Five University of Zimbabwe (UZ) students who were last week arrested for <a href="https://zero.pindula.co.zw/watch-uz-students-protest-demanding-fees-must-fall/">protesting over hiked tuition fees</a> said they suffered degrading and dehumanising treatment at a police station where they were detained.
They told a local magistrate that they have been in cells which had no proper flushing systems, in the male holding cells it was actually blocked and waste was overflowing.
The five students- Tinovimba Musengi, Hazel Gwande, Purpose Mangana, Tanyaradzwa Nzvimbo and Charles Moyo – were, however, freed Friday after spending two nights in custody.
They appeared before Harare Magistrate, Munashe Chibanda and were remanded out of custody for September 26.
Through their attorney, Tinashe Chinopfukutwa of the Zimbabwe Human Rights lawyers, the students said:
<blockquote>
There was no demarcation of the toilets and no privacy.
</blockquote>
The students were charged with disorderly conduct in a public place after they allegedly sang at the UZ main campus disturbing usual business around midday near a venue that was being used for a conference.
They were later dispersed and arrested at different locations on campus.
Moyo was reportedly arrested whilst making calls threatening other students, who were attending lectures.
Mangana, Gwande and Musengi allegedly disturbed lectures at the Faculty of Engineering at the time of their arrest, whilst Nzvimbo was part of a group of students protesting at the Computer Science department.
Meanwhile, UZ has since <a href="https://zero.pindula.co.zw/the-university-of-zimbabwe-announces-new-fee-structures-aug-dec-2022-semester/">announced new fee structures</a> for the August – December 2022 Semester.

Fees Protest: Arrested UZ Students Say They Suffered Degrading Treatment At Police Station

Police are preparing criminal charges against prominent rights advocate <a href="https://www.pindula.co.zw/Siphosami_Malunga">Siphosami Malunga</a> and his two business partners in an escalation of a fight over Esidakeni Farm in Matabeleland North.
Police on Wednesday arrested Charles Moyo, one of the directors of Kershelmer Farms (Private) Limited, on allegations of occupying state land without authority.
His lawyer Josphat Tshuma told <a href="https://www.zimlive.com/2022/08/malunga-and-esidakeni-partners-face-arrest-as-farm-battle-turns-nasty/">ZimLive</a> that Moyo was released and ordered to return to the police station in Bulawayo on Sunday together with Zephaniah Dhlamini, the third director who was reported to be in Harare.
Tshuma said police planned to arrest all three men who purchased Esidakeni Estate, a former dairy farm, in 2017 after buying shares in Kershelmer Farms. Tshuma told <a href="https://www.zimlive.com/2022/08/malunga-and-esidakeni-partners-face-arrest-as-farm-battle-turns-nasty/">ZimLive</a>:

What we are witnessing here is an abuse of process and an abuse of power.
</blockquote>
The lawyer said Moyo’s arrest followed a police complaint filed by Lovemore Jiyane and Legina Muchimba, who said they are some of the beneficiaries offered land on the farm by the lands ministry.
Malunga, the director of programmes at the Open Society Foundations in Africa, is currently working out of Senegal. 
Tshuma said when the 554-hectare property in Nyamandlovu was gazetted in 2020, Malunga, Dhlamini and Moyo instituted action against the lands minister and other interested parties contending that the gazetting was not done in terms of the Land Reform Programme.
The matter is pending at the High Court which recently ordered the ejection of ZANU PF secretary for administration <a href="https://www.pindula.co.zw/Obert_Mpofu">Obert Mpofu</a> and Dumisani Madzivayathi, a university lecturer, after they invaded the farm saying they had been allocated the land by the government.
Mpofu, who has other farms, says he was offered 145 hectares of Esidakeni together with his wife, Sikhanyisiwe. 
Malunga believes the government targeted the farm as punishment for his human rights advocacy work in his former role as executive director of the Open Society Initiative for Southern Africa (OSISA).

Esidakeni Farm Wrangle: Police Preparing Criminal Charges Against Owners - Report

Holders of Kershelmar Farms (Pvt) Limited, Malunga (OSISA Director), businessman Charles Moyo and Zephaniah Dhlamini, a scientist working at the National University of Science and Technology (NUST), have written to Lands and Agriculture minister Anxious Masuka to assert their ownership of the land.
The trio writes when the State has moved to compulsorily acquire Kerslmar Farm known as Esidakeni Farm in Hilda’s Kraal, Nyamandlovu, under section 72(2) of the country’s constitution.

In their letter to the lands minister, the Osisa director and colleagues accused political elites in Matabeleland including Richard Moyo, Obert Mpofu, and Gatsha Mazithulela of orchestrating the seizure. In a letter dated 14 June, the trio said:
<blockquote>_We came to know about the farm as its sale by public action was gazetted in 2015. At the public auction the farm was not sold as the highest bid fell short of the creditor’s demands. It was then sold by private treaty, administered by Bulawayo Real Estate, we dully placed our bid that was acceptable to the auctioneers. Before we signed the sale agreement with the Deputy Sheriff, we did due diligence and discovered that the farm was not owned by the defendant late Eddias Warambwa._
_As such the farm could not be sold for the debts of the defendant. Having invested a lot of time and energy in trying to purchase the farm we searched for and identified the owner. We then approached the lands office in Bulawayo and the then Minister of State for Matabeleland North, Hon. Cain Mathema for guidance. We were told the farm was indeed private property it had never been gazetted nor designated for acquisition._</blockquote>
They further argue that since October 2020, they have faced severe harassment from officials at the lands office.
Malunga and colleagues argue that the seizure of the farm is in violation of the country’s policies which state that the government will not take land from black nationals.

OSISA Director Malunga, Colleagues Write To Lands Minister

With the Education Amendment Bill at the Second Reading stage in the National Assembly, there are still sharp divisions over a part of the proposed law.
The controversy is centred around the clause which bans the expulsion of girls who fall pregnant while in school.
On Wednesday last week in the National Assembly, Primary and Secondary Education Minister Professor Paul Mavima defended the clause.
However, Pelandaba-Mpopoma legislator, Mr Charles Moyo (MDC Alliance) disagreed. He said:
<blockquote>I have a problem with the second part, that is on the basis of pregnancy. Why Madam Speaker? Our schools must not be turned into maternity homes.
There is no need for those who would have failed on their choice to look for a boyfriend to proceed with schoolwork. A rotten apple spoils the barrel.
I want to say, it will not be good for other pupils as well. So, when a person is impregnated, she ceases to be a pupil or a student, she becomes a mother.
Mind you Madam Speaker, there are complications associated with a person on her first pregnancy. The issues like BP, stress, untimely or early labour pains.
Surely, we must separate those who want to proceed with their schoolwork and those who have chosen to be mothers.
It must be a clear amendment to say, those who would have chosen to have boyfriends, I will reiterate, must be separated from those who want to proceed with their schoolwork because of the peer pressure.
After all, if you happen to have that pregnancy may be a Form 1 if you are not punished and proceeded with schoolwork, it means when you are now at Form 3 or Form 4 level, you again repeat the same mistake.
Surely, we must separate those who want to do their schoolwork properly without any disturbances, without being close to the bad behaviour that will be exhibited by those who would have been impregnated by other people.</blockquote>
