President <a href="https://www.pindula.co.zw/Emmerson_Mnangagwa/">Emmerson Mnangagwa</a> has <a href="https://www.pindula.co.zw/2023/09/30/president-mnangagwa-has-exempted-mutapa-investment-fund-companies-from-public-procurement-procedures/">exempted companies</a> under the <a href="https://www.pindula.co.zw/Mutapa_Investment_Fund/">Mutapa Investment Fund</a> (formerly the Sovereign Wealth Fund) from the Public Procurement and Disposal of Public Assets Act in Zimbabwe. This means that the companies under the fund, including <a href="https://www.pindula.co.zw/TelOne/">TelOne</a>, Kuvimba Mining, <a href="https://www.pindula.co.zw/Petrotrade/">Petrotrade,</a> and Noczim, are no longer required to follow the procurement procedures outlined by the Procurement Regulatory Authority of Zimbabwe when acquiring goods and services.
The decision <a href="https://www.pindula.co.zw/2023/09/30/president-mnangagwa-has-exempted-mutapa-investment-fund-companies-from-public-procurement-procedures/">to exempt these companies from open public procurement procedures</a> was announced in General Notice 1546 of 2023, published in a government gazette on September 29, 2023. The notice seen by Pindula News states that the exemption was granted because the mentioned public entity operates in competitive markets and is deemed to require an exemption under the specified grounds of the Act. 
Some commentators have criticized the exemption of companies under the Mutapa Investment Fund from public procurement procedures, suggesting it could lead to looting and personal gain. Journalist <a href="https://www.pindula.co.zw/Mduduzi_Mathuthu/">Mduduzi Mathuthu</a> expressed concern saying:

A scandal! Guess who will be supplying those companies? The family!
</blockquote>
Former Petrotrade Board chairperson <a href="https://www.pindula.co.zw/Tinomudaishe_Chinyoka/">Tinomudaishe Chinyoka</a>, however, mentioned that procurement regulations sometimes hinder the competitiveness of government-owned companies, and an exemption might not necessarily be a bad thing if implemented properly. He said:

From my limited experience, procurement regulations make it hard for government-owned private limited liability companies to be competitive. You can’t even cough without running a tender for it. And, being forced to buy things an 4 times their price just because that was the lowest bid you received to the mandatory tender is not how to run a business. So, with that limited experience, I don’t think this is necessarily a bad thing. The devil will be in the detail of how things actually work. Sometimes, not everything is amended to facilitate corruption.

 Former Local Government Minister <a href="https://www.pindula.co.zw/Saviour_Kasukuwere/">Saviour Kasukuwere</a> criticized the move as an abuse of power and raised concerns about potential corruption. He said:

Mnangagwa’s Presidential Decrees Open Door to Massive State Asset Looting The recent renaming of the Sovereign Wealth Fund into the so-called “Mutapa Fund” by presidential decree and the subsequent transfer of selected state enterprises into that fund has shocked many and naturally attracted serious concern regarding the motives behind such a brazen move, especially without the consent of parliament, which is still to convene and is meant to protect the interests of citizens. Further to that, there is the recent promulgation, again by presidential decree, of a new statutory instrument that seeks to exempt the Mutapa Fund from the Public Procurement and Disposal of Public Assets Act (Chapter 22:23). There is no debate that public procurement procedures and the disposal of public assets have a profound impact on a nation’s developmental trajectory. Any country that wishes to maximize benefits from its assets and resources in a responsible manner and is also serious about accountability and transparency, therefore, needs to ensure that it has the appropriate laws, policies, and regulations in place to safeguard such public assets and resources from fraud and abuse.

Apostle Joel expressed strong condemnation, calling it industrial looting and a betrayal of accountability and transparency. He said:

Gold Mafia/Industrial Corruption Inc Zimbabwe ED has now officially personalized Zimbabwe after substituting the Sovereign Wealth Fund of Zimbabwe with a new one named Mutapa Investment Fund. ED’s hunger and thirsty to build his dynasty has manifested for all to see. Remember, the prophecy of inauguration of shame, dishonour. Remember, the throne of disgrace, humiliation. Cursed!! Leprotic!! Ahithophel wisdom. Corrupted wisdom. Whatever ED does is cursed, and offensive to the Zimbabwean citizens. The Mutapa Fund has assumed ownership of several state firms, and these companies are exempted from open public procurement procedures. Welcome to Industrial looting never witnessed in this country, even, when it was still Rhodesia. None has boldness to investigate, or stop this train of corruption, since all state institutions are captured. After zanufying Southern Africa, except for the few nations standing for righteousness and justice, vene is now personalizing Zimbabwe . This is very worrying. Member of Parliament (MP) for the <a href="https://www.pindula.co.zw/Mt_Pleasant/">Mt Pleasant</a> Constituency in Harare, <a href="https://www.pindula.co.zw/Fadzayi_Mahere/">Fadzayi Mahere</a> argued that the creation of the Mutapa Fund is illegal and allows for unprecedented looting. Fadzayi Mahere who is a member of the opposition Citizens Coalition for Change (CCC) said:

The uncomfortable truth is that the creation of the Mutapa Fund is illegal. Mr Mnangagwa doesn’t have the power to amend an Act of Parliament. The new looting vehicle is ultra vires the law &amp; the Constitution. This dispensation is going for broke. Shameless. The looting that’s about to take place is stratospheric. Most parastatals &amp; public entities incl ZUPCO, Netone &amp; many others now fall under the unconstitutional Mutapa Fund. These entities are now exempt from the legal obligation to go through public tender procedures. Tragic.
</blockquote>
Economic commentator Tinashe Murapata drew parallels with historical nationalization efforts, saying:

The confusion that is Mutapa Investment fund. What is happening is nationalization of commercial assets with direct control and command by the centre. Many of these assets were private, had private shareholders, parastatals, ran at arms length and now all directly bundled under the command of Mutapa. This is nothing new. This happened in Africa in the 1960’s where companies were bundled up through nationalization and a joint venture with a preferred private investor was pursued. It reminded me very much of Tiny Rowland – the preferred private investor and his foray in Africa. Herein my abridged essay on Tiny Rowland and what happened at the time. Striking parallels.

The <a href="https://www.pindula.co.zw/Amalgamated_Rural_Teachers_Union_of_Zimbabwe/">Amalgamated Rural Teachers Union of Zimbabwe (ARTUZ)</a> expressed concern about the possible stripping of national assets. Said the union:

Reactions To Exemption Of Mutapa Sovereign Fund From Procurement Procedures

An MP and one of the top leaders of CCC, <a href="https://www.pindula.co.zw/Gift_Ostallos_Siziba/">Gift Ostallos</a>, has come under heavy criticism after suggesting a newly appointed minister rose to her position through sexual means.
Following the announcement of the Zimbabwe’s new cabinet in which former actress <a href="https://www.pindula.co.zw/Tatenda_Mavetera/">Tendai Mavetera</a> was appointed ICT Minister, CCC MP Fadzayi Mahere asked on Twitter:

Her colleague, also an MP, Ostallos responded with a picture of the naked legs and thighs of a woman.

CCC MP Ostallos Criticised After Sexist Comments Against New ICT Minister

The Citizens Coalition for Change (CCC) opposition party has alleged that the Zimbabwe Electoral Commission (ZEC) is trying to manipulate the results of the 23-24 August 2023 harmonised elections. The party posted on X (formerly Twitter) that presiding officers were called to change the figures, but polling agents intervened and demanded an end to the process.
The CCC stated that ZEC’s actions are unlawful and undermine the people’s will, and they will legally and constitutionally resist such attempts. The party urged ZEC to act with integrity and accept the election outcome to avoid further disputes. Said the party:

ELECTION UPDATE: ZEC’s unlawful attempt to undermine the will of the people by tampering with the V11s will be met with legally and constitutionally resistance. It is imperative for ZEC to act honorably and accept the will of the people to prevent further contestation of the election outcome.
</blockquote>
Advocate Fadzayi Mahere, the party’s former spokesperson, also posted on X suggesting that presiding officers in the Mt Pleasant Constituency were summoned to manipulate the postal vote count on the V11 forms in order to inflate the “presidential numbers” because President Emmerson Mnangagwa was losing. Mahere said:

STOP THE STEAL: All the presiding officers for Mt Pleasant Constituency were called back to alter the postal vote count on our v11s to inflate their “presidential numbers” cause Mr Mnangagwa is losing. Our polling agents demanded a stop to the process. ZEC is now leaving Oriel.

