A gold mining company in Mudzi has asked the Constitutional Court to overturn a recent Supreme Court ruling against it. The company claims the ruling was a violation of property rights and points to a number of issues with the handling of the case.
The case was brought by businessman Prosper Machekera, who was declared the owner of Radnor 58 in the recent judgement. The mining company, Milmath Security Private Limited, argues that the Supreme Court ruling violated its right to a fair hearing. Read court papers:

The basic of the application is that on March 10, 2023, the Supreme Court of Zimbabwe handed down an order which violates the applicant’s fundamental rights and freedoms namely, the right to property, the right to a fair hearing and the right to equal protection and benefit of the law.
The judgment upholds a High Court judgment which deprives the applicant of its property, namely gold claims, for no reason.
The High Court judgment also reviews the forfeiture of the first respondent’s base mineral claims, which took place in 2007 in the absence of an application for review and in violation of the right to a fair hearing.

Radnor 58 owns disputed gold claims in the Makaha area of Mudzi, Mashonaland East province. The case involves the provincial mining commissioner, Mines minister Winston Chitando, permanent secretary, and chief mining commissioner as respondents and has been ongoing for years.
Milmath Security Private Limited is arguing that the Supreme Court ignored the evidence and arguments presented by the applicant and based its decision on its own grounds of appeal. This violated the applicant’s right to a fair hearing. The High Court also granted relief to the respondent that was not mentioned in their papers, which violated the applicant’s fundamental rights, including the right to a fair hearing and equal protection under the law. By upholding this decision, the Supreme Court also violated the Constitution.
The company claimed that the judgment did not address the issue of mining coordinates for three mining blocks, which were awarded in the High Court and confirmed by the Supreme Court. However, these blocks are located three kilometres away from the disputed location, as defined by the undisputed coordinates on court records.
In his affidavit opposing the mining company’s application, Machekera claimed that the disputed gold claims belong to him, as previously ruled by the courts. He argued that he has been the holder of the mining rights since 2005 and that the applicant cannot make a valid claim to them. Madziwanzira, in his answering affidavit, maintained that the courts granted Machekera the gold claims that were forfeited.

Gold Miner Approaches Constitutional Court To Overturn Supreme Court Ruling

The <a href="https://www.pindula.co.zw/Mudzi">Mudzi</a> community of <a href="https://www.pindula.co.zw/Mutoko">Mutoko</a> has become the latest to benefit from the rural electrification programme after 10 institutions including schools, clinics, business centres and homesteads were connected to the national grid.
Speaking during the switching-on ceremony in Mudzi Rural Electricity Agency (REA) board member, Partridge Ndemera encouraged the community to use the electricity productively. ZBC News cites him as saying:

I urge you to use the electricity to your benefit and safeguard against vandalism of the infrastructure.
</blockquote>
The Deputy Minister of Energy and Power Development, Magna Mudyiwa said the government is working tirelessly to make sure there is enough power supply in the country. She said:

The government is working hard to improve power generation capacity at Hwange Power Station so there is an improved power generation.
</blockquote>
The government has set a target of providing power to all the rural areas in the country by 2030.
Villagers who spoke to ZBC News said they were delighted by the development saying it will give their children a chance to be on the same page with their counterparts from towns.
Some said women would be able to give birth even at night without challenges while others said the electrification initiative will allow them to start projects such as welding.

10 Institutions Electrified In Mudzi Under The Rural Electrification Programme

A barber, only identified as Jimmy from Masarakufa Village in Mudzi, is allegedly on the run after he raped and impregnated a 13-year-old girl after she failed to pay for a haircut.
The girl is now six months pregnant.
The victim’s 39-year-old mother resides at Tagarika Flats in Mbare.
She recently told <a href="https://www.hmetro.co.zw/barbaric-barber-rapes-impregnates-teenager/">H-Metro</a> that following the rape of her daughter, her neighbours are now accusing her of “selling” her daughter to men in exchange for money. She said:
<blockquote>
I have four children and this one is the third born.
The day she was raped, I left her at home alone and accompanied her father to collect rentals.
She visited a barber called Jimmy for a haircut.
On arrival, she discovered that she had lost money along the way, but the barber went ahead and cut her hair.
He later came to my daughter at night claiming he wanted to know if she had found the money.
He raped my daughter for the whole night at our house.
She only disclosed this after one of our neighbours detected signs of pregnancy.
I never saw any signs of pregnancy until her tummy grew and this has affected me so much.
People are calling me names when I walk with her.
I am afraid of leaving her alone now, as I fear that, maybe, something worse might happen to her.

The girl’s father, and his younger brother, were reportedly against lodging a police report to ‘‘protect’’ the family’s name.

Barber Rapes Girl (13) For Failing To Pay For A Haircut

A pregnant woman went into labour upon arrest on the same day she had stolen two sheep from a fellow villager in Mudzi.
Sarudzai Mukwaira, 37, gave birth to a baby boy the day she got arrested along with her accomplice niece Erina Joswa, 30 both under chief Nyamukohwo in Mudzi District.
The duo allegedly stole the sheep from Tombotiya family’s kraal and skinned them in the bush before taking the meat to their homestead.
The incident was confirmed by Mashonaland East Provincial spokesperson Inspector Tendai Mwanza. He said:
The two women are now in police custody assisting with investigations.
<blockquote>On Monday at around 2 am the two accused persons Sarudzai Mukwaira and Erina Joswa residing at Mukwaira village proceeded to Tombotiya’s place of residence.
Erina entered the pen and killed the sheep by strangling them whilst Sarudzai was checking if any person was coming.
They took off with sheep on their heads and went through the forest to avoid a trace of prints.
They took the stolen sheep to Sarudzai’s homestead and hid them in the wardrobe and at around 7 am, they them started skinning the animals.</blockquote>
Upon arrest by members of the neighbourhood watch committee, the women denied the charges but a search was conducted leading to the discovery of a dish containing two slaughtered sheep.
The suspects held pending a court appearance, Insp Mwanza added.
