishing such articles. Council will make an official complaint to the Voluntary Media Council and is contemplating taking legal action against The Herald.
As a statutory requirement everyone including Councillors should apply for industrial stands as per the Ministerial directive and should follow due processes .
The stands in question which were offered to policymakers, officials and other beneficiaries are on lease ONLY and therefore can not be sold as alleged in The Herald. A leased stand remains a council property and can not be sold or sub-leased.
Every beneficiary is supposed to pay monthly rental around RTGs 500 000+ depending on the size of the stand for the next 5yrs after the signing of the lease agreement.
Any beneficiary who fail to pay the monthly rentals will have their leases cancelled.
The lease agreement does not allow any beneficiary to sell the land as claimed by The Herald.
It is also important to note that, other Council procedures are yet to be followed which include but not limited to advertising in line with Section 159 of the Urban Councils Act.
For The Herald to report that Councillors since sold the stands in question is not only blatantly false but also defamatory as one cannot sale a stand which they are yet to be allocated.
It is also important to note that the benefits and welfare of councillors are determined by the minister not by councillors themselves while those of senior officials come as conditions of service in line with the Kurasha Commission Report.

Harare City Responds To Claims That Mafume, Other Councillors Buy Land For US$60

The <a href="https://www.pindula.co.zw/Reserve_Bank_of_Zimbabwe">Reserve Bank of Zimbabwe (RBZ)</a> has agreed to provide <a href="https://www.pindula.co.zw/Harare_City_Council">Harare City Council (HCC)</a> with foreign currency to buy water treatment chemicals to improve the potable water supply in the capital.
This came after a meeting on the water situation which was held last week between RBZ and HCC where RBZ governor John Mangudya was present.
RBZ also agreed to provide foreign currency to import 15 service delivery vehicles from South Africa, NewsDay reported citing Harare mayor <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a>. He is quoted as saying:

We met RBZ authorities last week and we agreed to find a lasting solution on the issue of water in our city. The RBZ agreed to provide us with the much-needed foreign currency so that we can buy the water chemicals for treatment of water.  Once we have the figure, we will announce the development.
We are happy that the RBZ has agreed to meet some of our challenges.  We also await 15 service delivery trucks which are outside the country because the contractor was affected by the foreign currency challenges, and has been failing to get the required currency. The contractor needs at least US$1,2 million dollars to import the trucks.

Harare City Council (HCC) has said it will begin levying interest charges on residents and commercial property owners who have outstanding balances on their monthly bills starting this month, according to <a href="https://www.sundaymail.co.zw/new-harare-charges-interest-on-outstanding-bills">The Sunday Mail</a>. 
In a statement, HCC said interest charges have been necessitated by a need to preserve the value of money. Reads the statement in part:

The City of Harare would like to advise its valued ratepayers, residents and stakeholders that it will begin to levy interest on all outstanding balances with effect from October 31, 2022. 
All residents with outstanding balances are therefore encouraged to clear their balances before this date or approach council finance offices for payment plans to avoid the interest charges.

Harare Mayor, <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a>, claimed in September 2022 that the local government authority <a href="https://zero.pindula.co.zw/mayor-says-harare-is-owed-zwl45-billion-by-residents-govt-and-business/">is owed ZWL$45 Billion by residents, the central government and businesses.</a>
Mafume, a Citizens Coalition for Change (CCC) councillor for Ward 17 Mount Pleasant, told a stakeholders’ meeting recently at the Town House that the failure by residents, institutions and Government Ministries to pay for services had affected Harare City Council’s operations.
He said the local government authority was failing to pay its service providers and as a result was failing to deliver required services to its clients.