The party later said after receiving reports of the ZEC’s alleged unlawful actions to reopen ballot boxes in Kwekwe, it deployed a team to the ZEC offices. The party said it appears the polling agents were misled by ZEC, who claim that they used an incorrect date and need to make amendments. The CCC party views this as a deliberate tactic to undermine the people’s will. The party urges everyone to stand up and protect the integrity of the vote.
Legal expert Advocate Thabani Mpofu urged polling agents not to respond to any requests from ZEC or the ZANU party to return to polling stations and reopen ballot boxes. He said:

Agents have discharged their mandate. Anyone getting a call from ZEC or ZANU requesting them to go back to polling stations to re-open ballot boxes must not heed such calls. 
</blockquote>
Mpofu emphasised that they already possess the necessary V11 forms and do not require anything further from ZEC. To safeguard the integrity of the vote, he advised them to defend it by remaining at home.

Zimbabwe 2023 Elections: CCC Says ZEC Is Attempting To Change Results

CCC spokesperson Fadzayi Mahere has claimed that the opposition party has received reports that police officers are being forced to vote under the watch of their superiors.
In Zimbabwe, police officers who will be on duty during the voting day are allowed to vote prior to the elections through postal voting.
Posting on Twitter, Mahere said some police officers are alleging that they are being forced to vote for ZANU PF. <a href="https://twitter.com/advocatemahere/status/1691472277727010816?s=20">She said</a>:

POLICE OFFICERS report that they’re being forced to vote under the watch of their bosses as we speak.
There are no agents or observers allowed to monitor the process. They report that they’re being forced to vote for ZANU PF.

In an unrelated development, prominent lawyer, Thabani Mpofu allegorically stated there is a scheme to manipulate the voting process. <a href="https://twitter.com/adv_fulcrum/status/1691476855512088576?s=20">He wrote</a>:

I hear a certain Electoral Commission is telling presiding officers that they must not post results on the notice boards at polling stations.
By the laws governing that Electoral Commission the instruction is unlawful &amp; CITIZENS of that country must resist the illegality.
In Zimbabwe, this will never happen. I hear the opposition is going to surprise the regime. Wait and watch.

CCC Official Says Police Officers Claim They Are Being Forced To Vote For ZANU PF

CCC has commended the Zimbabwe Defence Forces (ZDF) for safeguarding the country’s independence, sovereignty and territorial integrity as well as offering assistance to the civilian authority in times of need over the past 43 years.
In a statement to mark the 2023 Defence Forces’ Day on 15 August, CCC National Spokesperson, Fadzayi Mahere, noted that the country’s military has supported the civilian authority in saving lives by delivering humanitarian aid in times of crisis such as in the immediate aftermath of Cyclone Idai.
CCC, however, urged ZDF to serve “the interests of all Zimbabweans by fully complying with [its] constitutional obligation to respect the lives and dignity of the people in the execution of their duties.”
Mahere said if CCC wins the upcoming general elections, the military will never be used to curtail the rights and freedoms of citizens. Read the statement below:

Today, we join the nation in commemorating 43 years since the Zimbabwe Defence Forces came into being.
The constitutionally-defined roles of the Defence Forces are to protect Zimbabwe’s independence, sovereignty and territorial integrity, to partake in the design of our shared regional security architecture, to play a role in the preservation of international stability and peace and to offer assistance to the civilian authority in times of need.
Our Defence Forces have distinguished themselves in many of their constitutionally-defined roles. For 43 years, they have safeguarded Zimbabwe’s independence, sovereignty and territorial integrity.
We take pride in their sterling performances in various peacekeeping missions in Africa and the role they continue to play in aiding the civilian authority to save lives, deliver humanitarian aid and spearhead emergency reconstruction as they did in 2019 in the wake of Cyclone Idai.
However, the Defence Forces’ 43 years of service have been undermined by partisan politics. We note with particular sadness the attempt to poison and politicize the Defence Forces for partisan purposes and repression.
On this day of commemoration, we call on the Defence Forces to remember their constitutional mandate to the people of Zimbabwe.
We ask that they act in a manner that serves the interests of all Zimbabweans by fully complying with their constitutional obligation to respect the lives and dignity of the people in the execution of their duties.
In line with the Constitution, we demand the protection of citizens’ rights and freedoms by the Defence Forces. Our security services must protect not threaten citizens.
The democratic expression of citizens must be safeguarded. We reiterate our call for a Defence Force for everyone.
Under the incoming Citizen Government, weapons and arms of war will never be deployed to support a political party’s partisan interests or impede the citizens’ right to demonstrate peacefully.
Instead, our Defence Forces will support collective national interests taking due cognisance of the fundamental rights and diversity of the citizenry.
The professional standing of the Defence Forces will not be interfered with. The Defence Forces will be given the space to serve the people as prescribed by law.
We will improve the conditions of service of rank and file soldiers. They deserve to earn a living USD wage and conditions of service befitting of the important constitutional role they are mandated to play in our society.

"Soldiers Deserve USD Living Wage", CCC Commemorates Defence Forces Day

The spokesperson for the Citizens Coalition for Change (CCC), Fadzayi Mahere, has highlighted political intimidation and violence as significant factors contributing to women’s reluctance to assume political leadership positions. This reluctance is evident in the low participation rate of only 11% of women in this year’s general elections, despite women comprising the majority of the country’s population. Among the 11 individuals vying for the presidency, Elisabeth Valerio of the United Zimbabwe Alliance is the sole female candidate.
In the previous 2018 elections, there were a record-breaking four female contenders for the presidency. However, when candidate registration closed for the National Assembly in this election cycle, the major political parties had fielded fewer than 12% women candidates each. In the National Assembly, there are 70 women candidates compared to 637 men across 210 constituencies, representing a meagre 11% of the overall candidate pool, a decline from the 14% figure in 2018.
During a recent press conference in Harare, Fadzayi Mahere of the Citizens Coalition for Change emphasized that the hostile political environment in the country acts as a deterrent for women actively engaging in politics. She said:

We would have loved to see more women participating in leadership positions but sadly violence, harassment and intimidation are forcing women to shy away.
We must create a safe and inclusive environment where women can participate, express their ideas and contribute to the development of our nation. Let us break these barriers and empower women to take their place in shaping the future of Zimbabwe.

Linda Masarira, the president of the Labour Economists Afrikan Democrats, expressed similar sentiments after her unsuccessful bid for the presidency. Masarira said:

As an advocate for gender equality, I am determined to challenge the patriarchal norms that persist in Zimbabwe’s political landscape. It is high time we dismantle the barriers that favour men.
Let us empower women to rise, amplify their voices, and reshape our political environment to truly reflect the diversity and strength of our nation.

Section 17 of the Constitution of Zimbabwe, however, stipulates the promotion of full gender balance and the complete participation of women, based on equality with men, in all spheres of Zimbabwean society.
In response to the low participation of women, the Women’s Institute for Leadership Development (WILD) emphasised that it would further relegate women to the periphery of development. WILD expressed concern that this marginalisation would hinder women’s involvement in decision-making processes, which is detrimental to democracy and perpetuates gender inequality. Additionally, it warned that women’s concerns regarding opportunities, public resource management, and service delivery would not receive adequate prioritization.

