<p>Joshua Nkomo Housing Co-operative has spoken on the Aspindale Park land dispute saying they are the rightful owners of the land that is also claimed by businessman Billy Rautenbach. Pindula News present the co-operative’s statement made through its lawyers, DNM Attorneys.</p>
<blockquote><p>PRESS STATEMENT IN RESPECT OF STAND 48 ASPINDALE PARK</p>
<p>We, DNM Attorneys, legal practitioners for Joshua M. Nkomo Housing Co-operative Society Limited, have been instructed by our client to issue this Statement to clarify the position regarding their occupation of Stand 48 Aspindale Park.</p>
<p>This statement is made with full consciousness of pending litigation in respect to some aspects of the dispute between our Client and Marimba Residential Properties Limited. To that end, we shall restrict ourselves to stating facts that are common cause and not presently subject to contestation in the matters that are pending in Court for purposes of correcting misinformation and disinformation that is being peddled by Marimba Residential Properties and its agents. These are the facts:-</p>
<p>1. Our client was allocated Stand 48 Aspindale Park by government in 2004 and authorized to develop the land for residential purposes. All the developments were done with the blessing and approval of the Department of Physical Planning in the Ministry of Local Government and the City of Harare.</p></blockquote>

To our knowledge, Marimba Residential Properties Limited does not have any Court Order authorizing it to take possession of land that is currently occupied by our client and its affiliates. Our clients have on several occasions requested Marimba Residential Properties to produce a Court order vindicating the land in question. We are not aware of any pending litigation wherein Marimba Residential Properties is seeking vindication of its rights in the land in question.</p>
<p>3. Our client and its affiliates developed residential stands and allocated to beneficiaries who proceeded to build and occupy houses since 2004.</p>
<p>4. Our client’s members and affiliates were in peaceful and undisturbed occupation of the land until 2018 when Marimba Residential Properties came on site, purporting to act on the alleged cancellation of the offer letter by an official in the Ministry of Local Government</p>
<p>5. The purported cancellation of the offer letter was challenged by our client in the High Court under Case No. HC3170/18 and the matter is still pending in the High Court.</p>
<p>6. Our client’s affiliates, Wadzanai Housing Co-operative and Leopold Takawira Housing Co-operative obtained Court orders setting aside the purported cancellation of the offer letter.</p>
<p>7. It is worth highlighting that the offer letter purportedly cancelled is in respect of the whole of Stand 48 Aspindale Park. It is indivisible.</p>
<p>8. The political posturing and statements that are being made by certain individuals regarding the ownership of Stand 48 Aspindale Park are not supported by any order of Court and are of no legal force or effect.</p>

Aspindale Park Land Dispute: Joshua Nkomo Housing Co-operative Speaks

<p>The government has blocked businessman Billy Rautenbach from evicting thousands of residents that had purchased land in Aspindale Park, Harare.</p>
<p>Rautenbach has been accusing them of “illegally settling on his land.” Norton legislator, T<a href="https://news.pindula.co.zw/2020/02/20/full-thread-proven-rautenbach-doesnt-have-title-deeds-for-land-he-wanted-to-evict-residents-from/">emba Mliswa who has been fighting Billy tooth and nail, however, claims the tycoon has no title deeds for the land.</a></p>
<p>Rautenbach’s company, Marimba Residential Properties, has been embroiled in the land dispute with five housing co-operatives Joshua Nkomo, Leopold Takawira, Wadzanai, Mydek and Dzapasi which took possession of the vast property described as Number 48 Aspindale Park Township of subdivision A of Aspindale Park of subdivision A of Lochinvar measuring over 100 hectares.</p>

<p>NewsDay Weekender reports that Rautenbach met Harare Metropolitan Affairs minister Oliver Chidawu on Monday to finalise the matter but the meeting ended in deadlock.</p>
<p>The minister allegedly told Rautenbach that it was politically suicidal for government to evict party supporters ahead of the 2023 harmonised elections. The minutes read:</p>
<blockquote><p><em>He mentioned that the land was inaccessible due to the houses that have been built by the co-operatives. He added that evicting the residents appeared inevitable, but he cited that the move appeared politically wrong as it would be viewed as the Zanu-PF government fighting Zanu-PF supporters in view of the forthcoming year 2003 harmonised plebiscite._</em></p></blockquote>
<p>Chidawu also indicated that he had exhausted options in his efforts to try to assist Rautenbach “and his metropolitan province had now gotten tired.”</p>
<p>He pleaded with Rautenbach to reduce the purchase price of the disputed land from US$85 per square metre to US$50 per square metre to allow the occupants to purchase the land.</p>
<p>Rautenbach reportedly turned down the proposal revealing that he was, instead, considering increasing the purchase price to US$125 per square metre.</p>
<p>He suggested an option to buy all constructed houses owned by those residents not forthcoming coming to his cause and get them relocated elsewhere.</p>
<p>Ringleaders like Benedict Nyenyeza aka Mapiravana and Shadreck Majoni (Joshua Mqabuko Co-operative treasurer) among others would be evicted in order to bring about obedience among the residents.</p>
<p>Rautenbach pledged to build a state-of-the-art Marimba Police Station and donate to the government a modernised school within the property, among other corporate social responsibilities if he is protected.</p>

<p>RE: DRILLING OF BOREHOLES IN ASPINDALE PARK</p>
<p>We are writing in response to the increase of individuals who are drilling boreholes in The Aspindale Park Development.</p>
<p>As it is, Aspindale Park stands do not qualify for the drilling of a borehole on individual stands as the stand sizes in Aspindale Park are 200m2, however, the minimum stand requirement for boreholes to be drilled is 500m2.</p>
<p>Furthermore, with regards to health, it is advised that the borehole be a minimum of 16meters away from the sewer line.</p>
<p>All boreholes that are dug need to be registered and approved by the local council. There have also been reports that one drilling rig damaged a road while they were drilling for water.</p>
<p>The cost of damage of this kind cannot be borne by the developer.</p>
<p>This circular will also be given to our security who from now on, will not allow drilling rigs into the development to drill on any stands going forward.</p>