Harare Resolves To Levy Interest Charges On Ratepayers With Outstanding Balances

A Harare woman allegedly gave birth in <a href="https://www.pindula.co.zw/Glenview">Glen View</a> Poly Clinic after being neglected by health caregivers at the institution.
The incident which occurred on the 27th of September 2022 has attracted the wrath of other residents who have now petitioned Harare Mayor, Councillor Jacob Mafume over the matter.
The Combined Harare Residents Association (CHRA) claims that Ms Esthina Swaba gave birth in a toilet at Glenview Poly Clinic on Tuesday the 27th of September 2022.
This was reportedly after the health personnel on duty refused to attend to her when she was in labour and referred her to Harare Hospital.
The health caregivers allegedly argued that the Glen View Poly Clinic’s policy does not allow attending to pregnant women who will be giving birth for the fifth time.
It is alleged that the nurse on duty further withheld the woman’s maternal health card for an unspecified reason despite referring the woman to Harare Hospital.
In their petition to the Mayor, the residents highlighted the violation of human rights provided in sections 48, 51, 53, 68 and 76(1) of the Zimbabwean Constitution which speak of the right to life, right to personal dignity, right to be protected from physical, psychological harm and/ or degrading treatment, right to administrative justice, and the right to have access to basic health-care services among others.
The constitution also states “that no person may be refused emergency medical treatment in any healthcare institution.”
<h2>Therefore, the residents demand the Harare Mayor to:</h2>
<blockquote>
i. Make a mandatory policy for all the health personnel on duty to wear name tags/staff badges for easy identification and to improve the complaint reporting mechanism.
ii. Direct the Health Director to publicize the Patients Charter including sharing digital posters of the charter and hanging posters of the charter at all council clinics, and offices.
iii. Inform the Director of Health to effect disciplinary measures on the nurse/health personnel who ill-treated Ms Swaba and if possible remove her from Glen View Poly Clinic, and take responsibility for any damages and cost incurred during giving birth caused by the negligence of their health personnel.
iv. Increase budget allocation and fiscal commitment toward maternal health care provision in the 2023 Council Budget, and make maternal health a priority in the year 2023.
v. Put maternal health provision on the agenda of the upcoming Full Council Meeting or call for a Special Council Meeting to discuss the Status of Maternal Health Care Provision in the City and come up with recommendations.
vi. Set up an Investigation Committee in terms of Section 100 of the Urban Councils Act 29:15 on the Status of Maternal Health Provision in the City of Harare, considering the continued reports of negligence, corruption and poor maternal provision in Council health centres across the city.

Harare Woman Gives Birth In A Clinic Toilet After Being Neglected By Health Caregivers

Harare Mayor, Jacob Mafume has said some of the local government authority’s projects stalled due to delays by the central government to disburse the money allocated through the intergovernmental fiscal transfers popularly referred to as the devolution funds.
Addressing a budget consultative meeting at Town House, Mafume called for the full implementation of devolution to ensure that local government authorities have access to devolution funds in time to enable them to provide service delivery.
He said the money which Council is receiving from Government’s devolution funds and ZINARA is not enough. He said:
<blockquote>
As we prepare the budget, we are advised of our allocation in terms of the intergovernmental fiscal transfers popularly as the devolution funds.
For the year 2022 we were allocated ZWL$2,3 billion and so far we have received ZWL$165 million which was predominantly for the Water, Sanitation and Health (WASH) and Roads programmes.
This means all projects that were supposed to be funded using the IGFT cannot be completed. It is now pertinent that the requisite policy, regulatory and institutional frameworks necessary to fully operationalize and entrench the implementation of devolution agenda are put in place so that we can access our allocation fully.
</blockquote>
Mafume says ZINARA failed to allocate the council ZWL$825 million for the roads programme and only managed ZWL$248.7 million which is a quarter of the budgeted funds.
He said Harare’s infrastructure has a backlog of over 20 years and the area can be a huge opportunity for investors and or the private sector.
Mafume added that dependence on rates for infrastructure development was not ideal.

Harare Mayor Says Projects Stalled As Only A Fraction Of Allocated Devolution Funds Was Received

Harare City Council (HCC) is offering residential stands to war veterans who have been serving Council in various departments since Independence.
This was announced by Harare Mayor, Councillor <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a> who indicated that about 132 war veterans are set to benefit. 
Mafume made the remarks while conferring ranks to newly promoted officers and dog handlers at a pass-out parade held at the Harare Municipal Police Headquarters.
The promotions saw officers being promoted to ranks of Superintended, Chief Inspectors, Inspectors and sergeants.
There are 132 war veterans who are still serving in various Council departments and some of them have no residential stands. Said Mafume:
<blockquote>
About 132 war veterans have been working for about 42 years now but do not have a place to stay but people younger than them have stands. We are going to rectify that and make sure that those who served the country will get stands.

He acknowledged the presence of women in the force some of whom were also promoted.
Mayor Mafume said Council is going to promote gender in the city’s recruitment process in order to have gender parity.