Fadzayi Mahere: Political Intimidation And Violence Deter Women From Leadership

The Supreme Court will deliver its judgement at midday on Thursday in the appeal by 12 Citizens Coalition for Change (CCC) National Assembly candidates from Bulawayo who are fighting their disqualification from the August 23 poll by the High Court.
CCC spokesperson Fadzayi Mahere spoke to the media outside court:

The Court has said the matter has been postponed to tomorrow the 3rd of August at 12 noon for judgment so we await the outcome of the court.
</blockquote>
She also expressed concern over the heavy presence of police officers at the court. She said the CCC party continues to call for the will of the people to be respected adding that if ZANU PF believes that it is popular, let it allow a free and fair election. Watch the video below for more:

Disqualification Of 12 CCC Candidates: Supreme Court Will Deliver Judgment On Thursday

The Citizens Coalition for Change (CCC) has appealed against the High Court’s ruling that disqualified its 12 MP candidates from contesting the 2023 elections. The Party’s national spokesperson, Fadzayi Mahere, stated that the appeal suspends the High Court judgment until the appeal is heard and determined. She said:
<blockquote>
Our lawyers confirm that they have filed an appeal against yesterday’s judgment under Case Number SCB86/23. The noting of the appeal suspends the operation of the judgment. Our candidates are accordingly still on the ballot &amp; remain there until the appeal is heard &amp; determined.

CCC lawyer, Thabani Mpofu, confirmed the development assuring that the fact that the Supreme Court is going on vacation from July 29 until September 10 would not create complications. Mpofu clarified that parties can appeal during the vacation period. He said:

We have appealed. It is not true that parties cannot appeal during vacation. Relax! What we are dealing with has nothing to do with the law. Zimbabweans must confront this dictatorship in the only lawful way possible The last thing that you must do is to let them deflate you.

On Thursday, July 27, 2023, High Court judge, Justice Nokuthula Moyo, delivered the ruling on behalf of Justice Bongani Ndlovu, <a href="https://www.pindula.co.zw/2023/07/27/breaking-ccc-candidates-in-bulawayo-barred-from-contesting-2023-elections/">disqualifying 12 CCC candidates</a> from the 2023 elections. The judge found that the CCC candidates, along with three others from different political parties, had contravened the Electoral Act by submitting their nomination papers through a police officer on June 21, when the Nomination Court sat.
ZEC officers who were assessors of the Nomination Court which sat on the 21st of June 2023 at Tredgold Magistrates Court, testified in court that the <a href="https://www.pindula.co.zw/2023/07/28/2023-elections-zec-says-disqualified-ccc-candidates-submitted-nomination-papers-on-time/">CCC candidates submitted their nomination papers on time.</a> They also stated that the nomination officer is the one who instructed the police to collect all nomination papers from aspiring candidates outside the courtroom when the court was closing at 4 pm on 21 June.

CCC Appeals Disqualification Of 12 MP Candidates From 2023 Elections

The opposition Citizens Coalition for Change (CCC) led by Nelson Chamisa has denounced <a href="https://www.pindula.co.zw/2023/07/27/breaking-ccc-candidates-in-bulawayo-barred-from-contesting-2023-elections/">the disqualification of 12 MP candidates from contesting in the 2023 elections</a> as an unconstitutional attack on the will of the people. The CCC’s national spokesperson, Fadzayi Mahere, stated that the party will urgently appeal against the High Court decision and invoke all legal, political and regional measures available under Zimbabwe’s Constitution, as well as the SADC and African Union mechanisms, to ensure that citizens’ right to choose their leaders is respected and safeguarded. The CCC believes that the decision to disqualify the candidates is a thinly-veiled attempt to impose candidates on the citizens of Bulawayo and confirms that Zimbabwe is now a full-blown dictatorship. The party argues that ZANU PF is afraid of facing the CCC in a free and fair election and has resorted to unconstitutional violations to maintain its grip on power. Today’s decision to disqualify 12 CCC House of Assembly candidates in Bulawayo is unconstitutional and further confirmation that ZANU PF can never win a free and fair election in Zimbabwe. The decision militates against citizens’ right to vote in leaders of their choice. Section 117 of the Constitution unequivocally states that the legislative authority of Zimbabwe is derived from the people, not Zanu PF or any other state institution. Accordingly, the thinly-veiled attempt to impose candidates on the citizens of Bulawayo is a dark stain on our democracy and confirms that Zimbabwe is now a full-blown dictatorship, worse than Robert Mugabe. Yet even at his worst, Robert Mugabe never tried to brazenly remove opponents he knew he would lose against from the ballot.
It is a matter of public record that the 12 affected candidates were duly nominated to contest for the House of Assembly in Bulawayo. The said candidates filed their nomination papers well within the time limits stipulated by our Electoral Law. This fact was admitted by the Zimbabwe Electoral Commission which is the constitutional and administrative body mandated to receive nomination papers within the ambit of the Constitution and the Electoral Act.
The CCC will urgently file an appeal against today’s judgment as well as invoke all legal, political and regional measures available under Zimbabwe’s Constitution as well as the SADC and African Union mechanisms to ensure that the ability of the citizens to choose their leaders as required by our supreme law is respected and duly safeguarded.
There can be no doubt that ZANU PF is afraid of facing the CCC in a free and fair election and has instead resorted to regrettable violations of the Constitution in an attempt to maintain its grip on power.
As we challenge today’s decision, we remain unshaken in the fight for change and a New Great Zimbabwe that works for everyone and where the authority to govern is derived from the people, and not from those who wish to undermine the Constitution and the voice of the citizens.
The citizens’ right to vote in leaders of their choice is not optional. It is a constitutional imperative.

CCC Condemns Disqualification Of 12 MP Candidates As Unconstitutional

Zimbabwe’s main opposition party, CCC, has rubbished claims by Deputy Minister of Information, Publicity and Broadcasting Services, Kindness Paradza that opposition political parties in the country are reluctant to utilise free airtime that the Zimbabwe Broadcasting Corporation (ZBC) provides them to reach out to potential voters.
Paradza told diplomatic missions accredited to Zimbabwe that ZBC has slots such as the Ballot, the Candidate, the Manifesto, and the Constituency Indaba for all political parties on all four radio channels and television stations to deliver their messages free of charge.
However, in a statement released this Tuesday, 25 July in response to Paradza’s claims, CCC spokesperson Fadzayi Mahere said nothing could be further from the truth. Reads the statement:

ZBC, STATE MEDIA REPORTING UNCONSTITUTIONAL &amp; BIASED IN FAVOUR OF ZANU PF
Citizens’ Coalition for Change notes false claims by the Deputy Information Minister, Kindness Paradza, that the opposition is “refusing to take up airtime on ZBC.”
It is a matter of public record that ZBC refuses to give any independent or fair coverage to the CCC, our Presidential Candidate, Adv Nelson Chamisa, our star rallies, our cluster rallies, our rural penetration drive, our campaign messages or any of our wide-ranging political activities.
Not only is the state media’s coverage unequal, but whatever token coverage is accorded to the opposition is biased, derogatory and manipulated in contravention of the Constitution and Electoral Law.
Section 61 of the Constitution obliges state media to be impartial and to afford a fair opportunity for the presentation of divergent views and dissenting opinions.
Additionally, the Electoral Law including sections 160G and 160J of the Electoral Act require state media to be fair and grant balanced allocation of time and prominence between Zanu PF and the CCC.
The CCC is legally entitled to equitable treatment including a reasonable opportunity to present our case.
It is a matter of public record that, the state media in general and ZBC in particular, have failed to comply with the law.
Instead of acting independently and in a fair manner, Zimbabwe’s State media has degenerated into a political reporting arm for Zanu PF as demonstrated by the skewed news and current affairs coverage that is heavily biased in favour of Mr Mnangagwa and Zanu PF in terms of content, support and time allocation (over 90%).
This unconstitutional conduct cascades as far as the Permanent Secretary for Information who has a constitutional obligation to act in a non-partisan manner as a civil servant.
Instead, he has demonstrated clear support for Zanu PF in the exercise of his functions. His conduct in this regard offends section 200 of the Constitution and further undermines the ability of state media to act in a non-partisan manner as is required by law.
For the avoidance of doubt, the CCC is available to participate on all fairly-moderated platforms that accord with the Constitutional standard.
We further challenge the ZBC to afford our Presidential Candidate, Adv Nelson Chamisa, the opportunity, on a live and unfettered platform, to present his message of hope to the nation, in the same way in which it provides live, wall-to-wall coverage of Mr Mnangagwa, Zanu PF activities and Zanu PF rallies.
State media coverage must never be biased, manipulated or unjustifiably skewed to present the Citizens’ Movement in a bad light.
We draw the attention of state media, stakeholders, the public and election observers to the Government’s refusal to follow the recommendations of the 2018 SADC and the African Union election observer missions.
The reports found that the coverage by ZBC of the elections was “in favour of one political party, contrary to the relevant provisions of the Constitution, the Electoral Act, and the Revised SADC Principles and Guidelines Governing Democratic Elections, which requires State-owned media to be impartial.”
Regrettably, our state media and ZBC have failed to reform.

