The Crisis in Zimbabwe Coalition (CiZC) has demanded the implementation of the recommendations made by the Motlanthe Commission which was established to investigate the 1 August 2018 killings.
Six civilians were shot dead by soldiers in central Harare during protests over delays in announcing presidential election results.
Thirty-five others were wounded in the shootings, forcing President Emmerson Mnangagwa to appoint a commission headed by former South African President Kgalema Motlanthe, to probe the killings.
The Motlanthe Commission, recommended, among other things, compensation to families of the deceased as well as prosecution of the killers.
In a letter dated October 18, 2022, addressed to the Minister of Justice, Legal and Parliamentary Affairs Ziyambi Ziyambi, CiZC chairperson Peter Mutasa said:

We address you in your capacity as the chairperson of the Inter-Ministerial Taskforce which was tasked with addressing issues arising from the findings of the Motlanthe Commission of Inquiry report.
We write to your esteemed office expressing our reservations over the failure of the Government of Zimbabwe to implement recommendations of the seven-member Motlanthe Commission of Inquiry following the events of August 1, 2018, that resulted in the death of six civilians at the hands of the army following protests over the late announcement of Presidential election results in Harare.
</blockquote>
Mutasa raised the issue of security sector reforms which he said should be addressed. He said:
<blockquote>
So far, the Government of Zimbabwe has not instituted security sector reforms to ensure that the military acts within the provisions of the Constitution of Zimbabwe and in conformity with human rights norms and standards.
The State is still to implement Section 210 of the Constitution of Zimbabwe that provides for an Independent Complaints Mechanism for receiving and investigating complaints from the members of the public about misconduct on the part of members of the security services, and for remedying any harm caused by such misconduct.
The Independent Complaints Mechanism is a crucial body in light of the increasing cases of human rights abuses linked to security.

CiZC Demands Implementation Of Motlanthe Commission Recommendations

The government reportedly gave ZW$1 000 only as “compensation” to families of the August 1, 2018 army shooting victims, NewsDay Weekender reported.
The amount, given to assist in the burial of those killed by army personnel during the post-election protests over the delayed announcement of presidential election results, translates to less than US$2.
Last week, the Crisis in Zimbabwe Coalition (CiCZ) hosted a roundtable discussion to measure progress on the implementation of the recommendations of the commission where families of the deceased victims expressed sadness over their neglect.
Alison Charles, who lost her brother Galvin Dean, could not hold back her tears saying her brother “was killed like a dog”. Alison said in-between tears:

My brother died like a dog. He was never a violent person. 
I have tried litigation to no avail. The government is untouchable and unapproachable. The only compensation we got from the government was the $1 000 deposited into our accounts to cover some funeral expenses.
It was not even enough at the time as we were assisted by loved ones and friends.
</blockquote>
Maxwell Tauro said he wanted justice to find closure over the killing of his son Charles Tauro. 
He said his “wounds are still fresh” adding that he “can’t even maintain my son’s grave because I have no money. He was our breadwinner.” Tauro added:

I am also demanding justice. We need to know the perpetrators.
</blockquote>
CiCZ chairperson Peter Mutasa said August 1, 2018, brings sad memories and expressed regret that there is no will on the part of the government to compensate the victims.
<h2>Some Context:</h2>
President Emmerson Mnangagwa narrowly beat opposition leader Nelson Chamisa in the disputed elections, with the case spilling into the Constitutional Court, where Chamisa lost the challenge.
During the post-election protests the army, using live ammunition, opened fire on fleeing protesters, killing:

i). Silvia Maphosa, 
ii). Galvin Dean Charles, 
iii). Ishmael Kumire, 
iv). Jealous Chakandira, 
v). Challenge Tauro and 
vi). Brian Zhuwawo.
</blockquote>
Thirty-five others were wounded in the shootings in Harare’s central business district.
The killings attracted the attention of the international community prompting Mnangagwa to appoint a commission of inquiry, headed by former South African President Kgalema Motlanthe, to investigate the killings.
Among a raft of recommendations, the commission said families of the deceased should be compensated and that perpetrators be held accountable.
Opposition leader Linda Masarira, who testified before the Motlanthe commission, donated five bags of cement to Tauro for his son’s grave.
She said there is no political will to compensate the victims adding that there should be a special fund to compensate the families.

August 1, 2018 Shootings: "The Only Compensation We Got Was ZW$1 000" - Family Of Victim

The United States (U.S.) Embassy in Harare has asked when Zimbabwe will implement the Motlanthe Commission recommendations which included bringing to book security forces who killed civilians in Harare in 2018.
The Kgalema Motlanthe-headed Commission was instituted by President Emmerson Mnangagwa to investigate the August 1 shootings in which soldiers and police shot live ammunition at MDC protesters that had thronged into the streets over the July 31st elections.
The army killed six civilians with 35 others injured. 
Protesters argued that the Zimbabwe Electoral Commission (ZEC) in connivance with the ruling ZANU PF were manipulating the presidential election results in favour of the ruling party and President Mnangagwa.