Harare Offers Residential Stands To War Veterans

Harare Mayor, Councillor <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a> has criticised corruption in the local government authority saying action must be taken to curb the rot. 
Mafume made the remarks during the council’s Audit committee workshop.
Using the viral example of Blinart Investments which won the <a href="https://zero.pindula.co.zw/chokuda-says-he-cancelled-the-laptop-tenders-in-august/">tender to supply 173 laptops at USD9 264.48 each,</a> the Mayor said the council will not hesitate to act against workers who are corrupt as this has seen the local authority lose money. He said:
<blockquote>
We need to look at our systems and act to arrest leakages and as audit, such activities need to be our must-dos, as the internal eyes for council.
</blockquote>
While local authorities blame poor service delivery on a lack of adequate resources, research suggests that corruption is regarded as one of the leading factors that have contributed to the demise of subnational governments. 
Zimbabwe has experienced widespread corruption in virtually all levels and tiers of government as well as all sectors of the economy, according to Public Administration expert, Dr Tawanda Zinyama, a lecturer at the University of Zimbabwe. 
While Harare has been struggling to provide basic services such as sewer reticulation, garbage collection and provision of potable water, there have been reports that senior officials in the council have been converting council funds to personal use. 
The billing system was also said to be vulnerable to abuse amid reports that some officials had parallel accounts and additional swipe machines they used to pocket council money.

Harare Mayor Mafume Criticises Corruption In The Council

Harare Mayor, <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a>, has said there is a need for a citywide pipe replacement programme.
He made the remarks on Tuesday during a Special Council meeting convened to deliberate on water challenges being faced in the capital.
The meeting came amid reports that some of the water pumped by the local government authority was not reaching intended targets due to bursts of the old pipes. 
Harare’s water pipeline was installed during the colonial era save for suburbs that were established after independence. 
Mafume also said new suburbs are posing a challenge to the pipeline replacement agenda adding that people were settling without the requisite infrastructure.
Speaking on water challenges, Councillor Duma said the problem is that chemical suppliers are failing to provide the city with the required chemicals. Duma moved a motion to open the tender to other suppliers.
He also said the local government authority has to be ruthless to people who illegally connect themselves. 
Councillor Duma also urged Council to distribute the water equally so that all areas can access water.
Meanwhile, Mayor Mafume said Harare City Council would write to the central government requesting that the chemicals market be opened to end Zimphos monopoly.

Harare Mayor Mafume Says There's Need For A Citywide Pipe Replacement Programme

Harare Mayor, Jacob Mafume has said Citizens Coalition for Change (CCC) councillors are maintaining that the local government authority won’t pay the money it owes to Geogix BV as per the Pomona Waste to energy deal.
The deal was signed between Harare City Council and Geogenix BV, a Netherlands company fronted in Zimbabwe by <a href="https://www.pindula.co.zw/Dilesh_Nguwaya">Dilesh Nguwaya</a> who is said to have close links with the first family.
Mafume dismissed as false, the reports by <a href="https://www.herald.co.zw/ccc-in-pomona-deal-climbdown/">The Herald</a> that the councillors had retreated from their stance and eventually endorsed “the deal yesterday.”
CCC councillors have for weeks now been pushing for the reversal of the agreement with the Netherlands-based firm, Geogenix, which they say Local Government and Public Works Minister, July Moyo imposed on the local government authority.

THE opposition CCC-led Harare City Council yesterday made a volte-face on the €304 million Pomona Waste to Energy deal after weeks of politicking trying to reverse an agreement they had earlier sanctioned with the Netherlands-based firm, Geogenix.
The council proposed to fund the Pomona deal, which has national project status, with Devolution Funds.
Harare City Council officials carried out due diligence on the project after being treated to more than 10 days’ stay at a luxurious hotel in the exquisite City of Legnano, Italy, where they travelled to last year.
The councillors had a torrid time endorsing the deal yesterday as they spent more than three hours in caucus before a special council meeting which was scheduled to start at 11 am but began three hours later.
Chairing the meeting, Mayor Jacob Mafume <a href="https://news.pindula.co.zw/2022/07/11/minister-directs-hcc-to-immediately-rescind-resolutions-seeking-to-suspend-pomona-waste-project/">read a letter</a> from Local Government and Public Works Minister July Moyo <a href="https://news.pindula.co.zw/2022/07/11/minister-directs-hcc-to-immediately-rescind-resolutions-seeking-to-suspend-pomona-waste-project/">rescinding the city’s resolutions to suspend its contract</a> with Geogenix BV on the Pomona Waste to Energy project.

In response, Mafume said the article did not reflect what transpired. He said:

This is false. We read the letter as we are required by law to do. We stand by our resolutions not to pay this amount. We will not be part of this contrary to public morals contract.

The Pomona dumpsite waste-to-energy project is expected to generate up to 22MW of electricity and create at least 300 jobs. 
The US$344 million deal requires Harare to pay US$22 000 per day to Geogenix BV, an amount CC councillors are saying is too high for a council that has been failing to provide required public goods and services due to a lack of adequate resources.