CCC Accuses Deputy Minister Of Lying Over Free Broadcast Airtime On ZBC

CCC spokesperson Fadzayi Mahere has condemned the signing into law of the Criminal Law Codification and Reform Amendment Bill 2022, commonly referred to as the “Patriotic Bill” by President Emmerson Mnangagwa, which she described as unconstitutional.
The Chief Secretary to the President and Cabinet, Misheck Sibanda announced that Mnangagwa has assented to the Patriotic Bill through General Notice 1189 of 2023 published in the Government Gazetted on Friday, 14 July 2023.
Mahere said the signing into law of the controversial Bill proves that Mnangagwa’s government is worse than that of the late former president Robert Mugabe who was deposed by the military in November 2017. <a href="https://twitter.com/advocatemahere/status/1679815541161091072?s=20">Said Mahere</a>:

The Criminal Law (Codification and Reform) Amendment Act has been condemned by human rights actors both at home and internationally as an instrument meant to punish critics of the corrupt and repressive ZANU PF regime!

It will see many opposition, government critics and journalists jailed for exercising their constitutional rights.

Political activist Jacob Ngarivhume was jailed for 4 years for speaking out against corruption and organizing an anti-corruption march.
The regime inspects Twitter handles of opposition politicians, critics and journalists for anything that offends it and gets them arrested at times using laws that don’t exist.
So this law is meant to muzzle them! Today is a dark day for Zimbabwe!

The new law provides penalties that include a fine not exceeding level twelve or imprisonment for a period not exceeding 10 years, or both for those found guilty of “wilfully injuring the sovereignty and national interest of Zimbabwe”.

Patriotic Act: Zimbabwe Now A Full-blown Dictatorship, Says Mahere

The High Court has ordered Bindura Magistrate Msika to hear the opposition Citizens Coalition for Change (CCC) appeal against the ban on their campaign launch rally, which was scheduled to take place at 10 AM today. 
The High Court ruled that the hearing must occur at 12 noon, following an urgent application filed by three Bindura residents seeking an order to compel Msika to set down the hearing and determination of the appeal by no later than 11 AM today. The residents argued that their political rights and right to assembly and association had been violated by the ban. Jeremiah Bamu is representing them. CCC national spokesperson, Fadzayi Mahere, confirmed the ruling in a statement seen by Pindula News. She said:

CCC: Ban On National Campaign Launch Unlawful

The opposition CCC party has approached the High Court to challenge the decision by the Zimbabwe Republic Police (ZRP) to ban their 2023 elections campaign launch that was scheduled for 09 July in Bindura.
CCC spokesperson Fadzayi Mahere said they had initially approached the Magistrates Court to challenge the move by the Police, but after the lower court set the matter down for 11 July, the opposition party then approached the High Court. Said Mahere:

The Police unconstitutionally “banned” our Campaign Launch set for Sunday. Our lawyers immediately challenged the illegality.
The Magistrates’ Court erroneously set the matter down for 11 July (2 days after the rally) in violation of the Act. We’ve lodged an urgent review to the High Court.

In banning the CCC rally, Police said the venue selected by the opposition party has no access roads and water, exposing supporters to communicable diseases.
ZRP also said they were not given sufficient notice “as provided for in terms of the MOPA Act”, and advised CCC to find another venue and date for the event.
On Wednesday, police disrupted CCC’s Presidential Campaign Rally in Chiredzi, saying the party failed to comply with security requirements prescribed under section 8 of the Maintenance of Peace and Order Act (Chapter 11:23).
Another CCC rally that was scheduled for Chivi Growth Point this Friday was also blocked by the Police who said the venue had already been booked by ZANU PF.

CCC Approaches High Court To Challenge Campaign Launch Ban

The opposition Citizens Coalition for Change (CCC) has announced that lawyer, <a href="https://www.pindula.co.zw/Obey_Shava/">Obey Shava</a> was viciously attacked by four unidentified men who broke his legs. In a Twitter post seen by Pindula News, the party’s spokesperson, Advocate Fadzayi Mahere said:

We’ve received a disturbing report that human rights defender &amp; lawyer @obeyshava1 was badly assaulted this evening. We condemn this savage act and wish him a speedy recovery.

According to reports, four assailants broke his legs and left him fighting for his life. In a Twitter post, Advocate Thabani Mpofu, another top CCC lawyer, expressed his concern over the safety of citizens during this tumultuous season. He said:

Top CCC Lawyer Obey Shava was this evening viciously attacked by 4 men who broke his legs and left him battling for his life. The safety of our citizens must be uppermost on the state’s agenda, particularly during this crazy season. Wishing this champion a speedy recovery.

Former ZINASU leader, <a href="https://www.pindula.co.zw/Makomborero_Haruzivishe/">Makomborero Haruzivishe</a>, condemned the attack suggesting that the perpetrators were sent by the ruling ZANU PF. He said:

ZAPU has also taken to Twitter to condemn the brutal and barbaric attack on human rights lawyer Obey Shava by alleged ZANUPF thugs. The party said the attack is a clear indication that the perpetrators have resorted to their Mgagao settings, which is deeply concerning. ZAPU tagged SADC and the African Union in their post, highlighting the need for regional and continental bodies to take action against such acts of violence.

Unidentified Men Attack CCC Lawyer Obey Shava, Break His Legs

The Nelson Chamisa-led Citizens Coalition for Change (CCC) has said forty-one (41) individuals fraudulently filed nomination papers as members of the party.
20 of the “fraudsters” filed nomination papers for National Assembly seats while the other 21 individuals filed for local authority seats.

CCC Sues 41 "Fraudulent" Candidates

The opposition Citizens Coalition for Change (CCC) party has written a letter to the Zimbabwe Electoral Commission (ZEC) to seek clarification regarding a situation of name similarity. This was after it was discovered that a person named Chitembe David from Harare East Constituency had registered to contest in the Parliamentary elections as a candidate for a political party named Changu Chimuti Chakapinda Chapinda (CCCC), which bears a resemblance to the CCC party.
The party inquired if the CCCC party exists and how it was possible for someone to register with a political party that has a name identical to theirs. The CCC has also expressed curiosity about the use of similar symbols by various political parties and requested ZEC to clarify this issue to the citizens. In an open letter seen by Pindula News, the CCC led by Nelson Chamisa said:

We wanted to inquire whether there exists a political party by the name of Changu Chimuti Chakapinda Chapinda (CCCC). We are curious about the electoral law with regard to the use of similar symbols by various parties. Over the years, Zimbabwe’s political landscape has been marked by instances of name similarity among political parties. Examples include the MDC-T party led by Thokozani Khupe, which was accused in 2018 of using a symbol similar to that of the MDC Alliance party then led by Nelson Chamisa. Other examples include Movement for Democratic Change (MDC) formations such as MDC T, MDC M, MDC 
Alliance, MDC 99 as well as the ZANU Ndonga, PF ZAPU, ZANU PF, ZIM PF, Citizens Coalition for Change (CCC), Citizens Collaboration for Change (CCC), Citizens Convergence for Change (CCC), and Changu Chimuti Chakapinda Chapinda (CCCC).
Political analysts believe that this situation can lead to voter confusion and raise concerns about the credibility of the electoral process. CCC Writes To ZEC Over Case Of Name Similarity

