The Zimbabwe Electoral Commission (ZEC) has issued strict guidelines for the upcoming elections. ZEC’s vice-chairman, Ambassador Rodney Kiwa, emphasised that all political campaigning must end by midnight on August 21, with legal consequences for any violations. August 22 is designated as a quiet day with no political campaigning allowed. Kiwa said:
<blockquote>
Any campaigning by any political party, candidates, or individuals should end on August 21 at midnight. August 22 should be a quiet day and no political campaigning is allowed. If any party campaigns they will be liable to the law, it’s in terms of the Electoral Act and they will be criminalised. Those who campaign will be bound to prosecution, as ZEC will see to that. Midnight on August 21 is the deadline.
</blockquote>
ZEC has also published a list of prohibited activities within a 300-meter radius of polling stations, including the ban on party regalia, slogans, political vehicles, leaflets, public performances, and the use of cameras or phones.
In a notice seen by Pindula News, the electoral body also said it is a punishable offence to refuse to leave a polling station when a Presiding Officer orders one to do so. Read the notice:

<h3>REFUSAL TO LEAVE A POLLING STATION </h3>
It is an offence to refuse or fail to leave a polling station when lawfully required to do so by the Presiding Officer. Offenders are liable to a fine not exceeding level four or to imprisonment for a period not exceeding three months or to both such fine and such imprisonment. (Electoral Act – Chapter 2;13, Section 90).

Regarding ballot printing, ZEC announced the following quantities produced for each election category:

<li>Presidential Election: 7,126,600 ballot papers</li>
<li>National Assembly Elections: 7,098,750 ballot papers</li>
<li>Council Elections: 6,861,650 ballot papers</li>
</ul>
ZEC’s chief elections officer, Mr Utloile Silaigwana, explained the reasons for the variation in the number of ballot papers printed for each election category. He stated that for the National Assembly election, the passing of an independent candidate in the Gutu West National Assembly constituency led to a postponement. In the local authority election, elections won’t be held in 91 wards due to unopposed candidates and the unfortunate demise of four candidates. These elections will be conducted at a later date.
ZEC has also published a list of the 12,374 polling stations distributed as follows:

ZEC Chairperson Justice Priscilla Chigumba confirmed that 6 623 511 people have been registered to vote in the elections. She also confirmed the following categories of participants in the elections:

<li>Presidential Candidates: 11</li>
<li>National Assembly Candidates: 518</li>
<li>Independent Candidates: 64</li>
<li>Local Authority Candidates (sponsored by political parties): 4,648</li>
<li>Independent Local Authority Candidates: 266</li>
</ul>
Regarding the election of two Senators to represent persons with disabilities, ZEC Chief Elections Officer, Mr Utoile Silaigwana, provided the following information:
<ul>
<li>The Electoral College, consisting of specified associations and institutions, will convene on August 26.</li>
<li>The election will be conducted in accordance with section 120(1)(d) of the Constitution.</li>
<li>The specified associations and institutions are listed in Statutory Instrument 133 of 2023.</li>
<li>The Electoral College will gather at the Rainbow Towers Hotel in Harare on Saturday, August 26, 2023, from 7 am to 7 pm to elect the Senators representing persons with disabilities.</li>
</ul>
Last month, Justice, Legal and Parliamentary Affairs Minister, Ziyambi Ziyambi, prescribed a list of 119 associations and institutions. These entities will nominate individuals who will compose the Electoral College responsible for filling the Senate seats for Senators elected to represent persons with disabilities. The list was formulated after consultations with Public Service, Labour and Social Welfare Minister, Professor Paul Mavima.

ZEC Sets Strict Election Guidelines, Including An August 21 Campaign Deadline

The Zimbabwe Electoral Commission (ZEC) has confirmed that police officers have started voting ahead of the 23 August 2023 elections.
A report by <a href="https://www.newsday.co.zw/local-news/article/200015384/tempers-flare-as-police-secretly-vote">NewsDay</a> on Wednesday quoted ZEC deputy chairperson Rodney Simukai Kiwa as saying they had only allowed police officers deployed outside their constituencies to participate in the postal ballot system. Said Kiwa:

Yes, they have been voting. We started sending out the postal ballots on Sunday and Monday.
</blockquote>
CCC spokesperson Fadzayi Mahere on Tuesday tweeted that police officers were voting in the absence of agents and independent observers.
However, Kiwa said postal voting was not subject to monitoring. He said:
<blockquote>
There is no way postal votes can be monitored. Postal votes are not subject to monitoring.
So the opposition or whoever might want to monitor, it’s not possible. How can one tell whether there are postal votes? The law is very clear on that.
How can you deploy observers on postal votes, because the postal ballots are dispatched in various places, so operationally, and physically, it’s not possible.

ZEC recently gazetted Statutory Instrument 140, which amended section 75(1)(d) of the Electoral Act to allow the chief elections officer to receive postal votes not later than three days before the voting day instead of 14 days.
Zimbabwe holds three elections (local authority, parliamentary and presidential) on 23 August 2023.