The U.S. Embassy in Harare said this Monday:

Today, we remember those Zimbabweans who lost their lives exercising their right to protest. How long must the people wait for full implementation of the #MotlantheCommission recommendations?
Today marks four years since security forces killed civilians for exercising their constitutional right to protest. When will Zimbabwe implement #MotlantheCommission recommendations and hold those responsible to account? #ZimLivesMatter
</blockquote>
<h2>The Commission made several recommendations including some below:</h2>
<blockquote>
1). Payment through a special Committee to be set up by the Government, of compensation for losses and damages caused including, in particular, support and school fees for the children of the deceased;
2). Promotion of political tolerance, and responsible and accountable leadership and citizenry;
3). Electoral reforms including the development of Information Communication Technology (ICT), to among other things enhance the transparent and expeditious announcement of election results;
4). The enforcement of law and order in order to ensure that the events of the 1. of August 2018 are not repeated;
5). Accountability in respect of the alleged perpetrators; and f. Nation-building and reconciliation including an initiative for multi-party dialogue and cooperation.

Meanwhile, the government claims that it fully complied with the recommendations of the Motlanthe Commission of inquiry.
The Crisis in Zimbabwe Coalition (CiZC), however, maintains that the Motlanthe Commission was set up with an interest to exonerate President Mnangagwa, ZANU PF and the Zimbabwe National Army from the killings of civilians who were demonstrating against electoral fraud.

Today Marks 4 Years Since Security Forces Killed Civilians For Protesting In Harare - US Embassy

A Sudanese court has sentenced to death a paramilitary officer charged with killing a protestor during a deadly breakup of a protest camp in the capital, Khartoum, in 2019.
Youssef Mohieldin al-Fiky, a major with the paramilitary Rapid Support Forces, was on Monday found guilty of ramming a protester with his car as security forces were dispersing a sit-in outside the military headquarters.
The protester, Hanafy Abdel-Shakour (22), was one of over 120 people killed during the brutal crackdown on demonstrators in Khartoum and elsewhere in Sudan that June.
The incident occurred two months after the military ousted then-President Omar al-Bashir amid a public uprising against his nearly three-decade autocratic rule.
According to the state-run SUNA news agency, the trial had started more than a year later, in July 2020, in Khartoum’s Judicial and Legal Science Institute.
Judges held 26 hearings before their ruling on Monday. The ruling can be appealed before a higher court.
Meanwhile, on 1 August 2018, members of Zimbabwe’s elite military unit, the Presidential Guard shot dead six people during election-related protests in central Harare.
The Motlanthe Commission, which was established to investigate the killings, recommended that those found guilty should be prosecuted.
However, almost three years later, no one has been made to account for the cold-blooded murders of unarmed civilians.

Sudan Court Sentences Soldier To death For Killing Protester

The Zimbabwe Human Rights NGO Forum has reported that Defence and War Veterans Minister Oppah Muchinguri <a href="https://news.pindula.co.zw/2021/01/16/govt-throws-oppah-muchinguri-under-the-bus/">– Kashiri</a> was on 11 March 2021 ordered to pay legal costs for the 1 August 2018 shooting victims. We present the statement by Zimbabwe Human Rights NGO Forum below.
<blockquote>Defence and War Veterans Minister Oppah Muchinguri -Kashiri was on 11 March 2021 ordered to pay wasted costs for the lawyers representing some of the 1 August 2018 shooting victims. Harare High Court, Justice David Mangota, issued the order in three matters involving Dzikamai Chivhanga, Fabion Majuru and Andy Manyeruke.
The three victims are lucky to be alive after they were shot in Harare’s CBD when soldiers opened fire on members of the public as they attempted to disperse protesters who were demonstrating against a delay in releasing of election results. The trio is seeking damages for shock, pain and suffering caused by the unlawful actions of the soldiers.
Through her lawyer, Mrs Gloria Dzitiro of Mutumbwa Mugabe and Partner Legal Practitioners, the Defence Minister had requested that the three matters which they had erroneously set down be removed from the court roll. Advocate Wilbert Mandinde who appeared with Mr Darlington Marange from the Zimbabwe Human Rights NGO Forum argued that the error in prematurely setting the matters down deserved to be censured with an order of costs. Justice Mangota agreed and ordered the Minister to pay the wasted costs. The matter will be re-enrolled on the court roll once all pleadings are filed.
The government has claimed that it has fully complied with the <a href="https://www.pindula.co.zw/The_Motlanthe_Commission">Motlanthe Commission</a> recommendations. However, one of the three, Manyeruke, has since taken President Mnangagwa to court seeking an order that the President fully complies with the recommendations as has been claimed by Justice, Legal and Parliamentary Affairs Permanent Secretary Virginia Mabhiza.