The Citizens Coalition for Change (CCC) recently published the names of its parliamentary candidates who have filed their nominations across the country on Wednesday. Notably, the final list excluded several veterans, ensuring new faces in the upcoming parliament following the general elections on August 23.
According to the leader of CCC, Nelson Chamisa, the party has selected the most competent individuals to lead the country’s recovery. The CCC initiated the process of selecting their candidates in April but faced criticism for delaying the announcement of the winners until the sitting of the nomination courts. Chamisa has explained that the party was concerned that their candidates could be subjected to arrest and harassment. We present the list below:

FULL LIST: CCC Parliamentary Candidates For 2023 Elections

Finance and Economic Development Minister <a href="https://pindula.co.zw/Mthuli_Ncube">Mthuli Ncube</a> is accused of damaging a water pipe near the Caravan area in Bulawayo.
Ncube reportedly hired earth-moving machines hired to rehabilitate some of the Cowdray Park roads as part of his campaign ahead of the 23 August 2023 elections.
He is the ZANU PF candidate for the Cowdray Park House of Assembly constituency.
According to CITE, City of Bulawayo councillors recently criticised Ncube for embarking on the road rehabilitation project without seeking approval from the local authority. <a href="https://twitter.com/citezw/status/1668613802386923522?s=20">Reported CITE</a>:

Ncube and Deputy Industry and Commerce Minister Raj Modi were not contested in the ZANU PF primary elections held in March this year. Modi is eyeing the Bulawayo South constituency.
When Ncube was confirmed as the ZANU PF candidate for Cowdray Park, he said he was working with the Bulawayo City Council to address the issue of the sewage system in the area.
He also promised to drill more boreholes in the constituency as part of efforts to deal with the water crisis in the area.

Mthuli Ncube Accused Of Damaging Underground Water Pipe In Bulawayo

The Permanent Secretary of Information, <a href="https://www.pindula.co.zw/Nick_Mangwana/">Nick Mangwana</a>, has claimed that some banks lied that NOSTRO accounts did not have United States dollars (USD) and that triggered mass withdrawals by depositors.
BancABC and FBC Banks were accused of limiting <a class="MarkdownLink_linkifiedLink__KxC9G">cash withdrawals</a> and prohibiting certain transactions, but they later dismissed the reports as fake. <a class="MarkdownLink_linkifiedLink__KxC9G">Mangwana</a>‘s comments are believed to refer to the earlier statements by the banks in which the restrictions were announced. In a Twitter post seen by Pindula News, Mangwana said:

A “Bank Run” is when a large number of depositors simultaneously try to withdraw their funds from banks immediately. This is what was caused by the recklessness of a couple of banks which for reasons best known to themselves lied that what was in the Nostro accounts was not USD. Stop It!

<a href="https://www.pindula.co.zw/Fadzayi_Mahere/">Fadzayi Mahere</a>, <a href="https://www.pindula.co.zw/Citizens_Coalition_for_Change/">Citizens Coalition for Change (CCC)</a> spokesperson, responded to Mangawa’s post saying it was confirmation that banks had actually issued the statements which they later denied. She said:

Tinashe Murapata, an economic blogger, disagreed with Mangwana’s comments, stating that banks were attempting to prevent mass withdrawals contrary to his claims that they triggered them. He said:

You’re not helping the situation perm sec (Nick Mangwana). Banks are actually trying to avoid a run but for reasons known to you, you are inflaming the situation. The problem with propaganda here is that depositors have a right to their money. They’re not being irrational considering what has happened this last few weeks. The message from GOZ is to calm the waters and NOT play politics. Perhaps start by actually sharing the data of what is in the system. What we have is end of March. We are now June. Nobody cares to communicate the real time truth. I implore you, on these sensitive matters to communicate with empathy or to keep quiet. Remember most people keep their money under mattresses because they don’t trust GOZ. Therefore, what are you communicating with this tweet? Other than withdraw your money from banks quickly….

Banks are attempting to prevent a run on their institutions by limiting <a class="MarkdownLink_linkifiedLink__KxC9G">cash withdrawals</a> and prohibiting some transactions. This is intended to ensure that there is enough cash to meet the demand of depositors and to prevent a situation where everyone tries to withdraw their money at once, which could lead to a collapse of the banking system.
However, the imposition of restrictions on <a class="MarkdownLink_linkifiedLink__KxC9G">cash withdrawals</a> and certain transactions has caused widespread panic among depositors. Some individuals who were contemplating depositing their money have refrained from doing so since they were not sure they would be able to withdraw whenever they want to.

Mangwana: Banks Lied Nostro Accounts Didn't Have USD, Causing Mass Withdrawals

The founder of the #ThisFlag movement <a href="https://pindula.co.zw/Pastor_Evan_Mawarire">Evan Mawarire</a> condemned the passage of the Criminal Law (Codification and Reform) Amendment Bill in the ZANU PF-dominated National Assembly (Lower House of Parliament) on Thursday.
The proposed law contains the contentious Patriotic clause that seeks to punish Zimbabweans who speak badly about the country or associate with foreign diplomats or any other foreigners discussing such issues.
Mawarire said the Bill criminalises citizens’ rights such as freedom of speech, freedom of association, and assembly. He wrote:

Very sad day for Zimbabwe. Parliament passed the draconian Patriot Act.
It criminalizes freedom of speech, freedom of association, and assembly and disallows Zimbabwe citizens from engaging foreign government officials.
Zimbabwe has become far worse than any of us imagined.

Citizens Coalition for Change (CCC) spokesperson and lawyer <a href="https://pindula.co.zw/Fadzayi_Mahere">Fadzayi Mahere</a> said:

This violation of the right to life under Section 48 of the Constitution which says the death penalty can only be imposed for murder committed by men between 21-70 years.

Harare East MP, <a href="https://wiki.pindula.co.zw/Tendai_Biti">Tendai Biti</a> (CCC), who vigorously debated against the passing of the Bill in the National Assembly said:

It was a day indeed as Parliament passed the Patriot Bill this evening.
The new law is an unprecedented law that seeks to proscribe freedom of association, assembly, and speech of any citizen holding a meeting with a foreign government.
Not even Apartheid Rhodesia passed such repugnant law.

The Bill seeks to amend the Criminal Law (Codification and Reform) Act [Chapter 9:23], which has four clauses, three of which have been described as progressive excluding Clause 2.
Clause 3 will amend Section 65 of the Principal Act to make 15 years the minimum required punishment for rape, in response to the rise in crimes of sexual violence and rape.
Clause 4 proposes to amend Section 155 of the main Act’s definition of dangerous drugs to include prepared opium, prepared cannabis resin, and a drug schedule.
Clause 5 proposes to amend Section 174 of the main Act as the existing definition of criminal abuse of office, as provided for in Section 174 (i), is fairly broad, allowing public officials to be charged for honest mistakes made while doing their duties.
At least 99 Members of Parliament voted in favour of the amendments while 17 voted against resulting in the adoption of the amendments.
Justice, Legal and Parliamentary Affairs Minister <a href="https://wiki.pindula.co.zw/Ziyambi_Ziyambi">Ziyambi Ziyambi’s</a> proposed amendments to Clause 2 (3) read as follows:

Any citizen or permanent resident of Zimbabwe who, within or outside Zimbabwe, intentionally partakes in any meeting, whose object or one of whose objects the accused knows, or has reasonable grounds for believing involves the consideration of or the planning for the implementation or enlargement of sanctions or a trade boycott against Zimbabwe (whether those sanctions or that boycott is untargeted or targets any individual or official, or class of individuals or officials), but whose effects indiscriminately affect the people of Zimbabwe as a whole, or any substantial section thereof shall be guilty of wilfully damaging the sovereignty and national interest of Zimbabwe and liable to…
The clause provides penalties that include a fine not exceeding level twelve or imprisonment for a period not exceeding 10 years, or both.