We Stand By Our Resolutions Not To Pay Geogenix BV For Pomona Waste - Mayor Mafume

Harare Mayor <a href="https://www.pindula.co.zw/Jacob_Mafume">Jacob Mafume</a> has declared that he has once again bounced back at the Town House after his 45-day suspension lapsed Friday.
Local Government, Public Works and National Housing Minister, <a href="https://www.pindula.co.zw/July_Moyo">July Moyo</a>, suspended Mafume in December, for the 4th time,  accusing him of gross misconduct and incompetence.
Mafume’s lawyer Tonderai Bhatasara on Thursday wrote to acting town clerk Phakamile Moyo informing him that Mafume was resuming his duties after the expiry of the 45-day suspension. Bhatasara wrote:

We write to advise that our client’s suspension by the honourable minister through a letter dated December 17, 2021, has lapsed following the expiring of the statutory 45 days.

Harare Mayor Mafume Bounces Back At Town House

Harare Mayor Councillor Jacob Mafume has approached the High Court challenging his <a href="https://news.pindula.co.zw/2021/12/22/harare-mayor-jacob-mafume-suspended-for-the-4th-time/">fourth suspension.</a>
Mafume who is a member of the opposition MDC Alliance led by Nelson Chamisa is seeking to have his suspension set aside and declared null and void. 
He argues that the decision by Local Government Minister July Moyo is irrational and illogical.

Mafume was suspended late last year and that was the fourth time that Moyo suspended the law expert without convening a disciplinary hearing.
Mafume was suspended when he had just returned to work after the expiry of his third suspension.
The MDC Alliance secretary for local government stands accused of criminal abuse of office.
In the latest suspension dated 17 December 2021, Moyo accused Mafume of committing gross misconduct and willful violation of the law. Wrote Moyo:

I have reasonable grounds for suspecting that you councillor Jacob Mafume has committed acts of gross misconduct, gross incompetence and willful violation of the law as referenced in subsection (1)(b)(c) and (e) and hereby suspend you with immediate effect.
</blockquote>
Mafume described the latest suspension as childish adding that the Minister’s actions were affecting public service delivery. He added:

The Act allows the loser of the last election to supervise the winner, in this case, we beat ZANU PF in council elections but because they stole the presidential elections they are now supervising us using the Urban Councils Act.
This is so childish they are throwing toys and the baby out of the pram.

A few days before his latest suspension, Mafume wrote to the mayor, Stewart Mutizwa (MDC-T) and the town clerk Phakamile Moyo, accusing them of failing to respect the law on his return to the office.

Suspended Harare Mayor Jacob Mafume Challenges 4th Suspension

The Minister of Local Government and Public Works, July Moyo has appointed Stewart Musarurwa Mutizwa as the acting Mayor for Harare.
<a href="https://zero.pindula.co.zw/just-in-acting-mayor-for-harare-city-council-appointed/">Mutizwa has been Harare’s acting Mayor since December 2020</a> following the suspension of councillor Jacob Mafume who has a pending corruption case in which he is accused of parcelling council stands without following due process.
Mafume denies the allegations adding that the charges are trumped up and are meant to create a vacuum that will be filled by an individual favoured by the governing ZANU PF. In a letter to the local authority, Minister Moyo said:

The above matter refers. The post has been vacant since 14 September 2021 and the Council has failed and or neglected to appoint an Acting Mayor in terms of Section 104 of the Urban Councils Act (Chapter 29:15). In terms of Section 104 (2) of the Urban Councils Act (Chapter 29:15), I hereby appoint S. M. Mutizwa Ward 9 Greendale Councillor as the Acting Mayor for City of Harare with immediate effect.

There has been chaos at the local government authority amid reports that Council management was not sure on whether to report to the suspended Mayor Jacob Mafume or acting Mayor Stewart Musarurwa Mutizwa.
Both Mafume and Mutizwa claimed to be the mayor.