Muchinguri Ordered To Pay Legal Costs For August 1 Shooting Victims

<blockquote>Today marks 2 years since 6 people lost their lives at the hands of the military in Zimbabwe. Two years on, there is still no justice for the innocent civilians.
The Zimbabwe Human Rights NGO Forum (the Forum) remains concerned with the delayed justice for the victims bearing in mind that “justice delayed is justice denied.”
Following relatively peaceful 30 July 2018 harmonised elections, protests broke out in the Harare central business district on 1 August 2018, with protesters demanding the release of the results of the presidential elections.
In response, the media documented security forces indiscriminately shooting and assaulting civilians, including those who were not taking part in the protests.
Some were shot at the back, as they were escaping the scenes. As a result of the shootings, six (6) people died whilst over sixty (60) more people were brutally assaulted.
President Emmerson Mnangagwa appointed former South African President Kgalema Motlanthe to lead a Commission of Inquiry into the 2018 Post-Election Violence whose report was released on 18 December 2018.
Some of the recommendations made by the commission are as follows;
<ul>
<li>The payment of compensation for all victims of the violence and dependents of the deceased. Where the deceased had young children, the Commission recommended that they be urgently assisted with school fees and their general welfare.</li>
<li>The government should put in place a special committee to assess and determine the quantum of damages and compensation to be awarded to victims on a case by case basis and their general welfare</li>
<li>The government should set up a fund to assist those directly affected.</li>
<li>Police to urgently complete their investigation to enable the prosecution of those persons responsible for alleged crimes committed on the 1st of August 2018.</li>
</ul>
The Forum which represents some of the victims and relatives of the deceased persons remains extremely concerned that two years on, nothing of substance has been done to operationalise the Commission’s recommendations.
On 28 June 2020, the Justice, Legal and Parliamentary Affairs Permanent Secretary Virginia Mabhiza issued a statement in which she alleged that government had fully complied with recommendations made by the Motlanthe Commission.
She also stated that some of the victims’ families had not approached the Department of Social Welfare for assistance.
This is all surprising as the recommendations of the Motlanthe Commission never alluded to the need for the victims’ family members to approach the Department of Social Welfare, and no public or direct communication to the victims was ever made for them to approach the Department of Social Welfare.
The Forum has also noted with concern the unrepentant nature of the State in the protection of human rights.
In January 2019, the State abrogated the recommendations from the Commission of Inquiry and unleashed the military into the streets once again.
At that point, seventeen (17) people lost their lives. As we remember fellow citizens who lost their lives on 1 August 2018, the State has also unleashed the security forces onto the streets of Zimbabwe leading to the death of Paul Munakopa who was shot in Bulawayo and the assault and torture of many more.
Apart from the compensation of victims, there is no evidence of security sector reforms in the country as recommended by the report of the Commission of Inquiry.
It is disturbing to also note that there is no record in the public domain pointing to any disciplinary action being taken against members of the armed forces who perpetrated the heinous crimes.
Rather, Brigadier-General Anselem Sanyatwe the tactical commander of the force deployed on 1 August 2018 was promoted and subsequently appointed Zimbabwe’s Ambassador to Tanzania.
The 1 August 2018 events remain a fresh wound in Zimbabwe. As a result, the Forum calls on:
The government to-
<ul>
<li>fully implement the recommendations of the Commission of Inquiry;</li>
<li>learn from the past and desist from the unnecessary deployment of the military to 
conduct civilian policing duties;</li>
<li>pursue its constitutional mandate in relation to allegations of continuous human rights violations at the hands of the State apparatus;</li>
<li>prosecute military personnel who killed unarmed civilians to be held accountable 
for their actions; and</li>
<li>reach out to the families affected and provide compensation.</li>
</ul>
The National Peace and Reconciliation Commission (NPRC) to:
<ul>
<li>to urgently work towards reconciliation and compensation to the victims of 1 August 2018 shootings; and</li>
<li>work towards prevention on recurrence.</li>

Former War veterans minister Tshinga Dube said the August 1 shootings drove Zimbabwe’s economy years backwards.
Dube said the shooting which claimed 6 lives affected Zimbabwe’s chance of having sanctions removed. Said Dube:
<blockquote>The excitement we had when the new dispensation came to play, we thought many things will then come right but a lot of things have happened that were not foreseeable.  When we were so hopeful that things would go right and we were very hopeful that sanctions were going to be terminated some very unfortunate things happened which affected us as well as our economy that is the August 1 shooting.