Political Activists Condemn Passage Of 'Patriotic Bill' In Parliament

The recent release of <a class="MarkdownLink_linkifiedLink__KxC9G">convicted rapists</a> under the <a class="MarkdownLink_linkifiedLink__KxC9G">presidential amnesty</a> has caused discontent among some Zimbabweans, with <a href="https://www.pindula.co.zw/Fadzayi_Mahere/">Fadzayi Mahere</a> accusing authorities of being grossly irrational.
President Emmerson Mnangagwa <a href="https://www.pindula.co.zw/2023/05/20/francis-gudyanga-released-in-presidential-amnesty/">ordered the release of 4,279 prisoners</a> to ease congestion in <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwe</a>‘s prisons, which had a capacity of 17,000 inmates but were holding more than 22,000.
The pardons benefited prisoners who were held for non-violent offences and those aged over 60 who had served at least one-tenth of their sentence by April 18. However, the release included a convicted rapist who had sexually assaulted a nine-year-old girl and was released after serving just one year of his sentence.
Fadzayi Mahere, the spokesperson of the opposition Citizens Coalition for Change (CCC) criticised the decision to release the rapists before completing their full prison terms, calling it “irrational.” Mahere, a legal expert posted on Twitter:

While it is globally accepted that amnesties are a useful criminological device to minimise incarceration and encourage rehabilitation, such pardons must be made in a reasonable manner as required by section 68 of the Constitution with due regard to the plight of victims.
With respect, it is grossly irrational to release dangerous, unrehabilitated offenders back into society. In particular, releasing rapists who have barely served their sentence and who’ve not demonstrated that they are rehabilitated poses a huge threat to the survivors of the rape and wider society.
Unleashing unrehabilitated rapists back into the communities that they committed rape is not only ultra vires the amnesty instrument, it’s a grossly irrational, negligent act that must be condemned by all progressive voices who care about the safety of women &amp; girls.

Fadzayi Mahere: Release Of Convicted Rapists Under Presidential Amnesty Is Grossly Irrational

National Peace and Reconciliation Commission (NPRC) spokesperson, Obert Gutu, has criticised CCC spokesperson, Fadzayi Mahere over the remarks she made at the United Nations Geneva Summit for Human Rights and Democracy 2023 in Switzerland on Tuesday.
Among other things, Mahere said Zimbabwe is under a dictatorship that is worse than during the late former president Robert Mugabe’s reign.
Speaking to <a href="https://zbcnews.co.zw/2023/05/19/mahere-under-fire-for-vilifying-the-country/">ZBC News</a>, Gutu said Mahere should have raised her concerns with the NPRC instead of using the United Nations Geneva Summit for Human Rights and Democracy to air her grievances. Gutu said:

We normally want to encourage people to be mindful of what we say, where we say it, and how we say it.
It’s very unfortunate when utterances that might have the effect of disturbing peace are made here in Zimbabwe or outside the country there might have the effect of disturbing the peace because I understand from my observation that a number of people are very upset about what she said in Geneva.
I happen to have watched the video as well and I’m saying from a peace-building perspective, those issues she raised could have been raised locally as they say the best approach is to use domestic remedies before you go out of your own house to talk about domestic issues.
As a peacebuilding institution mandated by the supreme of the land to build peace in Zimbabwe, we wouldn’t have to encourage any Zimbabwean who feels they want to have issues to discuss to be free to contact us or give us suggestions may be orally or in writing with regards to what they would want to be done about the issues or complaints that they have.
We believe that as NPRC at the end of the day peace-building affects everyone and if you say something that might have an effect of sticking emotions, which is what appears to be the case here, that would actually invite an inferno of emotions that might even lead to civil unrest in the country and it will be very unfortunate considering that we are already in elections where political emotions are running very high and one would want to believe that the whatever we do, whatever we say as Zimbabweans, political actors and non-political actors, we should always be mindful of the impact-end of effect it might have on the peacefulness of our beloved country.

Speaking in Switzerland, Mahere claimed that half of Zimbabwe’s population lives in extreme poverty while billions are being looted by the ruling elite.
She also said the conviction of Transform Zimbabwe (TZ) president Jacob Ngarivhume for incitement to public violence is a warning by the ruling elite that participating in opposition politics is punishable.
Mahere narrated her ordeal at the hands of State institutions and castigated the treatment of political opponents, prisoners, and judicial capture.
She recalled her treatment at Chikurubi Maximum Prison after her arrest on charges of undermining the authority of the police after she posted a video that had already been posted multiple times alleging that a police officer had struck dead a baby with a baton in Harare. Mahere said:

Two years ago, I woke up in an overcrowded jail cell in Zimbabwe’s Maximum Security Prison.
No water. No toilet. No underwear. No dignity. No rights.
Inmates ate watery porridge with their bare hands because spoons are not allowed.
Before lights were off, we had to line up in queues for roll call – groups A, B, C and D. D was for Dangerous.
Even though the other women there had committed crimes such as murder, armed robbery and infanticide, I alone was put in the dangerous group.
I had committed the dangerous crime of tweeting against police brutality.

Obert Gutu Criticises Mahere Over Her Remarks In Geneva

<a href="https://www.herald.co.zw/mahere-lies-about-state-of-human-rights-in-zimbabwe/">The Herald</a> accused Fadzayi Mahere, the CCC spokesperson, of lying during the United Nations Geneva Summit for Human Rights and Democracy 2023 in Switzerland, where 25 NGOs partnered to discuss the state of human rights in different countries.
Mahere claimed that Zimbabwe is a “full-blown dictatorship” and opposition leaders are being politically persecuted.
The Herald refuted these claims, stating that Transform Zimbabwe leader Jacob Ngarivhume was jailed for inciting public violence and that Job Sikhala was in remand for facing multiple charges.
The article criticized Mahere for shaping the international community’s perception of Zimbabwe’s human rights situation ahead of the forthcoming elections and accused her of using a “borrowed Western English accent” to do so.
Mahere claimed during the United Nations Geneva Summit for Human Rights and Democracy 2023 that the crackdown on opposition members was a sign that they were winning. However, The Herald refuted these claims, stating that the opposition committed criminal offences because they were not popular and wanted to appear popular.
The article also criticized the CCC for failing to register enough voters for its leader, Nelson Chamisa, and for making false promises during the election campaign. It accused the opposition of stirring violence to create an environment of contested elections and justify their defeat and subsequent calls for more sanctions on Zimbabweans.
The article concluded by stating that President Mnangagwa had publicly denounced violence and urged Zimbabweans to vote in peace, while the opposition warned their supporters to arm themselves and be ready to defend the vote by any means possible, including violence.
Some Context:
Sikhala has been in prison since June 2022 when he was arrested and charged with inciting public violence which erupted during the funeral wake of slain Citizens Coalition for Change (CCC) activist, <a href="https://www.pindula.co.zw/Moreblessing_Ali">Moreblessing Ali.</a> Sikhala denies the charges against him. His party and some analysts believe that the judiciary is captured by the executive and that Sikhala’s prolonged detention is politically motivated. These analysts believe that the judiciary should remain autonomous and free from any perception of being owned or controlled.
Ngarivhume <a href="https://www.pindula.co.zw/2023/04/28/jacob-ngarivhume-sentenced-to-four-years-in-jail">was convicted of incitement to public violence and sentenced to four years in jail</a> for a tweet he posted in July 2020. Twelve months were conditionally suspended, with his case being seen as a threat to the constitutional rights of all <a class="Markdown_link__9ACHA MarkdownLink_linkifiedLink__KxC9G">Zimbabweans</a>. In the 2020 tweet, Ngarivhume called for a national shutdown to protest against poor leadership by the ZANU PF-led government. 
Dictatorship in Zimbabwe?
Robert Mugabe was Zimbabwe’s President from 1987 to 2017. His government faced allegations of <a class="MarkdownLink_linkifiedLink__KxC9G">human rights abuses</a>, corruption and political repression. The regime was accused of manipulating elections, suppressing opposition voices and using violence to maintain power. The media was tightly controlled, and journalists were often arrested for reporting on critical issues. Mugabe’s rule lacked respect for the rule of law, leading many to label it as a dictatorship.
Following the ousting of Robert Mugabe in 2017, there were expectations that his successor, President Emmerson Mnangagwa, would lead <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabwe</a> towards democratic reforms. Mnangagwa promised to create a “new Zimbabwe,” free from the repression and corruption that characterized Mugabe’s rule. However, nearly four years after taking office, many <a class="MarkdownLink_linkifiedLink__KxC9G">Zimbabweans</a> feel that little has changed. The country continues to face economic challenges and <a class="MarkdownLink_linkifiedLink__KxC9G">political repression</a>, with opposition leaders and activists frequently harassed and arrested. The Herald Accused Mahere Of Lying At UN Human Rights Summit