Local Govt Minister Appoints Mutizwa As Acting Mayor For Harare

City of Harare Officials and Councillors are reportedly part of a syndicate that is behind improper allocations of land belonging to the municipality, Zim Morning Post reports.
According to the publication,  Education, Housing and Community Services director Addmore Nhekairo is believed to be working with the said syndicate which Harare Mayor is said to be a part of to scam the metropolitan of its land.
These allegations were reportedly made by Preservation of Harare City Assets (PHCA) which alleged that:
<blockquote>This tag team is working with HCC Director of Housing, Nhekairo, to illicitly sell land. They are making a killing from the shenanigans,” read the social media post by HPCA. Dumba and Dzehonye are senior housing officers for the city and are operating from Remembrance Drive at the HCC offices in Mbare. The two are said to be inter-mediators of the housing director.
Nhekairo is untouchable in the City of Harare. He has enough money to enable him bribe investigators, including even those from the Zimbabwe Anti-Corruption Commission, Zimbabwe Republic Police, Central Intelligence Organisation, and court officials, including magistrates so that investigations on him are stifled.
He has even managed to capture Minister July Moyo and Harare Provincial Minister, Chidau, by offering them housing and commercial stands so that he covers up for his corrupt activities.
Nhekairo sells stands like he is selling cornflakes. He usually carries piles of offer letters, ready for sale in United States dollars and signing by prospective buyers.
Nhekairo has absolute and exclusive power to issue offer letters to whoever he desires, even before council approves the price, which all will be done in retrospect</blockquote>
When contacted for comment, Nhekairo reportedly said:
<blockquote>Land barons are swaying public opinion against myself and other top HCC officials because they are now being denied what they were used to getting</blockquote>
When another councillor Jacob Mafume was contacted for comment he also said the allegations were being made by land barons and there was no evidence of the allegations being levelled against him.

Harare Council Officials Fingered In Illegal Land Deals

The MDC has released a statement emphasising the need for electoral reforms the government has been urged to implement as they claim MDC polling agents were chased from all 4 polling stations in <a href="https://www.pindula.co.zw/Chimanimani">Chimanimani </a>by-election which Zanu PF won resoundingly.
A statement posted on Facebook by the country’s leading opposition party reads:
<blockquote>Mangwe/Chimanimani by-elections a call for Reform
The call for political and electoral reform is more significant now than before. The By-elections in Chimanimani and Mangwe both had irregularities, a skewed environment with absence of remedies for all the MDC’s calls for redress.
That Zanu PF declares some places no go areas is unlawful and unacceptable in a modern society. MDC polling agents were violently chased away by Zanu PF vigilantes at four polling stations in Chimanimani, exactly the same way it happened in the 2018 election.
A case we raised even in our Presidential petition yet ignored by the Judges.
Once rewarded for that kind of bad behavior Zanu PF finds no reason not to resort to that dirty tactic. An enforceable and enforced code of conduct is non-negotiable otherwise the playing field will remain tilted and elections useless.
We make this point to ZEC and all citizens that failure to provide a path to credible elections as a means of redress may result in Zimbabweans rejecting the Electoral route and seeking unconstitutional means of redress.
Electoral reforms are beneficial to everyone not just the MDC.
Both elections in Chimanimani and Mangwe were also abused with abuse of State Institutions for Zanu PF partisan gain.Food distribution was selective with aid only availed to those perceived to be supporters of Zanu PF, excluding the rest.
The MDC however expresses its gratitude to hundreds of Zimbabweans in the two wards who resisted intimidation and exclusion in defence of their belief in democracy.

Harare councillors have bemoaned the number of car sales that have invaded open spaces in the Sunshine City. This came to light during a full council monthly meeting when Jacob Mafume said they were now an eyesore as they have invaded most open spaces in Harare.
Mafume said:
<blockquote>It does not make sense anymore how at every street corner in Harare there is a car sale. It seems they have taken over all the land. What is of even more concern is that most of them end up being dumping grounds for car breakers</blockquote>
The City’s Director of Works echoed Mafume’s sentiments and said they were working on it by asking dealers to destroy or remove old cars from their car sales.

Harare West MP and MDC member Joanna Mamombe has been released on bail. She was remanded to June 25. The MDC party has said that Mamombwe was arrested on Tuesday evening charged with Electoral Act violations.
Speaking to ZimLive, MDC spokesman Jacob Mafume said:
<blockquote>She is accused of providing a false address to the Zimbabwe Electoral Commission before elections last July.</blockquote>
This year alone, Mamombe has been arrested twice. The MDC’s youngest MP at age 26 is currently on bail on treason charges emanating from violent protests against fuel price increases decreed by President Emmerson Mnangagwa earlier this year. Prosecutors say she planned to overthrow the government.