Postal Voting Not Subject To Monitoring, Says ZEC

The Zimbabwe Electoral Commission (ZEC) says it has been forced to delay the printing of ballot papers because of numerous pending court cases.
Addressing election observers in Harare early this week, ZEC deputy chairperson Rodney Simukai Kiwa said the court cases have put the elections management body under pressure to meet specified timelines to prepare for the 23 August 2023 elections. <a href="https://www.newsday.co.zw/2023-elections/article/200013935/poll-preps-face-major-hurdles">Kiwa said</a>:

Now on the issue of the ballot paper designing and printing, section 239(G) of the Constitution gives the commission the mandate to design, print and distribute ballot papers among other functions.
The commission has commenced the exercises of designing ballot papers for all contesting National Assembly and local authority wards as well as the presidential ballot.
The drawback, however, as you may appreciate, is the designing of the ballot papers for those constituencies where an appeal has been lodged against the rejection and acceptance of a candidate’s papers.
We have to live with that until the court process has been done and completed. There is nothing we can do, but it puts a lot of pressure on us in terms of meeting the timelines.
So bear that in mind. Don’t ask us why this has not been done. It is a legal process and ZEC is bound to respect the law. We hope that the legal challenge is concluded as soon as possible.

ZEC is a respondent in several court cases where political parties are querying the 21 June nomination process.
Presidential aspirants Linda Masarira and Elisabeth Valerio are not happy after their nomination papers were rejected for various reasons while Saviour Kasukuwere has approached the Supreme Court contesting the nullification of his candidature by the High Court.
CCC has filed an appeal at the Electoral Court against the nomination court’s decision to accept nomination papers for some candidates who reportedly forged signatures to submit their nomination forms under the opposition party.
ZANU PF has also challenged a decision by ZEC to accept nomination papers for opposition Bulawayo aspiring MPs after the 4 PM deadline on 21 June.

Pending Court Cases Delay Printing Of Ballot Papers - ZEC

The Zimbabwe Electoral Commission (ZEC) announced on Thursday that 11 candidates would contest the southern African country’s presidential election on August 23.
While 21 candidates submitted nomination papers on Wednesday, 10 were not accepted for various reasons, including failure to pay the US$20,000 fee or insufficient nominations. Candidates were required to have 10 nominations from each of Zimbabwe’s 10 provinces.
ZEC’s deputy chairman <a href="https://www.pindula.co.zw/Rodney_Kiwa/">Rodney Kiwa</a> confirmed that President Emmerson Mnangagwa, leader of Zanu PF, and his main rival Nelson Chamisa of the Citizens Coalition for Change (CCC) had their papers accepted. Other candidates on the ballot include Saviour Kasukuwere, Douglas Mwonzora, Lovemore Madhuku, Joseph Busha, Trust Chikohora, Blessing Kasiyamhuru, Wilbert Archbald Mubaiwa, Gwinyai Muzorewa, and Harry Peter Wilson.
The ZEC will release successful candidate lists for the National Assembly and local authority elections by June 30 to provide time for aggrieved candidates to launch court appeals.
Some presidential aspirants have resolved not to contest in this year’s election citing high nomination fees. <a href="https://www.pindula.co.zw/Tendai_Munyanduri/">Tendai Peter Munyanduri</a>, leader of the New Innovative and Modernisation Front Party (NIMFP), has said he will not contest for the presidency in the 2023 elections due to high nomination fees and pressure from his studies.

Zimbabwe's Presidential Election To Have 11 Candidates: ZEC

The Zimbabwe Electoral Commission (ZEC) says claims that it has deliberately removed the names of opposition members from the voters’ roll are “mischievous and preposterous”.
In an interview with <a href="https://www.herald.co.zw/zec-dismisses-oppositions-frivolous-claims/">The Herald</a> on Wednesday, ZEC vice chairperson Rodney Kiwa said that cannot happen as the electoral body is not affiliated with any political party. He said:
<blockquote>
The rationale for the voters’ roll inspection is to ensure every registrant is accurately captured on the roll and all corrections made.
To suggest that members of a particular political party are targeted for exclusion is not only mischievous and preposterous as we are fully independent of any political party influence and in fact, when registering people, we do not seek their political alignment, it would be illegal and unethical.
</blockquote>
Voters across the country including sitting members of Parliament from the opposition say their names are missing from the voters’ roll.
Some of the registered voters whose names are missing from the voters’ roll voted in the March 2022 by-elections.
Kiwa said there are more people checking the voters’ roll using the ZEC USSD platform *265# than those checking the physical copies in person. He said:

We are compiling figures from all the inspection centres. My take so far is that registrants were/are using our USSD platform *265# more than they are physically turning up to check.
But let the figures speak for themselves. I should be able to speak authoritatively end of the day Friday.

ZEC extended the voters’ roll inspection exercise to 01 June 2023. The voters’ roll inspection exercise which commenced on Saturday, was supposed to end on 31 May.