Four University of Zimbabwe students were arrested for staging a protest against the continued imprisonment of opposition politician <a href="https://www.pindula.co.zw/Job_Sikhala/">Job Sikhala</a> and the “use of the law against government critics.”
The students are being charged with criminal nuisance and are being represented by a human rights NGO lawyer.
The protest involved over 30 youths holding placards and denouncing the ZANU PF government for persecuting opposition politicians.
The students also used social media with the hashtag #BlackMonday to mourn the death of democracy and the rule of law in the country.
Sikhala has been in pre-trial detention since June last year, while other opposition members and human rights activists face various charges amid concerns over shrinking democratic space in Zimbabwe.
The students’ comments are similar to those made by opposition members and other government critics who accuse the government’s executive branch of controlling the judiciary to benefit the ruling party.
Critics have accused the government of using the judiciary to silence opposition voices and to protect ruling party officials from prosecution.
There have been several high-profile cases where opposition members and human rights activists have been arrested and charged with various offences while ruling party officials accused of similar offences have gone unpunished.
The appointment of judges has also been a contentious issue, with accusations that the government has manipulated the process to ensure that only judges sympathetic to the ruling party are appointed. These actions have led to concerns about the impartiality of the judiciary and the erosion of democratic values in Zimbabwe.

Four Students Arrested For Protesting Sikhala's Imprisonment

President Emmerson Mnangagwa’s reversal of the <a href="https://www.pindula.co.zw/2023/05/09/mnangagwa-declares-procurement-of-public-health-assets-should-not-be-disclosed/">ban on health assets procurement disclosure</a> has been criticised for policy inconsistency.
The president last Friday declared that procurement details of public health assets will not be disclosed for “national interest.” The Office of the President and Cabinet said the declaration is in accordance with the Public Procurement and Disposal of Public Assets Act.
He, however, reversed GENERAL NOTICE 635 OF 2023 which had announced the ban, citing its unauthorized publication without proper authorization and signature.
The reversal attracted criticism from some members of the public.
Fadzayi Mahere, the national spokesperson of the opposition Citizens Coalition for Change (CCC) led by Nelson Chamisa said the reversal was not effective until a government notice to that effect has been gazetted. She said:

Policy inconsistency, confusion, flip flopping and U-turns. The incompetence is breathtaking. ..
At law, you don’t rescind a gazetted Govt Notice by a tweet or a press statement. You repeal it by way of a similarly gazetted Govt Notice. In light of your concessions on the invalidity of it, we look forward to the expeditious repeal thereof… 
Who signed these respective documents? Which should we believe? What have rise to such an egregious violation of the Constitution? Surely the public is entitled to an explanation? We need new leaders.

George Charamba’s alleged Twitter account, Tinoedza Zvimwe @Tinoedzazvimwe1, agreed Mahere’s opinion was right, stating that the President’s statement was merely informative, not a reversal of the gazetted notice.  Tweeted the account:

Do not tweet as if you know what it happening in Govt for compliance!!! Unless you are very silly, a PRESS STATEMENT is just that: for public information. It is not a rescinding instrument!!!!!

Joanah Mamombe, CCC MP for Harare West, criticised the ruling ZANU PF, saying the party expected praise for correcting the damage it had caused. She said:

ZANU PF wants us to clap hands and praise them for opening windows after they had farted. You farted and soiled the air, we can’t praise you for opening windows for us. ZANU PF has been soiling the air for 43 years. It’s time we give them the boot. Real leaders take responsibility when they err. Weak leaders play the blame game. Your so-called commitment to fighting corruption should be in word and deed. Your corruption stinks to high heavens. It’s time you leave running the country to new capable leaders.
</blockquote>
Some said some government officials should be fired if the president was not aware of the document.
Govt Spokesman, Nick Mangwana initially defended the invalid Government Notice but the Chief Secretary in the Office of the President and Cabinet, Dr Misheck Sibanda issued a statement moments later disowning the notice, causing inconsistency.
Linda Tsungirirai Masarira, the president of the opposition Labour, Economists and African Democrats party (LEAD) criticised government inconsistency. She said:

Ali Naka said President Mnangagwa was testing the waters with the ban on disclosure of procurement of health assets. Nothing works if the politics is not right.
Some critics said Varakashi, “those defending the attempt to legalize looting” were swiftly rebuked which shows that social media was effective.

Reactions To Reversal Of Ban On Health Assets Procurement Disclosure

<a href="https://www.pindula.co.zw/Fadzayi_Mahere/">Fadzayi Mahere</a> has said the Citizens Coalition for Change (CCC) is not a party to the delimitation report case contrary <a href="https://www.pindula.co.zw/2023/05/04/ccc-lawyer-applies-to-oppose-mwonzoras-application-on-zec-delimitation-report/">to reports</a> by former Information Minister <a href="https://www.pindula.co.zw/Jonathan_Moyo/">Jonathan Moyo</a>.
Moyo, a Political Science Professor claimed this Thursday that the CCC opposed <a href="https://wiki.pindula.co.zw/Douglas_Mwonzora">Douglas Mwonzora</a>‘s legal challenge against <a class="MarkdownLink_linkifiedLink__KxC9G" href="https://wiki.pindula.co.zw/Zimbabwe_Electoral_Commission">Zimbabwe Electoral Commission (ZEC)</a>‘s 2023 delimitation report through lawyer Jeremiah Bamu. He claimed:

The fact that ZanuPF has virtually completed its primary elections and that CCC is about to complete its stalled candidate selection process, both based on new electoral boundaries, makes it unlikely that the ZEC delimitation report will be set aside. More likely, praxis will prevail over theory to avoid chaos. But in the event that the delimitation report is set aside, it is difficult to see why and how the Court would grant Mwonzora’s prayer that the election proclamation should only be made after ZEC has redone the delimitation report. This expectation might explain why through its proxy, CCC has opportunistically made a eleventh hour application to basically argue against postponement of the election. It’s a winning argument, almost guaranteed!

In response, Mahere said the opposition party which is led by Nelson Chamisa, a former Minister of ICT, Postal and Courier Services during the Government of National Unity (GNU) was not a party to the case. She said:

Mwonzora seeks to nullify the ZEC Delimitation Report and postpone the general election, scheduled for August, by six months to give the Zimbabwe Electoral Commission (ZEC) time to redo the delimitation exercise and provide a new report.
Bamu applied to become Amicus Curiae or a friend of the court opposing Mwonzora’s request that, if the delimitation report is nullified, President Emmerson Mnangagwa’s election proclamation should be postponed until ZEC has redone the delimitation exercise and submitted a new report. In other words, Bamu’s application is against delaying the general election.
Jonathan Moyo argues that Mwonzora may face preliminary obstacles, such as a lack of capacity (locus standi) to sue ZEC as a presidential candidate. Moyo explained that Mwonzora is a presidential candidate, therefore, is unaffected by the new electoral boundaries in the ZEC delimitation report since voters can vote for him no matter the ward or constituency they are voting from. He added
The CCC party wants elections held this year. <a href="https://news.pindula.co.zw/2023/04/22/elections-are-like-christmas-you-cant-postpone-them-mahere/">Mahere has compared elections to Christmas</a> and believes they should take place regularly, regardless of the situation. The party alleges that Mwonzora’s challenge of the delimitation report was instructed by the ruling ZANU PF party, which is afraid of holding elections this year. The upcoming elections are set to take place sometime between July 26 and August 26.