MDC MP Joanna Mamombe Released On Bail

Dr. Takavafira Zhou, the MDC Midlands provincial spokesperson has indicated that MDC deputy president Welshman Ncube donated 10 heifers to feed delegates at the MDC congress which starts today in Gweru. Ncube is a successful farmer and has a thriving cattle ranching venture.
Zhou also revealed that there are some other top officials who donated tpowards trhe event. The PTUZ president said:
<blockquote>That the Midlands province is fully geared to successfully host the historic congress is a fact as evidenced by various committees that have largely worked hard in pursuit of their set objectives and tasks. MDC national leadership has been lining donations with Professor Welshman Ncube offering 10 beasts.</blockquote>
Zhou indicated that former finance minister, Tendai Biti had also donated truckloads of mealie-meal that will almost cover the needs for the congress. The MDC women’s assembly chairperson Lynette Karenyi-Kore is said to have donated three beasts towards the event.
The party spokesperson Jacob Mafume revealed last week that the party had no suiffcient resources to make the event a success. This, as he said, was being exacerbated by the soaring inflation. Consequently, the party would rely on its members to fund the congress earlier budgeted for close to $2 million.

The MDC led by Nelson Chamisa has said that the political dialogue led by President Emmerson Mnangagwa is a waste of both labor and state resources.

President Mnangagwa invited all political parties which participated in the presidential elections in 2018 to a national dialogue. The dialogue was expected to suggest ways of addressing both the economic and political crises.
The MDC led by Chamisa boycotted the dialogue after the party and ZANU PF failed to find each other on the issue of Mnangagwa’s legitimacy.

The Movement for Democratic Change party led by Nelson Chamisa has issued a statement condemning the  attacks on Chief Ndiweni by government and ZANU PF members.
Jacob Mafume, the Party Spokesperson said:
<blockquote>The military State and the cult has  displayed that by all accounts the Chief was right. Matemadanda’s press conference, Nick Mangwana and Energy Mutodi were all inciting and unacceptable.</blockquote>
The advocate has also said that it is not surprising that the attacks came a day after ZANU PF officials had threatened the chief. He said:

Within a day of their reckless utterances the Chief was attacked by a Zanu PF mob in Bulawayo who attempted to take his vehicle. It is clear. Those vehicles given to Chiefs were meant to convert them into a captured community. This too is unacceptable. Not to mention that Zanu PF was all in defence of Chief Charumbira when he was found on the wrong by the courts for partisan behavior.</blockquote>
The spokesperson has argued that Chief Ndiweni was innocent as he was only rebuking violations of human rights. He further suggested that ZANU PF officials were the ones who needed to be held accountable for their threats and attacks on the chief.

MDC Denounces ZANU PF Attacks On Chief Ndiweni

Vimbai Tsvangirai Java, daughter of the former Prime Minister, Morgan Tsvangirai has been involved in an accident near Kwekwe.
The development has since been confirmed by MDC spokesperson Jacob Mafume who revealed that she has been taken to a local hospital. In an interview with The Herald on Tuesday morning, Mafume said:
<blockquote>She and the other two were coming from Bulawayo when the tragedy struck. Two of the passengers who are MDC members died on spot. She was left with injuries and is battling for her life.
As a party we pray for her speedy recovery. We want to send our deepest condolences to the bereaved families.
At this moment we cannot give out names of the deceased because we are not yet sure if their next of kin have been informed.
However we are devastated and full of grief by their passing away, they were pillars of the party.</blockquote>

Following the recent High Court ruling that nullified Chamisa’s presidency in the MDC, the NewsDay conducted an interview with Jacob Mafume, the MDC spokesperson.  He indicated that the party was proceeding with plans to conduct the Congress. He also said that the selection of party leaders was a preserve of party members. Below are excerpts of the interview between Blessed Mhlanga (ND) and Jacob Mafume (JM).
<blockquote>ND: The MDC has indicated that it is going ahead with its congress despite a High Court judgment which has ordered an extraordinary congress instead, what are your thoughts?
JM: Well, first of all, we are pushing ahead with Congress. The party is still there, it is still intact. The leadership is still intact, the judgment is one of those things that comes out of the courts, but we have legal options from our lawyers that indicate how we can proceed.

So, we cannot stop a process that had begun, a process that had over 500 000 people, a process that had 1 958 wards, 210 constituencies or districts and 13 provincial congresses. That process has to continue and reach its logical conclusion. What we do is, we look at the situation, if it needs to be appealed, we will do so depending on the advice from our lawyers.
We will appeal so that we proceed or if it does not affect the activities of the party, we will proceed with the activities of the party and we will not appeal. Currently, there is no order that has nullified our congress, there is no order that had nullified the processes that we have done up to this point. There is no order that has indicated that the party had to derail any of its projects in as far as we can interpret the law. Remember, political leadership of a party cannot be determined by anybody else except its members.
It cannot be determined by the courts, it cannot be determined by anyone else who is outside the ambit of the membership. The world over, and time and time again, this is a stated legal principle which has been stated even here in Zimbabwe by Constitutional Court (ConCourt) that it is the preserve of the members to select its leadership and that is what the party is doing.
ND: When you say the ConCourt, what is the specific case.
JM: There is a case of Bhasikiti and others versus Zanu PF and Robert Mugabe, there is the Madzimure case versus MDC. There are a number of judgments this court has issued and their clear stated position is that … if you are unhappy with a particular party, being a voluntary member, you get out and you form your own.

