The Electoral Court is on Wednesday, 19 July set to hear a dozen applications filed by ZANU PF activists seeking to have CCC National Assembly candidates in Bulawayo disqualified from the 23 August elections.
<a href="https://www.zimlive.com/ccc-braces-for-electoral-court-showdown-over-bulawayo-candidates/">ZimLive</a> reported that the court ordered the 12 applications, filed simultaneously, to be consolidated due to similar facts.
The applicants, who only describe themselves as “registered voters”, are seeking to have CCC, other opposition parties, and independents barred from contesting.
They are arguing that the defendants filed their nomination papers after the regulated time of 4 PM on 21 June and should not be allowed to contest.
If the applications succeed, ZANU PF could win all 12 National Assembly seats in Bulawayo unopposed.
In the 2018 general elections, the MDC Alliance, which was the main opposition won 11 of the 12 seats.
ZANU PF’s Raj Modi won Bulawayo South after the MDC Alliance fielded double candidates and split its vote.
Meanwhile, CCC argues that all its candidates in Bulawayo filed their papers by 4 PM, but the Zimbabwe Electoral Commission (ZEC) asked the candidates to correct some signature anomalies on the forms.
The party argues that its candidates were ready to file the corrected forms by 4 PM, and were present at the Nomination Court, but ZEC was now assisting other candidates, the party argues.
The process continued into the wee hours of 22 June.
CCC has its own application filed by the 10 candidates for the Provincial Council who were disqualified.
The candidates argued in a court filing that their papers were delivered to ZEC before 4 PM, but the nomination papers appear to have suddenly disappeared while in the court’s custody.

Electoral Court To Hear Applications Seeking Disqualification Of CCC MP Candidates

The Electoral Court Division of the High Court in Harare will on Friday, 14 July hear an appeal by opposition United Zimbabwe Alliance (UZA) leader, Elisabeth Valerio, challenging the rejection of her nomination papers.
In a statement, UZA National Spokesperson Elvis Dzvene said the Nomination Court rejected Valerio’s nomination to run for the presidency despite submitting proof that she had paid the nomination fee in full. Said Dzvene:

The United Zimbabwe Alliance (UZA) wishes to inform the public, the media, and all interested stakeholders that our party President, Elisabeth Valerio, will be attending an appeal hearing in the Electoral Court Division of the High Court in Harare on Friday, July 14th at 10 AM.
The appeal is against the June 21st decision of the Nomination Court, which rejected President Valerio’s nomination for election to the office of the President. President Valerio provided bank-stamped proof of her request to initiate a ZWL transfer of funds to the Zimbabwe Electoral Commission (ZEC) bank account for the required nomination fees equivalent to US$20,000. Full payment was made to ZEC but her nomination papers were still refused.
UZA is challenging this decision as a violation of the constitutional rights of President Elisabeth Valerio and the party members who nominated her.
We are seeking an order directing ZEC to accept her nomination papers and allow her to contest in the August 23rd presidential election.

She said that appeal by Valerio is an important step for the advancement of democracy, transparency, and women’s rights in Zimbabwe. Dzvene said:

We are confident that the High Court will uphold the principles of justice and fairness that are essential for our political system and the participation of women in political leadership.
</blockquote>
Valerio and the leader of Labour, Economists and African Democrats (LEAD) Linda Masarira were the only women who expressed their intention to contest in the presidential elections and both failed in their bid to submit nomination papers.

Electoral Court To Hear Elisabeth Valerio Appeal On 14 July

At least 30 Parliamentary results have been challenged at the Electoral Court. Some of the applicants are seeking to have the results of the National Assembly set aside arguing that the winners who were declared by the Zimbabwe Electoral Commission were not duly elected.
Some of the cases include,
Chegutu West  – MDC Alliance’s Gift Konjana is challenging Zanu-PF Dexter Nduna’s victory. <a href="https://news.pindula.co.zw/2018/08/09/zec-faces-lawsuit-over-chegutu-west-results-refuses-to-reverse-results-despite-acknowledging-errors-in-counting/" rel="noopener" target="_blank">Zec admitted that there counting errors which prejudiced Konjana of victory.</a>
Goromonzi West – Energy Mutodi is being challenged in two separate cases by Taurai Clifford Nhamburo of MDC-T and Luke Tamborinyoka of MDC Alliance.
Mutare North –<a href="https://news.pindula.co.zw/2018/08/03/zec-is-failing-to-reconcile-the-figures-for-mutare-north-candidate-demands-rerun/" rel="noopener" target="_blank"> Agrippa Bopela Masiyakurima is challenging Zanu-PF’s Michael Madiro</a>.
Murehwa South – Former Zanu-PF politician Noah Mangondo is challenging Zanu-PF Mashonaland East chair Joel Biggie Matiza.
Zvimba South – Zifa boss and Zanu-PF politician Phillip Chiyangwa is being challenged by Nkosilathi Nyamadzawo.
Chipinge East – Former deputy minister <a href="https://news.pindula.co.zw/2018/08/23/former-minister-sues-zec-after-he-was-defeated-says-zec-refused-to-put-his-nickname/" rel="noopener" target="_blank">Win Mlambo is challenging Mateu Mlambo and has blamed Zec for not putting his nickname on the ballot paper.</a>

More Than 30 Parliamentary Election Results Being Challenged At The Electoral Court

Harare High Court judge Justice Esther Muremba has ordered Deputy Minister of Finance and Economic Planning, Terrence Mukupe and the ruling Zanu-PF party to stop disrupting rallies organised by the opposition MDC Alliance. Justice Muremba ordered Mukupe and Zanu-PF to take steps to prevent their agents and supporters from intimidating or engaging in acts of political violence against the MDC Alliance led by Nelson Chamisa.
The order was granted after 6 MDC Alliance supporters told the Electoral Court that ZANU PF supporters acting under the instructions of Mukupe randomly and mercilessly attacked MDC Alliance supporters and cars using stones. Two MDC Alliance supporters Clement Daudi and Prince Mutebuka were injured in one such attack while a vehicle belonging to Coster Kazingizi was damaged.