Mahere Says CCC Is Not A Party To The Delimitation Report Case

<a href="https://wiki.pindula.co.zw/Fadzayi_Mahere">Fadzayi Mahere</a>, the spokesperson for the Citizens Coalition for Change (CCC), has filed an appeal against <a href="https://zero.pindula.co.zw/mahere-faces-20-years-in-prison-after-being-found-guilty-of-communicating-falsehoods/">conviction</a> and sentence in a case she is accused of publishing falsehoods.
Mahere was recently convicted and <a href="https://zero.pindula.co.zw/fadzayi-mahere-fined-us500-for-publishing-falsehoods/">fined US$500</a> for allegedly lying that the <a href="https://zero.pindula.co.zw/top-cop-says-mahere-lied-that-baby-was-killed-by-police-baton/">police had beaten a baby to death</a> in the Central Business District of Harare in 2020.
She was <a href="https://zero.pindula.co.zw/mahere-faces-20-years-in-prison-after-being-found-guilty-of-communicating-falsehoods/">spared a prison sentence</a> after magistrate Taurai Manuwere who presided over her case found that her intention was to tarnish the image of the police with a tweet alleging that an officer had killed a baby with a baton.
Mahere was, however, cleared of the prosecution’s charge of promoting and inciting public violence. She believes that the magistrate made an error in his decision. Zimbabwe Lawyers for Human Rights (Rights) representing the opposition spokesperson announced:

Constitutional lawyer &amp; opposition @CCCZimbabwe spokesperson Advocate Fadzai Mahere has asked the High Court to overturn her conviction and sentence for allegedly publishing or communicating falsehoods prejudicial to the state. 
</blockquote>
In her appeal, Mahere argued that the magistrate failed to interpret the law. She argued that the magistrate made several errors in his decision. Mahere claimed that Manuwere made a mistake by accepting the validity of a provision (section 31(a)(iii) of the Criminal Law (Codification and Reform) Act) that was declared invalid under the former Constitution.
Mahere also accused the magistrate of ignoring the fact that she was targeted for prosecution, which violated her right to equality before the law. She further argued that the US$500 fine imposed on her was excessively high and violated her right to freedom of expression.
Mahere wants the High Court to set aside her conviction and sentence.

Mahere Challenges Conviction In Falsehoods Case

Citizens Coalition for Change (CCC) spokesperson Fadzayi Mahere has said political elites cannot delay the 2023 general elections.
Mahere also said CCC is opposed to the idea of postponing elections to form a Government of National Unity (GNU).
She was quoted by <a href="https://tellzim.com/ccc-laughs-off-gnu-election-postponement/">TellZim News</a> as saying elections when done properly, are a true expression of the will of the people. Mahere said:
<blockquote>
The constitutional requirement that elections be held every five years can’t be suspended by political elites who have no support from the citizens and are afraid of electoral loss.
ZANU PF and its proxies are terrified of how much support they have lost and are seeking to use whatever hare-brained plan they can think of to try and stop the process.
We call upon citizens to continue to demand adherence to the Constitution. Elections are like Christmas, you can’t postpone them as they will come whether or not you have new clothes.
Elections are a Constitutional non-negotiable. Citizens must be at the centre of all national processes.
We reject the notion of elite pacts or a Government of National Unity or whatever basis put forward.
Done properly, elections are a true expression of the will of the people and a total necessity in a democracy.

MDC-T leader Douglas Mwonzora recently challenged the Zimbabwe Electoral Commission (ZEC)’s delimitation report.
Some commentators have suggested that the court challenge may lead to the deferment of the elections, which may lead to a GNU as the country prepares for another election.
In his court application, Mwonzora argued that the final delimitation report did not take into account the final results of the population census among other issues.
He argued that such issues will affect the credibility of the elections and thus his application seeks to ensure credible elections are held using a credible delimitation report.
Mwonzora goes on to say that in the event that elections are held with the report in question, the results can be easily challenged before a court of law and be invalidated.
A political analyst, Alexander Rusero dismissed claims that Mwonzora’s court challenge is a tactic by ZANU PF to postpone the general elections.
Since Mwonzora controversially took control of the MDC in 2020, critics claim he has been working with the ruling ZANU PF party to derail the “democratic project”. Said Rusero:

I think people have to understand why Mwonzora had taken the case to the court beyond the conspiracy theories doing circles that he is Mnangagwa’s blue-eyed boy intending to delay elections, that is a misleading statement and fallacy which is very costly to the opposition because ZANU PF wants those elections, they are not afraid and are prepared regardless of all such claims doing rounds in the misguided opposition rank and file.
Politics is the ability to determine outcomes and Mwonzora might be politically irrelevant in as much as the gravitas on the grassroots on the ground is concerned but you cannot take away his legal talents and prowess as he is one of the best lawyers produced in Zimbabwe since 1980.
So I am very sure he picked certain loopholes in the whole delimitation exercise that warrants court attention and that is why the case was given the green light that it warrants a hearing by the full bench.
There is really nothing to take away from that since it is not the first time a case has been granted such kind of attention by the courts.
Suppose Mwonzora wins that does not have a bearing on issues politically or at law to do with the proclamation of election dates or some possibilities of delaying an election.
The whole idea is, should he win because the case has been positively perceived to have some merits, ZEC can be directed to do certain things right and not necessarily to delay or stop the process of elections.
Elections are conducted when they are constitutionally due and not when a country is ready or ZEC has exposed certain incompetences or not political parties are ready. Elections are done within the prescribed time frame.

Rusero argued that the way ZANU PF has been campaigning does not indicate that the ruling party is considering the possibility of delaying elections.

Elections Are Like Christmas, You Can’t Postpone Them - Mahere

<h2>Full statement by Citizens’ Coalition for Change (CCC) spokesperson Fadzayi Mahere to mark Zimbabwe’s 43rd Independence Anniversary on 18 April 2023.</h2>

Today, Zimbabwe celebrates 43 years of independence. We join the nation in honouring this important day as we look to the sacrifice made by those who fought on our behalf for the constitutional entitlement of one man, one vote.
The liberation struggle was anchored on the fight for free, fair and credible elections.
We seek to complete the mission this year to ensure we win Zimbabwe for change by winning the election and taking power.
As a citizens’ movement, the Citizens’ Coalition for Change acknowledges the effort and sacrifices of the soldiers, war veterans, war collaborators and citizens, living and departed, who contributed to attaining the liberation of our nation from colonial rule.
We acknowledge and respect all national processes that relate to the history and legacy of Zimbabwe as this is the collective definition of our identity as a people.
Independence Day belongs to all Zimbabwean citizens. It is a national event which, in a functional nation, ought to be inclusive, non-partisan and be a moment of pride and celebration for all members of our society.
When our forebears took up arms, they were guided by liberation ideals including universal adult suffrage, sovereignty of the people and their will, as well as shared prosperity for the masses.
For this reason, the movement participates in these platforms, standing on the belief that these are national events, not partisan processes. We do so for our country and for the collective being of the people.
As election day beckons, we are mindful that the 43-year-old bad governance crisis has rendered the Liberation promise empty. Our aspirations for Zimbabwe are yet to be realized.
The latest corruption expose betrays a sad pattern of a rich nation being poorly managed and looted by political elites at the expense of the citizens.
Like every other corruption scandal that has preceded it over the last 43 years, it is an indictment of the liberation dream and the promise of independence.
This is not the Zimbabwe that the citizens had hoped for. We urge every citizen to ensure that they perform their civic duty by voting en mass in the coming election for ethical, competent leaders who will usher in a New Great Zimbabwe with dignity, prosperity and freedom for all.