ND: Don’t you risk the tag of being a rogue political party that doesn’t respect the rule of law?
JM: The rule of law is that the members of a political party choose its own leaders.
ND: I mean you are continuing with congress when the rule of law says go for an extraordinary congress?
JM: Well, there is a congress, an extraordinary congress or a congress can be combined in one and in any event, the court has not said we should not hold our own congress. It is clear that a congress has to be held every five years otherwise we fall foul of the constitution. An extraordinary congress simply meets to deal with one agenda. It does not cancel out a congress. Even if the party holds an extraordinary congress every five years, it has to hold its congress and this congress has to be held in terms of the processes that have begun.
Remember a congress when it is held, it validates any decision that has been made by the party. Congress can do anything, it is the ultimate authority and it can change names. It can change and vary a lot of things in terms of its constitution. It can condone any irregularity that was made because it is the ultimate authority of the party.
ND: In the statement you issued, you alleged Zanu PF had a hand in this, do you have any evidence or you are just casting aspersions.
JM: What we referred to were the machinations of Zanu PF to deal with MDC. The evidence of the machinations of Zanu PF are all too clear: The tweets by (Information deputy minister) Energy Mutodi, the statements by various leaders of Zanu PF that are determined to deal with the leadership of the MDC, (Victor) Matemadanda saying they would prefer a particular leader. Douglas Mahiya has said they would prefer a leadership that is other than our president Nelson Chamisa, you have heard them time and time again trying to change the leadership of the MDC right up to the point that they even proposed that they needed to change the Constitution so that the presidency of the country can only be contested by a person who is 52 years old and above. They have said the opposition must develop a character that they (as Zanu PF) have defined; they have clearly made their preferences known … and they have indicated that they don’t want Chamisa to be the MDC president. So, those are the machinations we referred to and the machinations come in all forms and disguises because you are having an opponent trying to choose the coach of a particular team.
ND: There is some vile that is coming out of the party towards Douglas Mwonzora, your secretary-general, on allegations that he had a hand in this judgment?
JM: We have not seen that evidence as a party. We know that the system always wants to work with people inside. It is very important for leaders to distance themselves from certain invitations, certain statements to be unequivocally on where they stand in defence of the party. Sometimes, when leaders prevaricate and are not able to answer or are lily-mouthed in their responses to certain invitations and aspirations, it leads to conclusions being drawn. We have not accused anyone to this point and once we get the evidence, yes, the party has the capacity to deal with such individuals, if any.
ND: Mwonzora is quoted elsewhere saying he gave advice to the party and its leaders on how to avert this crisis, what was the advice.
JM: Well, I am not privy to that advice, he is the party and its leadership ostensibly. How does a person advice himself? You cannot separate him from the party. If he did say that, then that is an awkward phrasing of events. It is like me saying I have advised the party, I am the party, the decisions that come out of internal debates bind the entire leadership. It is such utterances that then invite different meanings from people who are malicious. The party is the collective of its leadership and once they have taken action they do so in their entirety.
ND: There is a statement already out there which says Thokozani Khupe wants to come to Harvest House, is that possible?
JM: (laughs) We say that people can hallucinate. They can daydream or they can conjure phantoms. As far as we know, she has her own party, she held her own congress, fielded her own candidates; she has a motley crew of leadership, one of which they have just recently fired, Linda Masarira and, therefore, it is an entirely different set-up. The issue we have with her is here, she continued to use the MDC-T name, continued use of the party symbols, continued use of paraphernalia that is associated with the MDC and our late icon (Morgan Tsvangirai) and that matter is pending before the courts and it will be heard in the fullness of time. We will defend the interests of the party and we will make sure that party symbols and everything else that the party needs to use is not abused in any particular manner. It would be foolhardy for them to extend this joke beyond where they have taken it by trying to physically impose themselves on the party membership to try and impose themselves on party institutions and party activities. That would be taking a bad joke too far.
ND: Can you please clarify if it is possible for one to impose themselves on members or it is now a war for party assets.
JM: It appears it is now a matter of looting; it is another different matter and will be addressed at the right time. The issue of her coming to the MDC to lead it is not even part of the judgment, so we would not understand where she is getting it. The judgment as it stands, says she was supposed to have been interim leader and was supposed to have called for an extraordinary congress when our founding leader passed on. That time has already lapsed and she has already formed her own party. If the judgment wanted her to call the extraordinary congress, it would have been explicit that Khupe shall call for it. The judgment left the party without a president, it did not install one, and in that case, reading that judgment, it is clear that whoever is in the line of succession in this case, the party chairman should call the extraordinary congress.
ND: There have been reports that the party is in sixes and sevens following this ruling, is it correct?
JM: No, that is incorrect. The membership of the party, the heart and soul of the party is with Nelson Chamisa. We saw that with the 2,6 million people who voted, we saw that from people who walk with us in the streets, we see it everywhere, the heart and soul of the party is not legislated. No amount of writings, kidnappings and killings will take the heart and soul of the party. Where Nelson Chamisa is, is where the party will be.
ND: You are a party with lots of lawyers, who appear before the courts every day for a living, yet you appear not to respect the courts, do you turn to something else when you are in politics?
JM: No! No! Every judgment of the court can be criticised, the Chief Justice Luke Malaba has indicated that any judgment they make can be criticised. We can fundamentally disagree with a judgment; it does not mean you have disrespected anyone. What we say in terms of the law jargon is that we respectfully and fundamentally differ with a judgment of a particular court, which is not a sign of disrespect, it is a sign of democracy, it is a sign of the rule of law and it does not go on one side.
ND: Are you democrats?
JM: Yes, we are democrats. That is why we are saying the leaders of the party are chosen by members, democracy is the ability to say how do you chose.
ND: But we have heard the people in MDC complaining about the use of violence, intimidation and disrespect of your own constitution as indicated in this ruling. Does that impair your record as democrats?
JM: Over 500 000 of our members took part in branch elections and no serious injuries were reported, no death was reported; that was a display of democracy. 
ND: When you say there were no injuries, but people were taken to hospital in Chitungwiza, what does that mean?
JM: That was one person not people.
ND: Is that one not too many?
JM: Well, in the grand scale of things, one had to look at the multitude of elections that occurred and that there is only one reported case that had been swiftly investigated and corrective measures taken.</blockquote>

FULL TEXT: Mafume Reveals Party Position After High Court Ruling

The Zimbabwe Congress of Trade Unions (ZCTU) told the Daily News that threats by government will not stop workers from exercising their democratic and constitutional rights.
ZCTU Secretary General, Japhet Moyo, said that the government by introducing austerity measures worsened the plight of the citizenry. Moyo said:
<blockquote>The austerity measures that have been put in place by government have not put bread on our tables, as workers, and thus we are going to take the necessary steps to seek redress.
The right to demonstrate is a constitutional right that will never be taken away by any person; governments come and go but the laws of the country stay. If they do not amend the Constitution we are going to organise more and more demonstrations to push them to dump neo-liberal policies.</blockquote>
Moyo and Peter Mutasa, ZCTU president, were among civic society leaders, political activists and opposition leaders who were arrested in January for organising a three day national shutdown that degenerated into chaos. It is believed that about 16 people died from army gunshots during the shutdown.
Moyo’s sentiments on demonstrations resonate with those of Jacob Mafume, the spokesperson for the MDC who argued that government permission to protest is not necessary as the constitution already provides for it.

Civic Society Groups Not Intimidated By Gvt Threats, Demos To Proceed

The Movement for Democratic Party has dismissed claims by the ruling party of a plot to unseat president Mnangagwa as mere excuses to crackdown on protestors.
Speaking during a press briefing, the MDC spokesperson, Jacob Mafume said:
<blockquote>We have said this before, that Zimbabwe is captured by very dangerous group of people, who are irrational, unreasonable, paranoid and will do anything to crush dissent in pursuit of their power retention agenda.
They reveal another attempt to victimise Zimbabweans, justify premeditated crackdown on actors in the democratic movement.</blockquote>
Mafume’s sentiments follow a stern warning by minister of Home Affairs, Cain Mathema on Monday to the opposition and some civil society organisations against protests which he said were meant to remove the incumbent government.

Mafume further said that this was ZANU PF’s archaic strategy which will not work this time as the MDC is fully aware of its rights and freedoms. He added that instead of intimidating citizens, the e government is supposed to be looking at ways to mitigate the crisis it created.
